AccordingtothelaborlawofthePeople'sRepublicofChinaandrelatedlawsandregulations,partyaandpartybinlinewiththeprinciplesofequality,voluntary,consensus,theshorttermlaborcontract,abidebythetermsofthiscontract.
I.termofemploymentcontract
Thiscontractcomesintoeffecton2018.10.1andendson2019.10.1:
(I)partybagreestoworkinthepositionaccordingtopartya'srequirements.
(2)partyamayreasonablyadjustpartyb'sworkposition(includingdepartments,worksorduties)accordingtotheneedsofproductionandoperationandtheperformanceofpartyb.
(iii)partybshallcompletetheworktasksontime,quantityandqualityaccordingtotheresponsibilitiesdeterminedbypartya.
Laborprotectionandworkingconditions
1.Partyashall,inaccordancewiththerelevantlaborprotectionregulationsofthestate,providethelaborandworkplaceconformingtothenationallaborandhealthstandards,andearnestlyprotectthesafetyandhealthofpartybinproductionwork.
2.Partyashallberesponsiblefortheeducationofpartyb'sworkethics,workstandards,laborsecurity,labordisciplineandpartya'srulesandregulations.
3.Partybshallstrictlyabidebypartya'sworkregulations,operatingprocedures,laborsafetyandhealthsystem,andconsciouslypreventaccidentsandoccupationaldiseases.
4.Partyashallarrangeovertimeforpartybtocomplywiththeprovisionsoflawsandregulations.Partybshallworkovertimeasmuchaspossible.
4.Workinghoursandtakingbreaks
1.Partyaandpartybagreetodeterminepartyb'sworkinghoursaccordingtostandardworkinghours;
Theworkneedstoarrangeovertimeforpartyb,accordingtolawtoarrangethesameamountoftimetomakeuporpayovertimepay;Alittle,partyashouldpaymore
5.Laborremunerationandperformance
1.Thesalaryofpartyb'snormalworkinghoursshallbeasfollows:
1.Partyb'ssalary16000yuan/month
2.Partyamayreasonablyadjustthesalaryofpartybaccordingtothebusinessconditionsoftheenterpriseandtheperformanceofpartybandtheadjustmentoftheworkposition;
Socialsecurityandwelfaretreatment
1.Duringthetermofthecontract,partyashall,accordingtolaw,handletheproceduresofsocialinsuranceforpartyb,andthesocialinsurancepremiumshallbeheldbypartyaandpartybinaccordancewiththeprescribedproportion.
7.Labordiscipline
1.Partybshallconscientiouslyabidebythelaws,regulations,rulesandregulationsformulatedbytheenterprisesinaccordancewiththelaw,strictlyobservethesafetyoperatingprocedures,obeythemanagement,andcompletetheworktasksontime;
2.Partybshallstrictlyabidebyallbusinessinformationofpartya,strictlyabidebypartya'sconfidentialitysystem,andguardpartya'sbusinesssecretsandconfidentialinformationrelatedtointellectualpropertyrights.Confidentialityandtermofconfidentialityshallbeagreedbetweenthepartiesinaconfidentialityagreement;
3.Partyashall,inaccordancewiththeproceduresandauthorityandworkrequirementsstipulatedbythestatelaw,formulaterulesandregulationsandlabordisciplineaccordingtolaw.Partybviolatesthelabordisciplineandpartya'srulesandregulations,andpartyashallhavetherighttohandletherulesandregulationsuntilthecontractisterminated.
4.Partybshallnotengageinotherbusinessorpart-timejobswithoutthewrittenconsentofpartya.
Viii.Performanceandchangeoflaborcontract
1.Partyaandpartybshall,inaccordancewiththeprovisionsofthelaborcontract,fullyperformtheirrespectiveobligations;
2.Partyaandpartybagreetochangethecontentsofthelaborcontract.Achangeoflaborcontractshallbeinwriting.
Ix.Change,cancellation,terminationandrenewaloflaborcontract
1.Bothpartiesagreetoterminatethelaborcontract.
2.Ifpartybhasoneofthefollowingcircumstances,partyamayterminatethelaborcontract:
1.Partybisprovedtobeinconsistentwiththeemploymentconditionsduringtheprobationperiod;
2.Partybseriouslyviolatespartya'srulesandregulations;
3.Seriousderelictionofdutyormalpractice,causingsignificantdamagetopartya;
4.Partybshallestablishlaborrelationswithotheremployingunitsatthesametime,whichwillhaveaseriousimpactonthecompletionofpartya'sworktasks,orpartyashallbethepartytorefusetocorrectanyofit;
5.Partybshallmakeorchangethelaborcontractinviolationoftherealmeaningofpartyabymeansoffraudorcoercionorbythedangerofhumanbeing,resultingininvalidlaborcontract;
6.Criminalresponsibilityshallbeinvestigatedaccordingtolaw.
Incaseofanyofthefollowingcircumstances,partyamayterminatethecontract,butshallnotifypartybinwriting30daysinadvance:
1.Ifpartybisillorisnotinjuredbythework,heshallnotbeengagedintheoriginalworkaftertheexpirationoftheprescribedmedicaltreatment,norshallheengageinotherworkarrangedbytheemployer.
2.Partybisnotqualifiedforthework;aftertrainingoradjustingtheworkposition,itisstillnotcompetentforthejob;
3,concludealaborcontractisbasedontheobjectiveconditionsofmaterialchange,causesthelaborcontractcannotperform,consultation,bypartyaandpartybfailedtochangethelaborcontractagreement;
4.Partybshallnotifypartyainwriting30dayspriortotheterminationofthiscontract.Partybshallnotdealwiththeeconomiclossescausedbypartyaorthecircumstancesunderwhichotherissuesareunderreview.Partybnotifiespartyathreedaysinadvanceduringtheprobationperiodtoterminatethelaborcontract;
5.Underanyofthefollowingcircumstances,thelaborcontractshallbeterminated:
1.Theexpirationofthelaborcontract;
2.Partybshallbegintoenjoybasicold-ageinsurancetreatmentaccordingtolaw;
3.Partybdiesorisdeclareddeadormissingbythepeople'scourt;
4.Partyaisdeclaredbankruptaccordingtolaw;
5.Partyaisrevokedofbusinesslicense,orderedtoclose,revokedordecidedtodisbandinadvance;
6.Othercircumstancesstipulatedbylawsandadministrativeregulations.
Liabilityforbreachofcontract
1.Ifpartybviolatestheintellectualpropertyconfidentialityagreementsignedbybothparties,partybshallpayliquidateddamagestopartyainaccordancewiththecontract.
2.Partybterminatethelaborcontractaftertheexpiryofthetrialandnotshifttoanearlierdate30daystoinform,orterminatethelaborcontractwithoutinsideprobation3daysnoticeinadvance,orattrition,therebycausinglosstotheotherparty,shallbeliableforcompensation,damages,includingbutnotlimitedtopartyatorecruitemploypartybpaysexpenses,trainingexpenses,thedirecteconomiclossescausedtotheproductionandbusinessoperationandthework.
3.Partybshallindemnifypartyaforalllossescausedbybreachoftheconfidentialityagreementandthedisclosureofpartya'sconfidentialinformationinaccordancewiththeconfidentialitysystemstipulatedbypartya.Partyashallhavetherighttoterminatethelaborcontractimmediatelyuponthediscoveryofbreachofconfidentialityagreementandconfidentialitysystem,andshallhavetherighttopaynoeconomiccompensationinaccordancewiththelaw.
Xi.Disputeresolution
Incaseofdisputebetweenthetwoparties,thecontractmaybesettledbynegotiation.Ifitisnotwillingtonegotiateornegotiate,itmayapplytothelabordisputearbitrationcommitteeofpartyaforarbitration;Ifitisnotsatisfiedwiththearbitrationaward,itmaybringasuitinthepeople'scourtofthedistrictwherepartyaislocated.
Xii.Otherprovisions
1.Allrulesandconfidentialityagreementsofpartyashallbeattachedtothecontractasannexesofthecontract(includingemployeehandbook,etc.),andshallbeequallyauthenticwiththiscontract.
2.Thecontractisnotcoveredinanywayorcontrarytotherelevantprovisionsofthefuturestateorhangzhoucity,andshallbecarriedoutinaccordancewithrelevantregulationsortheemployeehandbook.
3.Thiscontractismadeinduplicate,witheachpartyholdingonecopy.Thesignatureofthepartyaandpartybshallenterintoforce,andthealterationorsignatureshallnotbevalid.
3.Wagesarepaidasusualduringperiodsofabsenceduetoinspections。
4.Afteroneyear,thecontractends.Ifthecontractisrenewedforoneyear,itwillbeawarded5,000yuanonOctober1,2019.Ifitisnotrenewed,itwillnotbe.
