Preamble
TheStatesPartiestothisConvention,
Concernedabouttheseriousnessofproblemsandthreatsposedbycorruption
tothestabilityandsecurityofsocieties,underminingtheinstitutionsandvaluesof
democracy,ethicalvaluesandjusticeandjeopardizingsustainabledevelopmentand
theruleoflaw,
Concernedalsoaboutthelinksbetweencorruptionandotherformsofcrime,
inparticularorganizedcrimeandeconomiccrime,includingmoney-laundering,
Concernedfurtheraboutcasesofcorruptionthatinvolvevastquantitiesof
assets,whichmayconstituteasubstantialproportionoftheresourcesofStates,and
thatthreatenthepoliticalstabilityandsustainabledevelopmentofthoseStates,
Convincedthatcorruptionisnolongeralocalmatterbutatransnational
phenomenonthataffectsallsocietiesandeconomies,makinginternational
cooperationtopreventandcontrolitessential,
Convincedalsothatacomprehensiveandmultidisciplinaryapproachis
requiredtopreventandcombatcorruptioneffectively,
Convincedfurtherthattheavailabilityoftechnicalassistancecanplayan
importantroleinenhancingtheabilityofStates,includingbystrengthening
capacityandbyinstitution-building,topreventandcombatcorruptioneffectively,
Convincedthattheillicitacquisitionofpersonalwealthcanbeparticularly
damagingtodemocraticinstitutions,nationaleconomiesandtheruleoflaw,
Determinedtoprevent,detectanddeterinamoreeffectivemanner
internationaltransfersofillicitlyacquiredassetsandtostrengtheninternational
cooperationinassetrecovery,
Acknowledgingthefundamentalprinciplesofdueprocessoflawincriminal
proceedingsandinciviloradministrativeproceedingstoadjudicatepropertyrights,
Bearinginmindthatthepreventionanderadicationofcorruptionisa
responsibilityofallStatesandthattheymustcooperatewithoneanother,withthe
supportandinvolvementofindividualsandgroupsoutsidethepublicsector,suchas
civilsociety,non-governmentalorganizationsandcommunity-basedorganizations,
iftheireffortsinthisareaaretobeeffective,
Bearingalsoinmindtheprinciplesofpropermanagementofpublicaffairs
andpublicproperty,fairness,responsibilityandequalitybeforethelawandtheneed
tosafeguardintegrityandtofosteracultureofrejectionofcorruption,
CommendingtheworkoftheCommissiononCrimePreventionandCriminal
JusticeandtheUnitedNationsOfficeonDrugsandCrimeinpreventingand
combatingcorruption,

Recallingtheworkcarriedoutbyotherinternationalandregional
organizationsinthisfield,includingtheactivitiesoftheAfricanUnion,theCouncil
ofEurope,theCustomsCooperationCouncil(alsoknownastheWorldCustoms
Organization),theEuropeanUnion,theLeagueofArabStates,theOrganisationfor
EconomicCooperationandDevelopmentandtheOrganizationofAmericanStates,
Takingnotewithappreciationofmultilateralinstrumentstopreventand
combatcorruption,including,interalia,theInter-AmericanConventionagainst
Corruption,adoptedbytheOrganizationofAmericanStateson29March1996,1the
ConventionontheFightagainstCorruptioninvolvingOfficialsoftheEuropean
CommunitiesorOfficialsofMemberStatesoftheEuropeanUnion,adoptedbythe
CounciloftheEuropeanUnionon26May1997,2theConventiononCombating
BriberyofForeignPublicOfficialsinInternationalBusinessTransactions,adopted
bytheOrganisationforEconomicCooperationandDevelopmenton21November
1997,3theCriminalLawConventiononCorruption,adoptedbytheCommitteeof
MinistersoftheCouncilofEuropeon27January1999,4theCivilLawConvention
onCorruption,adoptedbytheCommitteeofMinistersoftheCouncilofEuropeon
4November1999,5andtheAfricanUnionConventiononPreventingand
CombatingCorruption,adoptedbytheHeadsofStateandGovernmentofthe
AfricanUnionon12July2003,
Welcomingtheentryintoforceon29September2003oftheUnitedNations
ConventionagainstTransnationalOrganizedCrime,6

Generalprovisions
Article1
Statementofpurpose
ThepurposesofthisConventionare:
(a)Topromoteandstrengthenmeasurestopreventandcombatcorruption
moreefficientlyandeffectively;
(b)Topromote,facilitateandsupportinternationalcooperationandtechnical
assistanceinthepreventionofandfightagainstcorruption,includinginasset
recovery;
(c)Topromoteintegrity,accountabilityandpropermanagementofpublic
affairsandpublicproperty.

Useofterms
ForthepurposesofthisConvention:
(a)“Publicofficial”shallmean:
(i)anypersonholdingalegislative,
executive,administrativeorjudicialofficeofaStateParty,whetherappointedor
elected,whetherpermanentortemporary,whetherpaidorunpaid,irrespectiveof
thatperson’sseniority;(ii)anyotherpersonwhoperformsapublicfunction,
includingforapublicagencyorpublicenterprise,orprovidesapublicservice,as
definedinthedomesticlawoftheStatePartyandasappliedinthepertinentareaof
lawofthatStateParty;(iii)anyotherpersondefinedasa“publicofficial”inthe
domesticlawofaStateParty.However,forthepurposeofsomespecificmeasures
containedinchapterIIofthisConvention,“publicofficial”maymeananyperson
whoperformsapublicfunctionorprovidesapublicserviceasdefinedinthe
domesticlawoftheStatePartyandasappliedinthepertinentareaoflawofthat
StateParty;
(b)“Foreignpublicofficial”shallmeananypersonholdingalegislative,
executive,administrativeorjudicialofficeofaforeigncountry,whetherappointed
orelected;andanypersonexercisingapublicfunctionforaforeigncountry,
includingforapublicagencyorpublicenterprise;
(c)“Officialofapublicinternationalorganization”shallmeanan
internationalcivilservantoranypersonwhoisauthorizedbysuchanorganization
toactonbehalfofthatorganization;
(d)“Property”shallmeanassetsofeverykind,whethercorporealor
incorporeal,movableorimmovable,tangibleorintangible,andlegaldocumentsor
instrumentsevidencingtitletoorinterestinsuchassets;
(e)“Proceedsofcrime”shallmeananypropertyderivedfromorobtained,
directlyorindirectly,throughthecommissionofanoffence;
(f)“Freezing”or“seizure”shallmeantemporarilyprohibitingthetransfer,
conversion,dispositionormovementofpropertyortemporarilyassumingcustody
orcontrolofpropertyonthebasisofanorderissuedbyacourtorothercompetent
authority;
(g)“Confiscation”,whichincludesforfeiturewhereapplicable,shallmean
thepermanentdeprivationofpropertybyorderofacourtorothercompetent
authority;
(h)“Predicateoffence”shallmeananyoffenceasaresultofwhichproceeds
havebeengeneratedthatmaybecomethesubjectofanoffenceasdefinedin
article23ofthisConvention;
(i)“Controlleddelivery”shallmeanthetechniqueofallowingillicitor
suspectconsignmentstopassoutof,throughorintotheterritoryofoneormore
States,withtheknowledgeandunderthesupervisionoftheircompetentauthorities,
withaviewtotheinvestigationofanoffenceandtheidentificationofpersons
involvedinthecommissionoftheoffence.

Article3
Scopeofapplication
1.ThisConventionshallapply,inaccordancewithitsterms,tothe
prevention,investigationandprosecutionofcorruptionandtothefreezing,seizure,
confiscationandreturnoftheproceedsofoffencesestablishedinaccordancewith
thisConvention.
2.ForthepurposesofimplementingthisConvention,itshallnotbe
necessary,exceptasotherwisestatedherein,fortheoffencessetforthinittoresult
indamageorharmtostateproperty.
Article4
Protectionofsovereignty
1.StatesPartiesshallcarryouttheirobligationsunderthisConventionina
mannerconsistentwiththeprinciplesofsovereignequalityandterritorialintegrity
ofStatesandthatofnon-interventioninthedomesticaffairsofotherStates.
2.NothinginthisConventionshallentitleaStatePartytoundertakeinthe
territoryofanotherStatetheexerciseofjurisdictionandperformanceoffunctions
thatarereservedexclusivelyfortheauthoritiesofthatotherStatebyitsdomestic
law.
ChapterII
Preventivemeasures
Article5
Preventiveanti-corruptionpoliciesandpractices
1.EachStatePartyshall,inaccordancewiththefundamentalprinciplesof
itslegalsystem,developandimplementormaintaineffective,coordinatedanticorruption
policiesthatpromotetheparticipationofsocietyandreflectthe
principlesoftheruleoflaw,propermanagementofpublicaffairsandpublic
property,integrity,transparencyandaccountability.
2.EachStatePartyshallendeavourtoestablishandpromoteeffective
practicesaimedatthepreventionofcorruption.
3.EachStatePartyshallendeavourtoperiodicallyevaluaterelevantlegal
instrumentsandadministrativemeasureswithaviewtodeterminingtheiradequacy
topreventandfightcorruption.
4.StatesPartiesshall,asappropriateandinaccordancewiththe
fundamentalprinciplesoftheirlegalsystem,collaboratewitheachotherandwith
relevantinternationalandregionalorganizationsinpromotinganddevelopingthe
