ISSUES
Theissuestobedecidedinthiscasearethefollowing:
1.ItisnotdisputedthatSudburydidnotprovideStudentwithanindividualizededucationprogram(hereinafter,IEP)forStudent’s5thgrade(2008-2009schoolyear).WasSudburyresponsibleforprovidinganIEPfor5thgrade?
2.Ifso,didParent’sunilateralplacementatTheCarrollSchoolprovideStudentwithafreeappropriatepubliceducationintheleastrestrictiveenvironment?
3.Ifso,isParententitledtoreimbursementforpartorallofherout-of-pocketexpensesforTheCarrollSchoolfor5thgrade?
4.IstheIEPmostrecentlyproposedbySudburyfor6thgrade(2009-2010schoolyear)reasonablycalculatedtoprovideStudentwithafreeappropriatepubliceducationintheleastrestrictiveenvironment?
5.Ifnot,didParent’sunilateralplacementatTheCarrollSchoolsatisfythisstandard?

EDUCATIONALPROFILEANDHISTORY
Student’sEducationalProfile
Student,wholiveswithhisParentsinSudbury,MA,attendsthe6thgradeatTheCarrollSchool(hereinafter,CarrollSchoolorCarroll)inLincoln,MA.StudenthasattendedCarrollsince3rdgrade,entirelyatprivateexpense.SudburyhasproposedthatStudentattenditsLanguageLearningDisabilities(hereinafterLLD)programwithinwhichhewouldbeinsmallgroup,pull-outclassesforEnglishlanguageartsandmathaswellasremedialeducationalservices,andhewouldbeplacedwithingeneraleducationforscienceandsocialstudies,wherehewouldreceivesupportservices.ExhibitsS-1,S-59.
Student,whohasaverageintelligence,iscuriousandinterestedinlearning.Healsohaslanguage-baseddeficitsinbothspokenandwrittenlanguageskills,withtheresultthathehasdifficultyexpressinghisideasandconveyinghisknowledgeverballyandinwriting.Morespecifically,Student’sdeficitsmanifestthemselvesindifficultieswithmathcalculations,spelling,readingfluency,writtenlanguage,andverbalcommunication.Studenthasrelativestrengthsinreadingcomprehensionandconceptualunderstandingofmath.TestimonyofDiette,Helmus,Pliner;exhibitsS-4,S-11,P-61.
Student’sacademicskillsaresignificantlybelowaverage.Inaddition,Studenthasemotionaldeficits,whicharesecondarytohislearningdeficits,sothatwhenhestrugglesintheclassroom(forexample,whenhedoesnotunderstandwhatishappening),hehasatendencytoshutdownorbecomeoppositional.Studenthasalsostruggledwithself-confidence.Hefrequentlyhasconflictswithadultswhoareinpositionsofauthority,withtheresultthathehasatendencytorefusehelpfromanadultifheisbeingsingledoutforassistanceatschool.TestimonyofDiette,Gold,Gregory,Brown,Helmus,Pliner;exhibitsS-7,S-11.
Studentalsohasauditoryprocessingdeficits,whichincludedifficultywithmishearing,backgroundnoise,integration,rateofprocessing,temporalprocessing(forexample,pitchdifferentiation,thusmakingitdifficulttohearwherethereisemphasisinspeech).Heisatriskofinaccuratelyperceivingauditoryinformation,particularlywheninformationispresentedinanoisybackground,involvesmultipleparts,ispresentedquicklyorcontainsunfamiliarlanguageconcepts.Student’sauditorydeficitsmakeitdifficultforhimtolearninarelativelylargeclassroom(e.g.,20ormorestudents).TestimonyofShubow;exhibitsS-3,S-18.
2004-2005schoolyear(1stgrade)
During2004-2005schoolyear,Studentwasrepeatingthe1stgradeataparochialschool(St.PaulX,locatedinWestHarwich)atprivateexpense.InMayandJune2005,therewasaneuropsychologicalevaluationofStudentbyJosephMoldover,PhD(theevaluationwasalsoreviewedandsignedbyAnnHelmus,PhD).TheevaluationwasconductedinordertoobtainabetterunderstandingofStudent’slearningneedsandtomakeeducationalrecommendations.TheevaluationfoundthatStudenthadasignificantlearningdisabilityandwas“athighriskfrombothanacademicandemotionalperspective.”ExhibitS-30(page16).
InAugustof2005,StudentunderwentamultidisciplinaryevaluationatFranciscanHospitalforChildren.Theevaluationincludedneurology,audiology,speech-language,occupationaltherapyandphysicaltherapyassessments.ExhibitsS-26,S-27,S-28,S-29.
StudentandParentslivedinSouthYarmouth,MA,duringthisschoolyear.TestimonyofParent.
2005-2006schoolyear(2ndgrade)
InOctober2005,SouthYarmouthPublicSchoolsreviewedtheabove-referencedmultidisciplinaryevaluationandneuropsychologicalevaluation,determinedStudenttobeeligibletoreceivespecialeducationservices,andproposedaninitialIEPforStudentfortheperiod10/4/05to10/04/06.(In2003and2004,DennisYarmouthhaddeterminedStudenttobeineligibleforspecialeducationservices.)TheIEPcalledfor40minutesofspecializedinstructioneachdaywithintheregulareducationclassroomforeachofthefollowingtwoareas:
languageartsandmath.Inaddition,theIEPproposed40minutes,twiceperweekofspeech-languageservices.Nopull-outserviceswereproposed.TheIEPdoesnotindicatethatitwasacceptedorrejectedbyParents.ExhibitS-31.
InMay2006,aneuropsychologicalre-evaluationwasconductedbyDr.MoldoveratParents’requestinordertomonitorStudent’sprogresssinceDr.Moldover’spriorneuropsychologicalassessmentandtomakeeducationalrecommendations.Atthetimeofthisre-evaluation,StudentwascontinuingtoattendStPaulX,withsupportfromaprivatetutorandin-classaide.TheevaluationcontinuedtosupportthepriordiagnosisofLanguageBasedLearningDisability.ExhibitS-24(page5).
Theneuropsychologicalreportstated,inpart,thatDr.Moldover“stronglysupport[s][Parents’]decisiontoplace[Student]inaself-contained,language-basedprogramforthe3rdgrade.Intheabsenceofthislevelofintensivesupport,Iwouldviewhimasachildwhoisathighrisknotonlyforlackofacademicprogressbutalsoforgrowingemotionaldistress.…[Student’s]academicinstructionshouldtakeplaceinasettinginwhichallacademicsubjectsaretaughtbyspecialeducationteachersimplementingacoordinated,consistenteducationalprogramdesignedtomeet[Student’s]cognitiveprofile.[Student]shouldbeinaclassroomwithsixtoeightotherchildrenmatchedtohislevelofdevelopment….”ExhibitS-24(page5).
2006-2007schoolyear(3rdgrade)
ParentmovedfromSouthYarmouthtoSudbury,MAandplacedhersonatCarrollSchoolinLincoln,MAasa3rdgraderforthe2006-2007schoolyear.TestimonyofParent.
AftermovingtoSudburyandplacingStudentatCarroll,ParentmetwiththeSudburyout-of-districtcoordinator(LuanDean)onNovember3,2006.ParentexplainedtoMs.DeanthathersonhadbeenplacedatCarroll.ParenttestifiedthatshemetwithMs.Deanforthepurposeofseekingfundingforherson’splacementatCarroll.But,shealsotestifiedthatanotherpurposeinmeetingwithMs.DeanwasherwantingtodeterminewhetherSudburyhadanappropriatepublicschoolsprogramforhersonin3rdgrade.Ms.Dean,ontheotherhand,testifiedthatduringthemeeting,Parentmadeclearthatshewasnotseekingpublicschoolservices.Apparently,theNovember3,2006meeting
