Preamble
Members,
Desiringtoreducedistortionsandimpedimentstointernationaltrade,andtakingintoaccounttheneedtopromoteeffectiveandadequateprotectionofintellectualpropertyrights,andtoensurethatmeasuresandprocedurestoenforceintellectualpropertyrightsdonotthemselvesbecomebarrierstolegitimatetrade;
Recognizing,tothisend,theneedfornewrulesanddisciplinesconcerning:
(a)theapplicabilityofthebasicprinciplesofGATT1994andofrelevantinternationalintellectualpropertyagreementsorconventions;
(b)theprovisionofadequatestandardsandprinciplesconcerningtheavailability,scopeanduseoftrade-relatedintellectualpropertyrights;
(c)theprovisionofeffectiveandappropriatemeansfortheenforcementoftrade-relatedintellectualpropertyrights,takingintoaccountdifferencesinnationallegalsystems;(d)theprovisionofeffectiveandexpeditiousproceduresforthemultilateralpreventionandsettlementofdisputesbetweengovernments;and
(e)transitionalarrangementsaimingatthefullestparticipationintheresultsofthenegotiations;
Recognizingtheneedforamultilateralframeworkofprinciples,rulesanddisciplinesdealingwithinternationaltradeincounterfeitgoods;
Recognizingthatintellectualpropertyrightsareprivaterights;
Recognizingtheunderlyingpublicpolicyobjectivesofnationalsystemsfortheprotectionofintellectualproperty,includingdevelopmentalandtechnologicalobjectives;
Recognizingalsothespecialneedsoftheleast-developedcountryMembersinrespectofmaximumflexibilityinthedomesticimplementationoflawsandregulationsinordertoenablethemtocreateasoundandviabletechnologicalbase;
DesiringtoestablishamutuallysupportiverelationshipbetweentheWTOandtheWorldIntellectualPropertyOrganization(referredtointhisAgreementas“WIPO”)aswellasotherrelevantinternationalorganizations;
Hereby agreeasfollows:
PartIGeneralProvisionsandBasicPrinciples
Article1NatureandScopeofObligations
1.MembersshallgiveeffecttotheprovisionsofthisAgreement.Membersmay,butshallnotbeobligedto,implementintheirlawmoreextensiveprotectionthanisrequiredbythisAgreement,providedthatsuchprotectiondoesnotcontravenetheprovisionsofthisAgreement.MembersshallbefreetodeterminetheappropriatemethodofimplementingtheprovisionsofthisAgreementwithintheirownlegalsystemandpractice.
2.ForthepurposesofthisAgreement,theterm“intellectualproperty”referstoallcategoriesofintellectualpropertythatarethesubjectofSections1through7ofPartII.
3.MembersshallaccordthetreatmentprovidedforinthisAgreementtothenationalsofotherMembers.1
(1)Inrespectoftherelevantintellectualpropertyright,thenationalsofotherMembersshallbeunderstoodasthosenaturalorlegalpersonsthatwouldmeetthecriteriaforeligibilityforprotectionprovidedforintheParisConvention(1967),theBerneConvention(1971),theRomeConventionandtheTreatyonIntellectualPropertyinRespectofIntegratedCircuits,wereallMembersoftheWTOmembersofthoseconventions. 2
(2)AnyMemberavailingitselfofthepossibilitiesprovidedinparagraph 3ofArticle5orparagraph 2ofArticle 6oftheRomeConventionshallmakeanotificationasforeseeninthoseprovisionstotheCouncilforTrade-RelatedAspectsofIntellectualPropertyRights(the“CouncilforTRIPS”).
Article2IntellectualPropertyConventions
1.InrespectofParts II,IIIandIVofthisAgreement,MembersshallcomplywithArticles 1through12,andArticle19,oftheParisConvention(1967).
2.NothinginParts ItoIVofthisAgreementshallderogatefromexistingobligationsthat
MembersmayhavetoeachotherundertheParisConvention,theBerneConvention,the
RomeConventionandtheTreatyonIntellectualPropertyinRespectofIntegratedCircuits.
Article3NationalTreatment
1.EachMembershallaccordtothenationalsofotherMemberstreatmentnolessfavorablethanthatitaccordstoitsownnationalswithregardtotheprotection3 ofintellectualproperty,subjecttotheexceptionsalreadyprovidedin,respectively,theParisConvention(1967),theBerneConvention (1971),theRomeConventionortheTreatyonIntellectualPropertyinRespectofIntegratedCircuits.Inrespectofperformers,producersofphonogramsandbroadcastingorganizations,thisobligationonlyappliesinrespectoftherightsprovidedunderthisAgreement.AnyMemberavailingitselfofthepossibilitiesprovidedinArticle 6oftheBerneConvention(1971)orparagraph1(b)ofArticle 16oftheRomeConventionshallmakeanotificationasforeseeninthoseprovisionstotheCouncilforTRIPS.
2.Membersmayavailthemselvesoftheexceptionspermittedunderparagraph 1inrelationtojudicialandadministrativeprocedures,includingthedesignationofanaddressforserviceortheappointmentofanagentwithinthejurisdictionofaMember,onlywheresuchexceptionsarenecessarytosecurecompliancewithlawsandregulationswhicharenotinconsistentwiththeprovisionsofthisAgreementandwheresuchpracticesarenotappliedinamannerwhichwouldconstituteadisguisedrestrictionontrade.
Article4Most-Favored-NationTreatment
Withregardtotheprotectionofintellectualproperty,anyadvantage,favor,privilegeorimmunitygrantedbyaMembertothenationalsofanyothercountryshallbeaccordedimmediatelyandunconditionallytothenationalsofallotherMembers.Exemptedfromthisobligationareanyadvantage,favor,privilegeorimmunityaccordedbyaMember:
(a)derivingfrominternationalagreementsonjudicialassistanceorlawenforcementofageneralnatureandnotparticularlyconfinedtotheprotectionofintellectualproperty;
(b) grantedinaccordancewiththeprovisionsoftheBerneConvention(1971)ortheRomeConventionauthorizingthatthetreatmentaccordedbeafunctionnotofnationaltreatmentbutofthetreatmentaccordedinanothercountry;
(c) inrespectoftherightsofperformers,producersofphonogramsandbroadcastingorganizationsnotprovidedunderthisAgreement;
(d) derivingfrominternationalagreementsrelatedtotheprotectionofintellectualproperty
whichenteredintoforcepriortotheentryintoforceoftheWTOAgreement,providedthatsuchagreementsarenotifiedtotheCouncilforTRIPSanddonotconstituteanarbitraryorunjustifiablediscriminationagainstnationalsofotherMembers.
Article5MultilateralAgreementsonAcquisitionorMaintenanceofProtection
TheobligationsunderArticles 3and4donotapplytoproceduresprovidedinmultilateralagreementsconcludedundertheauspicesofWIPOrelatingtotheacquisitionor
maintenanceofintellectualpropertyrights.
Article6Exhaustion
ForthepurposesofdisputesettlementunderthisAgreement,subjecttotheprovisionsofArticles 3and4nothinginthisAgreementshallbeusedtoaddresstheissueofthe
exhaustionofintellectualpropertyrights.
Article7Objectives
Theprotectionandenforcementofintellectualpropertyrightsshouldcontributetothepromotionoftechnologicalinnovationandtothetransferanddisseminationoftechnology,tothemutualadvantageofproducersandusersoftechnologicalknowledgeandinamannerconducivetosocialandeconomicwelfare,andtoabalanceofrightsandobligations.
Article8Principles
1.Membersmay,informulatingoramendingtheirlawsandregulations,adoptmeasuresnecessarytoprotectpublichealthandnutrition,andtopromotethepublicinterestinsectorsofvitalimportancetotheirsocio-economicandtechnologicaldevelopment,providedthatsuchmeasuresareconsistentwiththeprovisionsofthisAgreement.
2.Appropriatemeasures,providedthattheyareconsistentwiththeprovisionsofthisAgreement,maybeneededtopreventtheabuseofintellectualpropertyrightsbyrightholdersortheresorttopracticeswhichunreasonablyrestraintradeoradverselyaffecttheinternationaltransferoftechnology.
PARTIIStandardsconcerningtheavailability,scopeanduseofIntellectualPropertyRights
SECTION1:
COPYRIGHTANDRELATEDRIGHTS
Article9RelationtotheBerneConvention
1.MembersshallcomplywithArticles1through21oftheBerneConvention(1971)andtheAppendixthereto.However,MembersshallnothaverightsorobligationsunderthisAgreementinrespectoftherightsconferredunderArticle6bisofthatConventionoroftherightsderivedtherefrom.
2.Copyrightprotectionshallextendtoexpressionsandnottoideas,procedures,methodsofoperationormathematicalconceptsassuch.
Article10ComputerProgramsandCompilationsofData
1.Computerprograms,whetherinsourceorobjectcode,shallbeprotectedasliteraryworksundertheBerneConvention(1971).
