Formorethantwodecades,U.S.courtshavebeenlimitingaffirmative-actionprogramsinuniversitiesandotherareas.Thelegalrationaleisthatracialpreferencesareunconstitutional,eventhoseintendedtocompensateforracismorintolerance.Formanycolleges,thismeansstudentscanbeadmittedonlyonmerit,notontheirraceorethnicity.IthasbeenadivisiveissueacrosstheU.S.,aseducatorsblametheprolongedreactiontoaffirmative-actionfordeclinesinminorityadmissions.Meanwhile,activistscontinuetobattleracepreferencesincourtsfromMichigantoNorthCarolina.
Now,chiefexecutivesofabouttwodozencompanieshavedecidedtoplungeheadfirstintothispoliticallyunsettleddebate.They,togetherwith36universitiesand7nonprofitableorganizations,formedaforumthatsetforthanactionplanessentiallydesignedtohelpcollegescircumventcourt-imposedrestrictionsonaffirmativeaction.TheCEOs’motive:
