GeneralPrinciples
Article1ThisLawisformulatedtoassurefoodsafetyandsafeguardpeople’shealthandlife.
Article2ThefollowingbusinessactivitiescarriedoutwithintheterritoryofthePeople’sRepublicofChinashallabidebythisLaw:
1)Foodproductionandprocessing(hereinafterreferredtoas“foodproduction”);foodsalesandcateringservice(hereinafterreferredtoas“trading”);
2)Productionandtradingoffoodadditives;
3)Productionandtradingofpackingmaterials,containers,detergents/disinfectantsforfoods,aswellastoolsandequipmentusedinfoodproductionandtrading(hereafterreferredtoas“food-relatedproducts”);
4)Foodadditivesandfood-relatedproductsusedbyfoodproducersandtraders;
5)Foodstorageandtransportation;
6)Safetymanagementoffood,foodadditivesandfood-relatedproducts.
Thequalityandsafetymanagementofprimaryagriculturalproductsforconsumption(hereinafterreferredtoas“edibleagriculturalproducts”)shallabidebytheLawofthePeople’sRepublicofChinaonQualityandSafetyofAgriculturalProducts.However,themarketingandsalesofedibleagriculturalproducts,developmentofrelevantqualitysafetystandardsandpublishingofrelevantsafetyinformationaswellasthequalityandsafetymanagementofagriculturalinputscoveredbythisLawshallabidebythisLaw.
Article3Foodsafetyworkshallfollowtheprinciplesof“puttingpreventionfirst,risk-basedmanagement,whole-processcontrol,andmakingeffortsbythewholesociety”,aimingtoestablishthescientificandstrictsupervisionandadministrationsystem.
Article4Foodproducersandtradersshalltakeresponsibilitiesforfoodproducedandtraded.
Foodproducersandtradersshallfollowlaws,regulationsandfoodsafetystandardsintheiroperation.Theyarerequiredtoensurethefoodsafety,behonestandself-disciplined,beresponsibleforthesocietyandthepublic,acceptsupervisionandadministrationbethepublic,andbearthesocialresponsibilities.
Article5TheStateCouncilestablishestheFoodSafetyCommittee,andassignsresponsibilitiestotheCommittee.
TheChinaFoodandDrugAdministration(CFDA)undertheStateCouncil,inaccordancewiththisLawandtheresponsibilitiesidentifiedbytheStateCouncil,supervisionandadministrationsfoodproductionandtradingactivities.
TheStateCouncilhealthadministrativedepartment(theNationalHealthandFamilyPlanningCommission,NHFPC),inaccordancewiththisLawandtheresponsibilitiesidentifiedbytheStateCouncil,conductsfoodsafetyrisksurveillance,riskassessment,anddevelopsandpublishesnationalfoodsafetystandardsjointlywiththeCFDA.
OtherministriesundertheStateCouncilshallundertakerelevantfoodsafetyworkinaccordancewiththisLawandresponsibilitiesidentifiedbytheStateCouncil.
Article6Countyandabovelevelgovernmentsshallberesponsibleforthefoodsafetysupervisionandmanagementintheregion;itshalllead,organizeandcoordinatefoodsafetysupervisionandadministrationwork,aswellasrespondtofoodsafetyincidents,establish/improvethewholeprocessfoodsafetymanagementmechanismandtheinformationsharingmechanism.
Countyandabovelevelgovernments,inaccordancewiththisLawandprovisionsoftheStateCouncil,determinestheresponsibilitiesofthefoodanddrugadministration,thehealthadministrativedepartmentandotherrelevantdepartmentsofthesamelevels;relevantdepartmentsshallberesponsibleforfoodsafetysupervisionandadministrationaccordingly.
Thecounty-levelfoodanddrugadministrationcouldestablishresidentagenciesintownsorcertaindistricts.
Article7Thecountyandabovelevelgovernmentsshallenforcethefoodsafetyaccountabilitysystem.Higherlevelgovernmentevaluatesandappraisesthefoodsafetysupervisionandadministrationworkbythelowerlevelgovernments.Countyandabovelevelgovernmentsshallevaluateandappraisefoodsafetysupervisionandadministrationworkbythefoodanddrugadministrationandotherdepartmentsofthesamelevel.
Article8Thecountyandabovelevelgovernmentsshallincorporatefoodsafetyworkintothelocaleconomicandsocialdevelopmentplan,includetheexpensesforfoodsafetyworkintothegovernmentfinancialbudget,reinforcecapacitybuildingforfoodsafetysupervisionandadministration,andprovidenecessarysupportstosafeguardfoodsafetyworks.
Thecountyandabovelevelfoodanddrugadministrationandotherrelevantdepartmentsshallstrengthencommunicationandcoordination,exercisetherightsandbeartheresponsibilities.
Article9Foodindustryassociationsshallplaymultipleroles,suchasreinforceself-disciplineoftheindustry,establishtheindustryrulesandtheawarding/penaltymechanismpursuanttotheircharters,provideservicessuchasfoodsafetyinformationandtechnologies,guideandmotivatefoodproducersandtraderstoengageinproductionandtradingaccordingtolaws,promotethecreditbuildingofindustry,publish/popularizefoodsafetyinformation,etc.
ConsumerassociationsorotherconsumerorganizationsarethesocialpowersthatoversightactivitiesthatviolatethisLawandharmtheconsumers’lawfulrights.
Article10Thegovernmentsatalllevelsshallstrengthenpubliceducationoffoodsafety,encouragessocialorganizations,communitygroupsandfoodproducers/traderstoconducteducationalactivitiesregardingfoodsafetylawsandregulations,standardsandknowledge,toadvocatehealthydiets,andtoraiseconsumers’foodsafetyawarenessandself-protection.
Themediashalllaunchpublicityforthefoodsafetylaws,regulations,standardsandknowledge,andprovidepublicoversightonactsthatviolatetheLaw.Publicityandreportsoffoodsafetyissuesshallbetruthfulandfair.
Article11Chinaencouragesandsupportsbasicandappliedresearchrelatedtofoodsafety;foodproducersandtradersareencouragedandsupportedtoadoptadvancedtechnologiesandmanagementpracticestoimprovefoodsafety.
Chinaputsinpracticestrictmanagementsystemsontheuseofpesticides,expeditestheobsoleteofextremepoisonouspesticides,highlytoxicpesticidesandhigh-persistentpesticides,promotesthedevelopmentandapplicationofalternativeproductsandencouragestheuseofhigh-effective,low-toxicandless-persistentpesticides.
Article12Anyorganizationorindividualhastherighttoreportviolationstofoodsafety;theyhavethelawfulrighttoinquirefoodsafetyinformationfromrelevantgovernmentagenciesandprovidecommentsandsuggestionsaboutfoodsafetysupervisionandadministrationwork.
Article13Anyentityandindividualthathavemadeoutstandingcontributionsintheworkofguaranteeingfoodsafetyshallbecommendedandrewardedinaccordancewiththerelevantnationalprovisions.
Chapter2:
FoodSafetyRiskSurveillanceandAssessment
Article14Chinaestablishesthefoodsafetyrisksurveillancesystem,whichmonitorsfood-bornediseases,foodcontaminationandotherfood-relatedhazards.
NHFPC,CFDAandAQSIQjointlydevelopandenforcethenationalfoodsafetyrisksurveillanceplan.
CFDAandotherministries,obtaininginformationoffoodsafetyrisks,shallverifysuchinformationimmediatelyandnotifytheNHFPC.TheNHFPC,receivingnotifiesoffoodsafetyrisks,food-bornediseasesbythemedicalinstitutes,etc.,willworkwithrelevantministriesandcarryoutresearchandanalysis.Ifdeemsnecessary,thenationalfoodsafetyrisksurveillanceplanwillbeadjusted.
Basedonthenationalsurveillanceplan,theprovincial,autonomousregionalandmunicipalhealthadministrativedepartment,jointlywiththefoodanddrugadministrationandthequalitysupervisiondepartmentatthesamelevel,shallformulateandadjusttheregionalfoodsafetyrisksurveillanceplanthattakesintoaccounttheregionalparticularities,filethesurveillanceplantotheNHFPCforrecordandexecutetheplan.
Article15Thetechnicalinstituteshallcarryoutthefoodsafetyrisksurveillanceworkpursuanttothesurveillanceplanandworkprogramtoguaranteetruthfulnessandaccuracyofthesurveillancedata;thesurveillancedataandanalysisresultsshallbereportedpursuanttothesurveillanceplanandtheworkprogram.
Foodsafetyrisksurveillanceofficialshaverighttoenterfarmsgrowing/breedingedibleagricultureproductsandfoodproduction/tradingfacilitiestocollectdataandsamples.Thecollectedsampleshallbepaidatmarketprice.
Article16Intheeventthatsurveillanceresultrevealspossiblefoodsafetyrisks,thecountyandabovelevelhealthadministrativedepartmentshallnotifytheinformationtothefoodanddrugadministration,thegovernmentofthesamelevel,andthehigherlevelhealthadministrativedepartment.Thefoodanddrugadministrationsha
