【摘要】在建筑工程项目管理中,合同的管理是保证管理规范性,维护多方共同利益,化解工程矛盾的重要保障。
加强建筑工程项目的合同管理,有助于整个建筑工程管理的规范性,从而保证工程进度,提高工程质量。
本文将结合多年建筑工程管理经验,对建筑工程合同管理的重要意义做出分析,并提出我国建筑工程合同管理中存在的问题,针对问题提出加强建筑工程项目合同管理的一些方案和措施。

一.前言
在建筑工程行业中,工程项目的合同是为了保证工程项目的施工目标,承包方和发包方都相互明确自己的权责关系,并在协商的基础上签订,具有法律效力的协议。
工程施工合同对承包方开始实施工程建设,发包方要通过各种途径来支付工程的造价款项,共同来控制整个工程的质量,保持工程合理的进度,控制整个工程的造价,保证整个工程活动建设高效优质进行的法律文件,对整个工程的建造有着十分重要的作用。
合同管理是否严格,管理是否规范科学,不仅仅会影响到整个工程的质量和进度,更对整个工程的造价产生深远的影响,直接关系到整个工程相关企业的竞争力和生存力。
因此,做好工程的合同管理,是企业生存发展,控制工程造价的重要举措。

中文摘要
随着建筑市场的飞速发展,建设开发过程中操作不规范的问题不断暴露,一些违法现象时有发生,建筑工程承包合同纠纷案件呈逐年递增态势。
为与时、公正审理建设工程施工合同纠纷案件,依法保护当事人的合法权益,规范建筑市场秩序,促进建筑业健康发展,因而加强建筑合同纠纷管理十分必要,合同纠纷管理显现出巨大的意义。
本文对建筑工程合同纠纷的概念、特点、原因进行浅析,对合同纠纷的解决进行探讨,同时提出减少工程合同纠纷对策的建议。

Abstract
Withtherapiddevelopmentoftheconstructionmarket,theoperationofnon-standardproblemsintheconstructionofthedevelopmentprocesshaveexposed,someillegalphenomenaoccur,constructioncontractdisputecaseincreaseseveryyear.Forthetimely,fairtrialofcasesofdisputesoverconstructioncontracts,protectingthelegitimaterightsandinterestsaccordingtolaw,standardizetheorderoftheconstructionmarket,promotethehealthydevelopmentoftheconstructionindustry,andstrengthentheconstructioncontractmanagementisnecessary,thecontractdisputemanagementshowedgreatsignificance.Inthispaper,thecontentofconstructionprojectcontractdisputescharacteristics,causeanalysis,toresolvecontractdisputeswerediscussed,andputforwardcountermeasurestoreduceprojectcontractdisputes.

1绪论
论文研究的背景
改革开放以来,我国的建筑业获得了长足的发展,这与建筑法律制度的完整是密不可分的,到目前为止,我国已经形成了以《建筑法》、《招标投标法》、《合同法》为三大支柱,以《建筑工程质量管理条例》、《建筑工程勘查设计管理条例》、《建设项目环境保护管理条例》与地方性法规、部门规章规范性文件为辅的建筑法律体系的基本框架。
但是由于建设工程施工过程本身错综复杂,涉与法律适用的新情况和新问题层出不穷,承、发包双方在出现合同争议后有时还会遇到无法可依的尴尬局面。
各地法院因司法理念和对法律精神的理解差异与建筑行业专业性较强,在审判实践中司法标准不统一的现象也时有出现。
合同管理是否严格,管理是否规范科学,不仅仅会影响到整个工程的质量和进度,更对整个工程的造价产生深远的影响,直接关系到整个工程相关企业的竞争力和生存力。

第二章为建设工程合同的基本理论,主要从建设工程合同纠纷的概念、特点以与工程合同纠纷产生的原因展开讨论,对建设工程合同有了进一步的认识。
第三章是阐述了建筑工程企业在合同管理上存在的问题。
第四章主要针对工程合同纠纷产生的原因以与建筑工程企业存在的问题提出的减少工程合同纠纷的对策。

摘要
建设工程施工合同为建设工程合同之一,由于建设工程具有投资大、建设工期长、技术复杂,影响国计民生等特点,国家在不同法律部门、不同层面立法对施工合同的主体、订立以与履行等进行严格的监管。
实践中,由于工程建设市场的迅猛发展和不规范竞争,超资质承揽工程,违法分包、转包,带资、垫资施工,串通投标等违法违规行为屡屡发生,影响施工合同的效力和建设市场的健康发展。
其根源既有市场自身的原因,也与相关法律制度不完善有关。
建设工程合同谈判、确定合同当事人双方的权利和义务以与签订合同一系列过程中,除了要求谈判人员具备必备的相关专业知识以与法律知识外,还需要一定的谈判技巧,从而取得谈判的成功,完成合同的签订,为后续建设工作提供良好的必要条件。
在建设工程合同中,受国家政策以与建设工程周期长等因素的影响,不可避免的会发生一些争议和纠纷。
这些争议和纠纷作为双方矛盾的集中体现,要对其进行妥善的解决,一方面应当在合同中对纠纷的争议解决方法做出预见性的规定,另一方面双方要本着互谅互让、公平合理、诚实信用的原则积极地进行磋商,达成共识。
