Article1

ThisLawhasbeenformulatedforthepurposesofstrengtheningportadministration,maintainingportsecurityandoperationorders,protectingthelegitimaterightsandinterestsofthepartiesconcernedandpromotingportconstructionanddevelopment.

Article2

ThisLawisapplicabletotheundertakingsofportplanning,construction,maintenance,operation,managementandtherelevantactivities.

Article3

Portshereinrefertotheareasofwaterandlandwithincertainrangewithcorrespondingdockfacilitiesoffunctionsforentryandexitofships,anchorage,moorage,offandonofpassengers,handlingofcommodities,lighterage,aswellasstorage.Portsmayconsistofoneormoreportareas.

Article4

TheStateCouncilandtherelevantlocalpeople'sgovernmentofandabovecountylevelshallintheplanonnationaleconomyandsocialdevelopmentembodytherequirementsforportdevelopmentandplanningandprotectandmakerationaluseoftheportresourcesbyforceoflaw.

Article5

Thestateencouragestheeconomicorganizationsandindividualsathomeandabroadtomakeinvestmentonconstructionandoperationofportsandprotectthelegitimaterightsandinterestsofinvestorsbyforceoflaw.

Article6

ThecompetenttrafficauthorityoftheStateCouncilisinchargeofthenationaladministrationofportworks.

Theadministrationofportsbylocalpeople'sgovernmentwithinitsadministrativedivisionshallbedeterminedaccordingtotheprovisionsontheportadministrativesystemoftheStateCouncil.Fortheportsundertheadministrationbythelocalpeople'sgovernmentofthecityandcountylevelaspertheportadministrativesystemdeterminedherein,thelocalpeople'sgovernmentconcernedshalldesignateadepartmentforactualimplementationoftheadministrativemanagementoftheportsconcerned;andfortheportsundertheadministrationbythepeople'sgovernmentoftheprovince,autonomousregionandmunicipalitydirectlyundertheCentralGovernment,thepeople'sgovernmentoftheprovince,autonomousregionandmunicipalitydirectlyundertheCentralGovernmentshalldesignateadepartmentforactualimplementationoftheadministrativemanagementoftheportsconcerned.

Thedepartmentsdeterminedhereinforactualimplementationoftheadministrativemanagementoftheportsarehereinafterreferredtoastheadministrativemanagementoftheports.

ChapterIIPortPlanningandConstruction

Article7

Portsplanningshouldbepreparedandcompiledaccordingtotherequirementsfornationaleconomyandsocialdevelopmentandthedemandsfordefenseconstruction,whichshallintheprincipleofrationalutilizationofthecoastalresourcesconformtotheplanningofurbanandtownshipsystemanddovetailandbeinharmonywiththeoveralllanduseplanning,overallurbanplanning,riverreachplanning,floodpreventionplanning,functionaldivisionofseas,developmentplanningofwaterwaytransportation,developmentplanningofothermeans,aswellasotherrelevantplanningspecifiedbylawsandadministrativelawsandregulations.

Thepreparationandcompilationofportsplanningshallwitnessexpertdemonstrationandevaluationofenvironmentalinfluencesbyforceoflaw.

Article8

Theportsplanningshallconsistofportlayoutplanningandoverallportplanning.

Theportlayoutplanningreferstothelayoutanddistributionplanningofports,includingnationalportlayoutplanningandportlayoutplanningoftheprovince,autonomousregionandmunicipalitydirectlyundertheCentralGovernment.

Theoverallportplanningreferstothespecificplanningofaportincertainperiod,includingthewaterandlandscopesoftheport,divisionoftheportarea,throughputandcategoriesofpotentialships,natureandfunctionsoftheport,utilizationofthewaterandlandareas,portfacilities,useofthecoastallinesbuilt,configurationofconstructionland,andsequencesforphasedconstruction,etc.Theoverallportplanningshallconformtotheportlayoutplanning.

Article9

ThenationalportlayoutplanningshouldbepreparedbythecompetenttrafficauthorityoftheStateCounciluponsolicitationoftheopinionsoftherelevantdepartmentsoftheStateCouncilandtherelevantmilitaryorgans,whichshouldberatifiedbytheStateCouncilbeforepromulgationandimplementation.

Theportlayoutplanningoftheprovince,autonomousregionandmunicipalitydirectlyundertheCentralGovernmentshallbepreparedandcompiledundertheorganizationofthepeople'sgovernmentoftheprovince,autonomousregionandmunicipalitydirectlyundertheCentralGovernment,whichshouldbesubmittedforsolicitationofopinionsformthecompetenttrafficauthorityoftheStateCouncilaccordingtothenationalportpayoutplanning.

IncasenoopinionshavebeenairedformodificationbythecompetenttrafficauthorityoftheStateCouncilwithinthirtydaysuponitsreceiptofthesolicitationofopinions,suchportlayoutplanningmaybepromulgatedforimplementationbythepeople'sgovernmentoftheprovince,autonomousregionandmunicipalitydirectlyundertheCentralGovernment;incasethecompetenttrafficauthorityoftheStateCouncilisoftheopinionthattheportlayoutplanningisnotincompliancewiththenationalportlayoutplanning,theopinionsonmodificationsshouldbeprovidedforwithinthirtydaysuponreceiptofthesolicitationofopinions;andincasethepeople'sgovernmentoftheprovince,autonomousregionandmunicipalitydirectlyundertheCentralGovernmentisindisputerwiththemodificationopinions,apetitionsmaybesubmittedfordecisionbytheStateCouncil.

Article10

Theoverallportplanningshouldbepreparedandcompiledbytheportadministrativedepartmentuponsolicitationofopinionsfromtherelevantdepartmentsandtherelevantmilitaryorgans.

Article11

Theoverallplanningoftheprincipalportsofimportantgeographicalpositions,largethroughputandwideinfluenceoneconomicdevelopmentshouldbepromulgatedforimplementationwithjointapprovalbythepeople'sgovernmentoftheprovince,autonomousregionandmunicipalitydirectlyundertheCentralGovernmentuponsolicitationbythecompetenttrafficauthorityoftheStateCouncilofopinionsfromtherelevantdepartmentoftheStateCouncilandtherelevantmilitaryorgans.ThedirectoryoftheprincipalportsshouldbedeterminedandpromulgateduponsolicitationbythecompetenttrafficauthorityoftheStateCouncilofopinionsfromtherelevantdepartmentoftheStateCouncil.

Thepeople'sgovernmentoftheprovince,autonomousregionandmunicipalitydirectlyundertheCentralGovernmentshalldeterminetheimportantportswithintheadministrativedivisionunderitsjurisdictionuponsolicitationofopinionsfromthecompetentauthorityoftheStateCouncil.Beforepromulgationandimplementation,theoverallplanningofimportantportsshouldberatifiedbythepeople'sgovernmentoftheprovince,autonomousregionandmunicipalitydirectlyundertheCentralGovernmentuponsolicitationofopinionsfromthecompetenttrafficauthorityoftheStateCouncil.

Theoverallplanningoftheportsotherthanthosespecifiedbytheabove-mentionedtwoparagraphsshouldbeapprovedbythelocalpeople'sgovernmentofcityandcountylevelbeforepromulgationandimplementation,whichshouldalsobesubmittedforfilingbythepeople'sgovernmentoftheprovince,autonomousregionandmunicipalitydirectlyundertheCentralGovernment.

Theoverallportplanningpreparedandcompiledbytheportadministrativedepartmentsofthepeople'sgovernmentofcityandcountylevelwithinthescopespecifiedbythefirstandsecondparagraphsofthisarticleshouldbereviewedandratifiedbythepeople'sgovernmentoftheproperlevelbeforesubmissionforratificationandapproval.

Article12

Themodificationoftheportplanningshouldbehandledwithincompliancewiththestatutoryproceduresforportplanning.

Article13

Theconstructionofportfacilitiesintheoverallplannedareasofportsanduseofthedeep-waterlinesofportsshouldbeapprovedbythecompetenttrafficauthorityoftheStateCounciljointlywiththecomprehensiveandmacro-controlandadjustmentdepartmentofeconomyoftheStateCouncil,andtheconstructionofportfacilitiesanduseofthedeep-waterlinesofportsshouldbeapprovedbytheportadministrativedepartments,providedthattheuseofportcoastallinesbytheprojectstobeconstructedwithapprovalbytheStateCouncilorthecomprehensiveandmacro-controlandadjustmentdepartmentofeconomyoftheStateCouncildoesnotrequireforseparatelyhandlingoftheproceduresrelatingtoapprovalforuseoftheportcoastallines.ThecompetenttrafficauthorityoftheStateCouncilshouldformulatethestandardsforthedeepcoastallinesofports.

Article14

Theportconstructionshallbeincompliancewiththeportplanningandnoportfacilitiesshouldbeconstructedinviolationoftheportplanning.

Article15

Theportconstructionprojectsrequiringforapprovalbytherelevantorganaccordingtothestateprovisions,shallgothroughtheexaminationandapprovalproceduresincomplia
