A.Thisagreementisanemploymentcontractwithfixed-termfromto,includingaprobationfromthedateof**tothedateof**B.Thisagreementisanemploymentcontractwithuncertaintermfromthedateof**tothedateof**,includingaprobationfromthedateof**tothedateof**C.Completed**jobtaskisthedurationofthelaborcontractfromthedateof**tothedateof**Article2DescriptionofWorkandWorkSite1.PartyB’sWorkSiteisBeijing2.AccordingtoPartyA'srequirements,PartyBshallengageinworkastheManagerafternegotiation.PartyAmaychangethePartyB’spositionaccordingtolaworafternegotiatingwithPartyB,inaccordancewiththeworkneedsandassessmentresultsofPartyB’sperformance,followingtheprincipleofreasonablegoodfaith.
3.PartyAshallarrangePartyB’sworkandrequirementswhichshallcomplywiththelaborstandardsofnationallawsandregulationsandtherulesandregulationsformulatedbyPartyA.PartyBshallperformitslaborobligationsinaccordancewiththeworkcontentsandrequirementsarrangedbyPartyAandcompletetheprescribedworkontimeathigherlevel.Article3WorkingHoursandHolidays1.PartyAandPartyBagreetoimplementthearticleA(chooseA,BorC):
A.PartyBistoworkunderthefull-timestandardworkingtimesystem:
PartyAmayrequirePartyBtoworkfornomorethan8hourseverydayandfornomorethan40hourseveryweek.Inaddition,PartyAshallguaranteethatPartyBshallhaveatleastonedayoffeachweek.B.ImplementationofacomprehensivecalculationofworkinghoursinaccordancewiththemattersandcontentsapprovedbytheLaborandSocialSecurityBureauoftheSuzhouIndustrialParkC.ApprovedbytheLaborandSocialSecurityBureauofSuzhouIndustrialPark,thesystemofirregularworkisimplemented,andPartyBwillarrangeworkinghours,restandvacationaccordingtotheneedsoftheworktoensurethecompletionofworktasks.2.PartyAshallstrictlyabidebythestatutoryworkinghoursandensurePartyB'srestandphysicalandmentalhealth.Ifnecessaryforwork,PartyAmay,onthebasisofnegotiationwithlaborunionandPartyB,extendartyB'sworkinghoursfornomorethanonehoureverydaygenerally;whereitisnecessarytoextenworkinghoursunderspecialcircumstances,suchextensionofworkinghoursmaynotexceedthreehourseverydayonthepremiseofbeingnoharmfultoPartyB’shealth,andnomorethanatotalof36hourseverymonth.3.PartyAshallprovidePartyBwithstatutoryholiday,annualleave,marriageleave,bereavementleave,maternityleave,andnursingleave,etc.inaccordancewithrelevantregulations.Thespecificmeasuresshallbedecidedbytherelevantregulationsofthestateorthroughconsultationbetweenthetwoparties.Article4LaborProtection,WorkingConditionsandPreventionagainstOccupationalHazard1.PartyAshallperformtheobligationoftruthfullycommunicatingtoPartyB,ifthepositionsthatmaycauseoccupationalhazards,andPartyAshallconductlaborsafetyandhygieneeducation,preventaccidentsandreduceoccupationalhazards2.PartyAshallprovidePartyBwithlaborsafetyandhygieneconditionsandnecessaryarticlesinconformitywiththerelevantlawsandregulations.IfPartyBisengagedintheworkofoccupationalhazards,PartyAshouldkeepregularhealthchecksforPartyBandarrangePartyBtohaveoccupationalhealthexaminationbeforeleaving.3.PartyBmuststrictlyabidebysafetyoperatingrulesduringthelaborprocess.ThePartyBshallhavetherighttorefusetocarryoutanyinstructionsagainstrulesandregulationsorcompelPartyBtoworkatriskbymanagementpersonnel.4.PartyAshallprovideprotectiontoPartyBinaccordancewiththeState'sspecialprotectionregulationsforfemaleemployeesandunderageworkers.
Article5RemunerationPartyAshallpayPartyB’swagesatleastonceamonthincurrency.PartyBshallworknormallyduringthelegalworkinghoursandthewagesofPartyBpaidbyPartyA,mustnotbelowerthanthelocallowestwage.1.PartyAshallpaythewageonthe15dayeverymonth.Wagesarepaidintheformof(∆cash∆commissionedbythebank)Duringtheprobationperiod,PartyB'ssalaryisRMBmonthly.2.ThesalarystandardofPartyBshallbedeterminedbythefollowing(B)method.(chooseA,B,CorD):
APartyBshallimplementamonthlysalarysystem,whichispermonth,andthespecificmeasuresareimplementedinaccordancewithrelevantregulationsformulatedbyPartyAaccordingtolaw.BPartyBshallimplementawagedistributionmethodcombiningbasicsalaryandperformance-relatedpay.PartyB’sbasicsalaryis----yuanpermonthaftertax(Themonthlyprepaidsalaryfortheannualsalarysystemis**yuan);TheperformancepayevaluationmethodshallbeimplementedinaccordancewiththerelevantregulationsformulatedbyPartyAaccordingtolaw.CPartyBshallimplementthepiece-ratewagesystem,andthelaborquotamanagementshallbeexecutedinaccordancewithrelevantregulationsformulatedbyPartyAaccordingtolawandthequotaisyuan.DPartyBshallimplementotherformsofwagedistribution:
PartyAshallreasonablyincreasethesalaryofPartyB,basedontheeconomicgrowthofthe3.unit,thesalaryguidancepriceissuedbytheSuzhouIndustrialPark,theaveragewageleveloftheemployeesintheregionandtheindustry,etc.,andthroughthecollectiveconsultationonsalaryandtherevisionofthelaborremunerationrulesandregulations.IfPartyAarrangesPartyBtoextendworkinghoursorworkovertimeonrestdaysand4.statutoryholidays,PartyAshallarrangePartyBtomakeupfortheholidaysorpaycorrespondingovertimepayaccordingtolaw.ThesalaryofPartyB'sovertimeworkshallbecalculatedbasedonthe(∆Salaryisyuan5.∆Collectivecontractorrulesandregulations)agreedbybothpartiesthroughnegotiation.PartyBshallenjoysalaryduringpaidvacation.6.Article6SocialInsuranceandWelfare1.Bothpartiesshallparticipateinthepark'sprovidentfundinaccordancewiththelaw,andthepartthatshouldbepaidbyPartyBaccordingtolawshallbewithheldbyPartyAfromPartyB’ssalary.2.PartyAshallpaytheparkfundforPartyBaccordingtothe**planprovidentfundsystem.3.IfPartyBhasanaccidentatwork,PartyAshallberesponsiblefortimelytreatment,orprovidepossibleassistance,andsubmitanapplicationforlaborinjurycertificationtothelaborandsocialsecuritydepartmentwithinaspecifiedtimesoastoperformlaborcapacityappraisalforPartyBinaccordancewiththelaw,andfulfilthenecessaryobligationstoenjoymedicaltreatmentforwork-relatedinjuries.4.IfPartyBissufferingfromillnessorisbeinginjuredirrelevanttohisjob,PartyAshall
providemedicaltreatmentperiodandmedicaltreatmentaccordingtonationalandlocalregulations,reimbursemedicalexpensesaccordingtomedicalinsuranceandrelatedregulations,andpaysickleaveorsicknessrelieffeesduringprescribedmedicalperiod.Article7TheAlteration,DissolutionandTerminationoftheContract1.IntheeventthateitherpartyrequeststoaltertheContractitshallnotifytheotherpartyinwriting;IfPartyAchangesitsname,legalrepresentative,principalresponsiblepersonorinvestor,theperformanceofthiscontractthereofshallnotbeaffected.IntheeventofthemergerordivisionofPartyA,thecontractshallcontinuetobevalidandcontinuetobeperformedbytheentitythathasinheritedtherightsandobligationsofPartyA.2.Dissolutioni.ThetwopartiesheretomaydissolutethisContractbyreachingmutualconsent.IfPartyAproposestorescindthecontract,itshallpayeconomiccompensationasrequired.ii.PartyAmayterminatethiscontractunderanyofthefollowingcircumstances:
a.Duringtheprobationperiod,PartyBisprovedtobeunqualifiedforemployment;b.PartyBseverelyviolatesPartyA'sregulations;c.WhenPartyBisseriouslymalfeasantandengagesinmalpracticeforselfishends,andthePartyAsuffersgreatdamagesbecauseofthePartyB'stheabovedeeds;d.PartyBhasestablishedlaborrelationswithotheremployersatthesametime,whichhasseriousimpactonthecompletionofPartyA’sworktasksororrefusetomakecorrectionsafterbeingsubmittedbyPartyA;e.PartyBforcesthePartyAtoconcludeoraltertheemploymentcontractagainsttheemployer'struewillbymeansofdeception,coercionortakingadvantageoftheemployer'sdifficulties;f.PartyBwasinvestigatedforcriminalresponsibilityaccordingtolaw;g.Evenaftertheregulatedrecoveryperiodduetoillnessornon-work-relatedinjury,PartyBcannotcontinueworkinhisoriginalpositionnorinotherpositionsarrangedbyPartyA;h.PartyBisnotcompetentforhisorherworkandstillcannotbecompetentforworkafterbei
