COMPLIANCEWITHLAWS[paragraph4ofEICC]:
"FundamentaltoadoptingtheCodeistheunderstandingthatabusiness,inallofitsactivities,mustoperateinfullcompliancewiththelaws,rulesandregulationsofthecountriesinwhichitoperates."
SectionA-LaborAuditFindings:
A1)FreelyChosenEmployment
Forced,bondedorindenturedlabororinvoluntaryprisonlaborisnottobeused.Allworkwillbevoluntary,andworkersshouldbefreetoleaveuponreasonablenotice.Workersshallnotberequiredtohandovergovernment-issuedidentification,passportsorworkpermitsasaconditionofemployment.
A2)ChildLaborAvoidance
Childlaborisnottobeusedinanystageofmanufacturing.Theterm“child”referstoanypersonemployedundertheageof15(or14wherethelawofthecountrypermits),orundertheageforcompletingcompulsoryeducation,orundertheminimumageforemploymentinthecountry,whicheverisgreatest.Theuseoflegitimateworkplaceapprenticeshipprograms,whichcomplywithalllawsandregulations,issupported.Workersundertheageof18shouldnotperformhazardousworkandmayberestrictedfromnightworkwithconsiderationgiventoeducationalneeds.
A3)WorkingHours
Studiesofbusinesspracticesclearlylinkworkerstraintoreducedproductivity,increasedturnoverandincreasedinjuryandillness.Workweeksarenottoexceedthemaximumsetbylocallaw.Further,aworkweekshouldnotbemorethan60hoursperweek,includingovertime,exceptinemergencyorunusualsituations.Workersshallbeallowedatleastonedayoffperseven-dayweek.
A4)WagesandBenefits
Compensationpaidtoworkersshallcomplywithallapplicablewagelaws,includingthoserelatingtominimumwages,overtimehoursandlegallymandatedbenefits.Incompliancewithlocallaws,workersshallbecompensatedforovertimeatpayratesgreaterthanregularhourlyrates.Deductionsfromwagesasadisciplinarymeasureshallnotbepermitted.Thebasisonwhichworkersarebeingpaidistobeprovidedinatimelymannerviapaystuborsimilardocumentation.
A5)HumaneTreatment
Thereistobenoharshandinhumanetreatment,includinganysexualharassment,sexualabuse,corporalpunishment,mentalorphysicalcoercionorverbalabuseofworkers;noristheretobethethreatofanysuchtreatment.
A6)Non-Discrimination
Participantsshouldbecommittedtoaworkforcefreeofharassmentandunlawfuldiscrimination.Companiesshallnotengageindiscriminationbasedonrace,color,age,gender,sexualorientation,ethnicity,disability,pregnancy,religion,politicalaffiliation,unionmembershipormaritalstatusinhiringandemploymentpracticessuchaspromotions,rewards,andaccesstotraining.Inaddition,workersorpotentialworkersshouldnotbesubjectedtomedicalteststhatcouldbeusedinadiscriminatoryway.
A7)FreedomofAssociation
Opencommunicationanddirectengagementbetweenworkersandmanagementarethemosteffectivewaystoresolveworkplaceandcompensationissues.Participantsaretorespecttherightsofworkersasestablishedbylocallawtoassociatefreelyonavoluntarybasis,seekrepresentation,joinorberepresentedbyWorksCouncils,andjoinornotjoinlaborunionsandbargaincollectivelyastheychoose.Asprovidedbylaw,employeeswhobecomeworkerrepresentativesshallnotbethesubjectofdiscriminationandshallhaveaccesstomanagementandco-workersinordertocarryouttheirrepresentativefunctions.Workersshallbeabletocommunicateopenlywithmanagementregardingworkingconditionswithoutfearofreprisal,intimidationorharassment.Insayingthatworkerrightsaretoberespectedasestablishedorprovidedbylocallaw,whatHPmeansisthatincountriesthathavelegalsystemsthatsupportthoserights,theyaretobeunderstoodinthecontextofthedefinitions,conditionsandproceduresthatlocallawprovides.However,basicworkerrightstoopencommunication,directengagementandhumaneandequitabletreatmentmustberespectedevenincountrieswheretheyarenotgivenmeaningfullegalprotection.Whereworkerrepresentationandcollectivebargainingarerestrictedbylaw,participantsaretofacilitateopencommunicationanddirectengagementbetweenworkersandmanagementasalternativewaysofensuringthatworkers’rights,needsandviewareconsideredandacteduponappropriatelyandingoodfaith.

B1)OccupationalSafety
Workerexposuretopotentialsafetyhazards(e.g.,electricalandotherenergysources,fire,vehicle,andfallhazards)aretobecontrolledthroughproperdesign,engineeringandadministrativecontrols,preventivemaintenanceandsafeworkprocedures(includinglockout/tagout).Wherehazardscannotbeadequatelycontrolledbythesemeans,workersaretobeprovidedwithappropriatepersonalprotectiveequipment.Workersshallnotbedisciplinedforraisingsafetyconcerns.
B2)EmergencyPreparedness
Emergencysituationsandeventsaretobeidentifiedandassessed,andtheirimpactminimizedbyimplementingemergencyplansandresponseprocedures,including:
emergencyreporting,employeenotificationandevacuationprocedures,workertraininganddrills,appropriatefiredetectionandsuppressionequipment,adequateexitfacilitiesandrecoveryplans.
B3)OccupationalInjuryandIllness
Proceduresandsystemsaretobeinplacetomanage,trackandreportoccupationalinjuryandillness,includingprovisionsto:
a)encourageworkerreporting;b)classifyandrecordinjuryandillnesscases;c)providenecessarymedicaltreatment;d)investigatecasesandimplementcorrectiveactionstoeliminatetheircauses;andd)facilitatereturnofworkerstowork.
B4)IndustrialHygiene
Workerexposuretochemical,biologicalandphysicalagentsistobeidentified,evaluated,andcontrolled.Whenhazardscannotbeadequatelycontrolledbyengineeringandadministrativemeans,workersaretobeprovidedwithappropriateprotectiveequipment.
B5)PhysicallyDemandingWork
Workerexposuretophysicallydemandingtasks,includingmanualmaterialhandlingandheavylifting,prolongedstandingandhighlyrepetitiveorforcefulassemblytasksistobeidentified,evaluatedandcontrolled.
B6)MachineSafeguarding
Physicalguards,interlocksandbarriersaretobeprovidedandproperlymaintainedformachineryusedbyworkers.
B7)DormitoryandCanteen
Workersaretobeprovidedwithcleantoiletfacilities,accesstopotablewaterandsanitaryfoodpreparationandstoragefacilities.Workerdormitorie
