COUNCILDIRECTIVE1999/13/ECof11March1999onthelimitationofemissionsofvolatileorganiccompoundsduetotheuseoforganicsolventsincertainactivitiesandinstallations
THECOUNCILOFTHEEUROPEANUNION,
HavingregardtotheTreatyestablishingtheEuropeanCommunity,andinparticularArticle130s
(1)thereof,
HavingregardtotheproposalfromtheCommission
(1),
HavingregardtotheopinionoftheEconomicandSocialCommittee
(2),
ActinginaccordancewiththeprocedurelaiddowninArticle189coftheTreaty(3),
(1)WhereastheEuropeanCommunityactionprogrammeontheenvironmentapprovedbytheCouncilandtherepresentativesoftheGovernmentsoftheMemberStatesmeetingwithintheCouncilbyresolutionsof22November1973(4),17May1977(5),7February1983(6),19October1987(7)and1February1993(8)stressestheimportanceofthepreventionandreductionofairpollution;
(2)Whereasinparticulartheresolutionof19October1987emphasisestheimportanceofCommunityactiontoconcentrate,interalia,onimplementationofappropriatestandardsinordertoensureahighlevelofpublichealthandenvironmentalprotection;
(3)WhereastheEuropeanCommunityanditsMemberStatesarepartiestotheProtocoltothe1979ConventiononLong-RangeTransboundaryAirPollutionconcerningthecontrolofemissionsofvolatileorganiccompoundsinordertoreducetheirtransboundaryfluxesandthefluxesoftheresultingsecondaryphotochemicaloxidantproductssoastoprotecthumanhealthandtheenvironmentfromadverseeffects;
(4)WhereaspollutionduetovolatileorganiccompoundsinoneMemberStateofteninfluencestheairandwaterofotherMemberStates;whereas,inaccordancewithArticle130roftheTreaty,actionatCommunitylevelisnecessary;
(5)Whereas,becauseoftheircharacteristics,theuseoforganicsolventsincertainactivitiesandinstallationsgivesrisetoemissionsoforganiccompoundsintotheairwhichcanbeharmfulforpublichealthand/orcontributestothelocalandtransboundaryformationofphotochemicaloxidantsintheboundarylayerofthetropospherewhichcausedamagetonaturalresourcesofvitalenvironmentalandeconomicimportanceand,undercertainexposureconditions,hasharmfuleffectsonhumanhealth;
(6)Whereasthehighincidenceofhightroposphericozoneconcentrationsinrecentyearshastriggeredwidespreadconcernregardingtheimpactonpublichealthandtheenvironment;
(7)Whereas,therefore,preventiveactionisrequiredtoprotectpublichealthandtheenvironmentagainsttheconsequencesofparticularlyharmfulemissionsfromtheuseoforganicsolventsandtoguaranteecitizenstherighttoacleanandhealthyenvironment;
(8)Whereasemissionsoforganiccompoundscanbeavoidedorreducedinmanyactivitiesandinstallationsbecausepotentiallylessharmfulsubstitutesareavailableorwillbecomeavailablewithinthecomingyears;whereas,whereappropriatesubstitutesarenotavailable,othertechnicalmeasuresshouldbetakentoreduceemissionsintotheenvironmentasmuchaseconomicallyandtechnicallyfeasible;
(9)Whereastheuseoforganicsolventsandtheemissionsoforganiccompoundswhichhavethemostseriouseffectsonpublichealthshouldbereducedasmuchastechnicallyfeasible;
(10)WhereasinstallationsandprocesseswhichfallunderthisDirectiveshouldatleastberegisterediftheyarenotsubjecttoauthorisationunderCommunityornationallegislation;
(11)Whereasexistinginstallationsandactivitiesshould,whereappropriate,beadaptedsothatwithinanappropriateperiodtheymeettherequirementsestablishedfornewinstallationsandactivities;whereasthatperiodshouldbeconsistentwiththetimetableforcomplianceofCouncilDirective96/61/ECof24September1996concerningintegratedpollutionpreventionandcontrol(9);
(12)Whereastherelevantpartsofexistinginstallationswhichundergosubstantialchangemust,asamatterofprinciple,meetthenewinstallationstandardsforthesubstantiallychangedequipment;
(13)Whereasorganicsolventsareusedbymanydifferenttypesofinstallationsandactivitiessothat,inadditiontogeneralrequirements,specificrequirementsshouldbedefinedand,atthesametime,thresholdsforthesizeoftheinstallationsoractivitieswhichhavetocomplywiththisDirective;
(14)Whereasahighlevelofenvironmentalprotectionrequiresthesettingandachievementofemissionlimitsfororganiccompoundsandappropriateoperatingconditions,inaccordancewiththeprincipleofbestavailabletechniques,forcertaininstallationsandactivitiesusingorganicsolventswithintheCommunity;
(15)WhereasinsomecasesMemberStatesmayexemptoperatorsfromcomplyingwiththeemissionlimitvaluesbecauseothermeasures,suchastheuseoflow-solventorsolvent-freeproductsortechniques,providealternativemeansofachievingequivalentemissionreductions;
(16)Whereasemission-limitingmeasuresadoptedbeforetheentryintoforceofthisDirectiveshouldbetakenintoaccountinanappropriateway;
(17)WhereasalternativeapproachestoreductionmayallowtheobjectivesofthisDirectivetobeachievedmoreeffectivelythanbyimplementinguniformemissionlimitvalues;whereas,therefore,MemberStatesmayexemptexistinginstallationsfromcompliancewiththeemissionlimitsiftheyimplementanationalplan,whichwill,withinthetimetableforimplementationofthisDirective,leadtoanatleastequalreductioninemissionsoforganiccompoundsfromtheseactivitiesandinstallations;
(18)WhereasexistinginstallationsfallingunderDirective96/61/ECwhicharecoveredbyanationalplancanundernocircumstancesbeexemptedfromtheprovisionsofthatDirective,includingArticle9(4)thereof;
(19)Whereasinmanycasessmallandmedium-sized,newandexistinginstallationsmaybeallowedtocomplywithsomewhatlessstringentrequirementstomaintaintheircompetitiveness;
(20)Whereasfordrycleaningazerothresholdisappropriate,subjecttospecifiedexemptions;
(21)Whereasmonitoringofemissionsisrequired,includingtheapplicationofmeasurementtechniques,toassessthemassconcentrationsorthequantityofthepollutantswhosereleaseintotheenvironmentispermitted;
(22)Whereasoperatorsshouldreduceemissionsoforganicsolvents,includingfugitiveemissions,andoforganiccompounds;whereasasolventmanagementplanisanimportanttooltoverifythis;whereas,althoughguidancemaybegiven,thesolventmanagementplanisnotdevelopedtothestagewhereaCommunitymethodologycanbeestablished;
(23)WhereasMemberStateshavetoestablishaproceduretobefollowedandmeasurestobetakenwhereemissionlimitationsareexceeded;
(24)WhereastheCommissionandtheMemberStatesshouldcollaborateinordertoensurethatinformationontheimplementationofthisDirectiveandontheprogressofsubstitutionoptionsisexchanged,
HASADOPTEDTHISDIRECTIVE:
Article1Purposeandscope
ThepurposeofthisDirectiveistopreventorreducethedirectandindirecteffectsofemissionsofvolatileorganiccompoundsintotheenvironment,mainlyintoair,andthepotentialriskstohumanhealth,byprovidingmeasuresandprocedurestobeimplementedfortheactivitiesdefinedinAnnexI,insofarastheyareoperatedabovethesolventconsumptionthresholdslistedinAnnexIIA.
Article2Definitions
ForthepurposesofthisDirective:
1.installationshallmeanastationarytechnicalunitwhereoneormoreactivitiesfallingwithinthescopedefinedinArticle1arecarriedout,andanyotherdirectlyassociatedactivitieswhichhaveatechnicalconnectionwiththeactivitiescarriedoutonthatsiteandwhichcouldhaveaneffectonemissions;
2.existinginstallationshallmeananinstallationinoperationor,inaccordancewithlegislationexistingbeforethedateonwhichthisDirectiveisbroughtintoeffect,aninstallationwhichisauthorisedorregisteredor,intheviewofthecompetentauthority,thesubjectofafullrequestforauthorisation,providedthattheinstallationisputintooperationnolaterthanoneyearafterthedateonwhichthisDirectiveisbroughtintoeffect;
3.smallinstallationshallmeananinstallationwhichfallswithinthelowerthresholdbandofitems1,3,4,5,8,10,13,16or17ofAnnexIIAorfortheotheractivitiesofAnnexIIAwhichhaveasolventconsumptionoflessthan10tonnes/year;
4.substantialchange
-foraninstallationfallingwithinthescopeofDirective96/61/EC,shallhavethedefinitionspecifiedinthatDirective,
-forasmallinstallation,shallmeanachangeofthenominalcapacityleadingtoanincreaseofemissionsofvolatileorganiccompoundsofmorethan25%.Anychangethatmayhave,intheopinionofthecompetentauthority,significantnegativeeffectsonhumanhealthortheenvironmentisalsoasubstantialchange,
-forallotherinstallations,shallmeanachangeofthenominalcapacityleadingtoanincreaseofemissionsofvolatileorganiccompoundsofmorethan10%.Anychangethatmayhave,intheopinionofthecompetentauthority,significantnegativeeffectsonhumanhealthortheenvironmentisalsoasubstantialchange;
5.competentauthorityshallmeantheauthorityorauthoritiesorbodiesresponsibleunderthelegalprovisionsoftheMemberStatesforcarryingouttheobligationsarisingfromthisDirective;
6.operatorshallmeananynaturalorlegalpersonwhooperatesorcontrolstheinstallationor,wherethisisprovidedforinnationallegislation,towhomdecisiveeconomicpoweroverthetechnicalfunctioningoftheinstallationhasbeendelegated;
7.authorisationshallmeanawrittendecisionbywhichthecompetentauthoritygrantspermi
