Article5Areaconfirmation&differencetreatment
Accordingtothevaluationmodewhichinterestedpartieschoosed,thisarticlestipulatestheareaconfirmation&differencetreatmentaccordingto[buildingarea][usablearea](hereinaftercalledareaforshort).
Thisarticledoesnotapplytotheinterestedpartieswhichchargetheapartmentbyset.
Thepropertyregistrationareawillbesubjecttothesurveyinganddrawingreportissuedbyqualifiedmappingunitdesignatedbyresidentialadministrationdept.
Foranydifferencesincontractedarea®istrationarea,theregistrationareawillbetakenasthestandard.
Aftertheapartmentistransferredtothebuyer,foranydifferencesincontractedarea®istrationarea,whichwasnotstipulatedinthecontract,bothpartieswillagreetomanageaccordingtothefollowingprinciple:
chargeasperactualarea,Returntheoverchargeanddemandpaymentoftheshortageontheprepaidcapital.
1.iftheabsolutevaluedifferenceiswithin3%(include3%),thechargewillbeaccordingtoactualamount.

Forthebuyerwhocanceltheorder,thesellermustreturnthemoneytobuyerwithin30daysafterbuyermaketheordercancelapplication,andpaytheinterestsratesaccordingto%.Thisarticleisnotapplicable.
Forthebuyerwhowillnotcanceltheorder,iftheregistrationareasiswithin3%(including3%)biggerthancontractedarea,theexceededamountshoudbesupplementedbythebuyer;forthecasewhichismorethan3%,theexceededamountshouldbebornbytheseller,thepropertyrightsbelongstothebuyer.Iftheregistrationareasissmallerthancontractedarea,thearearatioiswithin3%((including3%),theexceededamountmustbereturnedtothebuyer;theamountwhicharemorethan3%mustbedoubledandreturntothebuyer.Thisarticleisnotapplicable.
Areatoleranceratio=(registrationareas-contractedarea)/contractedareaX100%.Thisarticleisnotapplicable.
Thedifferencecausedbythedesignmodification,whichbothpartiesdoesnotterminatethecontract,buyerandsellershouldsigncomplementaryagreementofcontract.

Article7theBreachofcontractresponsibilityforoverduepayment
Ifthebuyercannoteffectthepaymentinthestipulatedtime,heorshewillbetreatedinthe2ndmode:
1)Iftheoverduedateiswithin__days,fromthe2ndduepaymentdatetotheactualpaymentdate,thebuyershouldpaytotheseller%defaultfineaccordingtotheoverduedate,thecontractwillcontinuetobeperformed.
2)Iftheoverduedateisexceeds__days,thebuyerhastherightstoterminatethecontract.Ifso,thebuyershouldpaytotheseller%defaultfineaccordingtotheoverduedate,thecontractwillcontinuetobeperformed,fromthe2ndduepaymentdatetotheactualpaymentdate,thebuyershouldpaytotheseller%(thisratiocannotlessthantheratesin1)defaultfineaccordingtotheoverduedate.
Theoverduepaymentinthisarticlereferstothebalancebetween6tharticleduepaymentandacutaleffectedpayment;forinstallmentpayment,itshouldbedecidedbythebalancebetweendueistallmentandactualpayment.

Article8handoverdeadline
Accordingtothestate’sandlocalgovernmentregulations,thesellershouldhandoverthecommercialresidentialbuilding,whichpossessthebelow1conditions,asstipulatedbythecontract,tothebuyerbeforeMAY,31,2011
1.thiscommercialresidentialbuildingisinspectedtobequalified.
2.thiscommercialresidentialbuildingiscomprehensivelyinspectedtobequalified.
3.thiscommercialresidentialbuildingisinstallmentinspectedtobequalified.
4.thiscommercialresidentialbuildingobtainedtheapprovaldocumentsofcommercialresidentialhandoverforusage.

Butincaseofthefollowingexceptionalreasons,exceptforbothpartiesagreetheterminationoralternationofcontract,thesellercanprolongthedeadlineasperactualfact.
1.encounteredwithmajeure,andsellerinformedthebuyerwithin30daysafterthemajeureoccurs;
2.thesellercausedtheprojectcannotbefinishedontimebecauseofnon-controllablereasons.
3.Ifthedelayisbecauseoftheabovecases,thisarticleisalsoapplicable.
Article9responsibilityofdelayinhandoverapartment
Exceptforthespecialcasesstipulatedinarticle8,ifthesellercannothandovertheapartmenttobuyerinthestipulatedscheduleinthiscontract,thebuyershouldbetreatedinthefollowing1st&2ndmode:
1.Accordingtotheoverduetime,thesellershouldbetreatedseparately(notbeaccumulated)
1)Foroverduedatelessthan90days,fromthe2nddayofdeadlinestipulatedinarticle8tothepaymentday,thebuyershouldpay_____%defaultfineofthealreadyeffectedpayment,thiscontractwillbeperformedcontinuously.
2)Foroverduedatemorethan90days,thebuyercanterminatethecontract.Inthiscase,thesellershouldreturnallthepaymentwithin30daysafterthedateoftermination,andpay__2___%defaultfineofthealreadyeffectedpayment.Ifthebuyerrequestcontinuouslyperformthecontract,thiscontractwillbeperformedcontinuously.fromthe2nddayofdeadlinestipulatedinarticle8tothepaymentday,thesellershouldpaythebuyer0.02%(thisratiocannotbelessthantheratesin1))ofthealreadyeffectedpayment
