I(ActsadoptedundertheECTreaty/EuratomTreatywhosepublicationisobligatory)REGULATIONSCOMMISSIONREGULATION(EC)No692/2008of18July2008implementingandamendingRegulation(EC)No715/2007oftheEuropeanParliamentandoftheCouncilontype-approvalofmotorvehicleswithrespecttoemissionsfromlightpassengerandcommercialvehicles(Euro5andEuro6)andonaccesstovehiclerepairandmaintenanceinformation(TextwithEEArelevance)THECOMMISSIONOFTHEEUROPEANCOMMUNITIES,HavingregardtotheTreatyestablishingtheEuropeanCommu-nity,andinparticularArticle95thereof,HavingregardtoRegulation(EC)No715/2007oftheEuropeanParliamentandoftheCouncilof20June2007ontype-approvalofmotorvehicleswithrespecttoemissionsfromlightpassengerandcommercialvehicles(Euro5andEuro6)andonaccesstovehiclerepairandmaintenanceinformation
(1),andinparticularArticles4(4),5(3)and8thereofWhereas:
(1)Regulation(EC)No715/2007isoneoftheseparateregu-latoryactsunderthetype-approvalprocedurelaiddownbyCouncilDirective70/156/EECof6February1970ontheapproximationofthelawsoftheMemberStatesrelat-ingtothetype-approvalofmotorvehiclesandtheirtrailers

(2)Regulation(EC)No715/2007requiresnewlight-dutyvehiclestocomplywithnewemissionlimitsandmakesadditionalrequirementsonaccesstoinformation.Thetechnicalrequirementstakeeffectintwostages,Euro5startingfrom1September2009andEuro6from1Sep-tember2014.ThespecifictechnicalprovisionsnecessarytoimplementthatRegulationshouldbeadopted.There-fore,thepresentRegulationaimsatsettingtherequire-mentsnecessaryforthetype-approvalofEuro5and6specificationvehicles.(3)Article5ofRegulation(EC)No715/2007providesforspecifictechnicalrequirementsrelatingtothecontrolofemissionsfromvehiclestobesetinitsimplementingleg-islation.Therefore,itisappropriatetoadoptsuchrequirements.(4)FollowingtheadoptionofthemainrequirementsfortypeapprovalinRegulation(EC)No715/2007,itisnecessarytoestablishadministrativeprovisionsforECtype-approvaloflightdutyvehicles.Theseadministrativerequirementsincludeprovisionsforconformityofproductionandin-serviceconformitytoensurecontinuedgoodperfor-manceofproductionvehicles.(5)InaccordancewithArticle11ofRegulation(EC)No715/2007,itisnecessarytoestablishrequirementsfortypeapprovalofreplacementpollutioncontroldevicessoastoensurethattheyfunctioncorrectly.(6)InaccordancewithArticles6and7ofRegulation(EC)No715/2007,itisalsonecessarytoestablishrequirementstoensurethatvehicleonboarddiagnostic(OBD)andvehiclerepairandmaintenanceinformationisreadilyaccessible,soastoensurethatindependentoperatorshaveaccesstosuchinformation.(7)InaccordancewithRegulation(EC)No715/2007,themeasuresprovidedforinthisRegulationregardingaccesstovehiclerepairandmaintenanceinformation,informa-tionfordiagnostictoolsandthecompatibilityofreplace-mentpartswithvehicleOBDsystems,shouldnotberestrictedtoemissions-relatedcomponentsandsystemsbutcoverallaspectsofavehiclesubjecttotype-approvalwithinthescopeofthisRegulation.

(1).(10)AForumshouldbeestablishedtoexamineanyconcernsraisedregardingtheimplementationofsection2.2ofAnnexXIV,concerningaccessinformationrelatingtovehiclesecurityfeatures.TheinformationexchangeintheForumshouldhelptoreducetheriskofmisuseofvehiclesecurityinformation.Duetothesensitivityofthesubjectmatteritmightbenecessarytokeepdiscussionsandfind-ingsoftheForumconfidential.HASADOPTEDTHISREGULATION:
Article1SubjectmatterThisRegulationlaysdownmeasuresfortheimplementationofArticles4,5and8ofRegulation(EC)No715/2007.Article2DefinitionsForthepurposesofthisRegulation,thefollowingdefinitionsshallapply:
1.vehicletypewithregardtoemissionsandvehiclerepairandmaintenanceinformationmeansagroupofvehicleswhichdonotdifferinthefollowingrespects:
(a)theequivalentinertiadeterminedinrelationtotheref-erencemassasprovidedforinparagraph5.1ofAnnex4ofUN/ECERegulation83
(2);(b)theengineandvehiclecharacteristicsassetoutinAppendix3ofAnnexI;2.ECtype-approvalofavehiclewithregardtoemissionsandvehiclerepairandmaintenanceinformationmeansanECtype-approvalofavehiclewithregardtoitstailpipeemis-sions,crankcaseemissions,evaporativeemissions,fuelcon-sumptionandaccesstovehicleOBDandvehiclerepairandmaintenanceinformation;3.gaseouspollutantsmeanstheexhaustgasemissionsofcar-bonmonoxide,oxidesofnitrogen,expressedinnitrogendioxide(NO2)equivalent,andhydrocarbonswiththefollow-ingratio:
(a)C1H1,89O0,016forpetrol(E5);(b)C1H1,86O0,005fordiesel(B5);(c)C1H2,525forliquefiedpetroleumgas(LPG);(d)CH4fornaturalgas(NG)andbiomethane;(e)C1H2,74O0,385forethanol(E85);4.startingaidmeansglowplugs,modificationstotheinjectiontimingandotherdeviceswhichassisttheenginetostartwithoutenrichmentoftheair/fuelmixtureoftheengine;5.enginecapacitymeanseitherofthefollowing:
(a)forreciprocatingpistonengines,thenominalenginesweptvolume;(b)forrotarypiston(Wankel)engines,doublethenominalenginesweptvolume;6.periodicallyregeneratingsystemmeanscatalyticconverters,particulatefiltersorotherpollutioncontroldevicesthatrequireaperiodicalregenerationprocessinlessthan4000kmofnormalvehicleoperation7.originalreplacementpollutioncontroldevicemeansapol-lutioncontroldeviceoranassemblyofpollutioncontroldeviceswhosetypesareindicatedinAppendix4toAnnexItothisRegulationbutareofferedonthemarketasseparatetechnicalunitsbytheholderofthevehicletype-approval;8.typeofpollutioncontroldevicemeanscatalyticconvertersandparticulatefilterswhichdonotdifferinanyofthefol-lowingessentialaspects:
(a)numberofsubstrates,structureandmaterial;(b)typeofactivityofeachsubstrate;(c)volume,ratiooffrontalareaandsubstratelength;(d)catalystmaterialcontent;(e)catalystmaterialratio;(f)celldensity;(g)dimensionsandshape;(h)thermalprotection;9.monofuelvehiclemeansavehiclethatisdesignedtorunprimarilyononetypeoffuel;

(a)aconsumablefuel;(b)battery,capacitor,flywheel/generatororotherelectricalenergy/powerstoragedevice;17.properlymaintainedandusedmeans,forthepurposeofatestvehicle,thatsuchavehiclesatisfiesthecriteriaforaccep-tanceofaselectedvehiclelaiddowninsection2ofAppen-dix1toAnnexII;18.emissioncontrolsystemmeans,inthecontextoftheOBDsystem,theelectronicenginemanagementcontrollerandanyemission-relatedcomponentintheexhaustorevaporativesystemwhichsuppliesaninputtoorreceivesanoutputfromthiscontroller;19.malfunctionindicator(MI)meansavisibleoraudibleindi-catorthatclearlyinformsthedriverofthevehicleintheeventofamalfunctionofanyemission-relatedcomponentconnectedtotheOBDsystem,oroftheOBDsystemitself;20.malfunctionmeansthefailureofanemission-relatedcom-ponentorsystemthatwouldresultinemissionsexceedingthelimitsinsection3.3.2ofAnnexXIoriftheOBDsystemisunabletofulfilthebasicmonitoringrequirementssetoutinAnnexXI;21.secondaryairmeanstheairintroducedintotheexhaustsys-tembymeansofapumporaspiratorvalveorothermeansthatisintendedtoaidintheoxidationofHCandCOcon-tainedintheexhaustgasstream;22.drivingcycle,inrespectofvehicleOBDsystems,consistsofenginestart-up,drivingmodewhereamalfunctionwouldbedetectedifpresent,andengineshut-off;23.accesstoinformationmeanstheavailabilityofallvehicleOBDandvehiclerepairandmaintenanceinformation,requiredfortheinspection,diagnosis,servicingorrepairofthevehicle.24.deficiencymeans,inthecontextoftheOBDsystem,thatuptotwoseparatecomponentsorsystemswhichare
