TheComplainantisacorporationdulyincorporatedunderthelawsoftheBritishVirginIslands,havingitsprincipalplaceofbusinessatTheLakeBuilding,1st Floor,Wickhams Cay 1,PO Box 3152,Road Town,Tortola,British VirginIslands.TheComplainant’sauthorizedrepresentativeisNathaly J VermetteofGreenspoon Perreault,GP,Montreal,Canada.

TheFirstRespondent,EPSX-10032,wastheregistrantofthefirstdisputeddomainnameatthetimetheComplaintwasfiled.Theadministrative,technicalandbillingcontactwasgivenasCarlos Lamarche,770 Claughton Island Dr.Apt 505,Miami,Fl 33131,UnitedStatesofAmerica.However,initsSecondAmendedComplaint,theComplainantadvisedthattheRegistrantforthefirstdisputeddomainnamehaschangedtoNA（DULXGKBCUD）,theThirdRespondent.Theadministrative,technicalandbillingcontactforthefirstdisputeddomainnamealsochangedfromCarlos LamarchetoCarol Natel.Thee-mailaddressfortheadministrative,technicalandbillingcontactisgivenas.ThesechangeswereeffectedafternoticetotheRespondentsoftheComplaint.

TheWhoisreportannexedtotheoriginalComplaintshowedthattheRegistrantoftheseconddisputeddomainnamewasCarolNatel,whowasalsonamedastheadministrative,technicalandbillingcontact.InitsFirstAmendedComplaint,theComplainantadvisedthatonFebruary 5, 2002,theRegistrantwaschangedtoCarlosLamarche.ThischangewaseffectedoneweekafteracopyoftheComplaintwassenttotheRespondentsbytheComplainant.

TheRegistrantfortheseconddisputeddomainnameconfirmedthattheRegistrantofthatdomainnameisnowCarlosLamarche.

3.ProceduralHistory

OnJanuary24,2002,aComplaintwasreceivedbytheWIPOArbitrationandMediationCenter（“WIPOCenter”）fordecisioninaccordancewiththeUniformDomainNameDisputeResolutionPolicy（“thePolicy”）,adoptedbytheInternetCorporationforAssignedNamesandNumbers（“ICANN”）onAugust 26, 1999.

OnFebruary6,2002theRegistrarrespondedtoarequestforverificationofthefirstdisputeddomainname,confirmingdetailsoftheRespondent,thatthePolicyappliedtothedomainnameandthatthecurrentstatusofthedomainnameis“active”.

OnFebruary6,2002theWIPOCenterreceivedanAmendmenttoComplaint,reflectingthemodificationstotheregistrantinrespectoftheseconddisputeddomainnameandthemodificationstothecontactdetailsinrespectofboththedisputeddomainnames.

OnFebruary9,2002theRegistrarrespondedtoarequestforverificationoftheseconddisputeddomainnameconfirmingdetailsoftheRespondent,thatthePolicyappliedtothedomainnameandthatthecurrentstatusofthedomainnameis“active”.

OnFebruary11,2002,theWIPOCentertransmittedaNotificationofComplaintandCommencementofAdministrativeProceedingtotheRespondents.TheRespondentswereadvisedthataresponsetotheComplaintwasrequiredbyMarch 3, 2002.

NoresponsewasreceivedonbehalfoftheRespondentsandonMarch 5, 2002,aNotificationofRespondentDefaultwassenttotheRespondents.

OnMarch11,2002,thePanelwasappointed.ThePanelistfindsthattheAdministrativePanelwasproperlyconstitutedinaccordancewiththeRulesandSupplementalRules.

OnMarch26,2002theWIPOCentersenttothepartiesaProceduralOrderForAdditionalSubmissiononbehalfofthePanel.

OnApril22,2002,theWIPOCenterforwardedaSecondAmendedComplainttothePanel.TheSecondAmendedComplaintprovidedfurtherevidenceinsupportoftheComplaint.ItalsoupdatedtheRegistrantandcontactinformationforthefirstdisputeddomainname.

AccordingtotheSecondAmendedComplaint,theRegistrantforthefirstdisputeddomainnamechangedonFebruary 17, 2002–11daysaftertheComplainantfileditsFirstAmendedComplaint.Asindicatedpreviously,theRegistrantforthedomainnameisnowNA（DULXGKBCUD）,withtheaddressEPSX-10032,7801NW37thStreet,Miami,Florida33166,UnitedStatesofAmerica.Theadministrative,technicalandbillingcontactisnowCarol Natel,770ClaughtonIslandDrive,Apt505,Miami,Florida33131,UnitedStatesofAmerica.

TheComplainantstatesthatMs.Natel’semail（

webmaster@>）ishostedatthedomainname<>.Thedomainname<>,isregisteredtoMarcosDuran.AccordingtotheWhoIsdatabasesearchconductedinrespectofthedomainname<>,MarcosDuran’sdetailsaregivenasMarcos Duran,EPSX-10032,7801NW37thStreet,Miami,Florida33166,UnitedStatesofAmerica.

AccordingtotheComplainant,Mr.DuranisaformeremployeeoftheComplainant.HewasemployedasawebsitedesignerfortheComplainant’swebsite<>.

ThePanelhasindependentlydeterminedandagreeswiththeassessmentoftheWIPO CenterthattheComplaintmeetstheformalrequirementsoftheRulesforUniformDomainNameDisputeResolutionPolicyasapprovedbyICANNonOctober 24, 1999,（“theRules”）andtheSupplementalRules.

4.FactualBackground

TheComplainanthasassertedandprovidedevidenceinsupportofthefollowingfacts.Unlessstatedotherwise,thePanelfindsthesefactsestablished.

TheComplainantstatesthatitregistereditsowndomainname<>onNovember 30, 1999,andhasbeenusingthedomainnameandthemarkTRUSTEDCASINOScontinuouslysincethentopromotethefollowingservices:

providinganinteractivecomputerdatabaseinthefieldofcomputerizedon-linegamingandcasinos;

publicationofinformation,ratingsandopinionsconcerningon-linecasinosandgamingsites;

publishingratingsandopinionsoftheanalysis,consensusandopinionsontheinternetgamingandcasinositesvialocal,regionalandglobalcomputernetworks;

gatheringandpublishingresearchstatistics,pollingandconductingmarketresearchinthefieldofon-linegamingandcasinos.

TheComplainantstatesthatsubstantialamountsoftime,effortandmoneyhavebeenexpendedoverthelasttwoyearsinpromotingitswebsiteat<>andthetrademarkTRUSTEDCASINOS.TheComplainantstatesthatintheperiod1999 to2002,itexpendedmorethanUS$1,350,000inacquiringthemarkandthedomainname,advertisingandpromotingitsgoodsandservicesanddevelopingthewebsite.InitsSecondAmendedComplaint,theComplainantstatesthat（inadditiontoasignificantsumpaidforthesite）sinceApril 2000,ithasspentapproximatelyUS$1,065,054.95onadvertisingalone.

TheComplainantstatesthatvisitstotheComplainant’sinternetwebsitearetheessentialportionofitsbusiness.ItassertsthatasatDecember 1999,onlyonemonthafterthesitebecameoperative,theComplainant’swebsitewasreceivinganaverageof1,500,000hitspermonth.ThereisnoexternalevidenceavailabletosubstantiatethisclaimastheComplainantpurchasedthesiteinApril 2000,andthepreviousownerdidnotkeepanyrecordsevidencingtrafficbacktothattime.TheComplainantdid,however,submitthatitwouldnothavepaidsuchaconsiderablesumforthesitehadthesitenothadahighvolumeoftraffic.TheComplainantannexedacopyofthesaleandpurchaseagreementforthesitetotheSecondAmendedComplaint.

TheComplainantassertsthatinthe24hourperiodfromJanuary 8, 2002,toJanuary 9, 2002,alone,2,627,207hitswererecordedontheComplainant’swebsite.TheComplainantstatesthatitnowaverages100,000,000hitseverymonthandabout3,000,000visitors.Itclaimsthatthesevisitorsareextremelytargetedandspendonaverage17minutespervisittotheComplainant’swebsite.TheComplainantsubmits,initsSecondAmendedComplaint,thatsinceJanuary 30, 2002,thesitehasaveraged2,395,890hitsperdayby120,200visitors.TheComplainantannexedfulltrafficlogreportsinsupportofthisclaim.

TheComplainantclaimsthatbyvirtueoftheextensivescopeofconsumersalesandthesubstantialsumsspenttopromoteproductsandservicesunderthemarkTRUSTED CASINOS,themarkhasacquiredanimportantdegreeofconsumerrecognitioninthemindsofthepurchasingpublicandtheon-linegamingbusinesscommunity.Itclaimsthatthemarkisnowwell-knownandservestoidentifytheComplainant’sproductsandservices.

TheComplainantalsoannexedtotheComplaintareportfromanindependentexternalmediaagency,JupiterMediaMetrix,datedNovember 2001.ThisreportlistedtheComplainant’swebsiteasoneofthetop25sitesforon-linegaming.

TheComplainantstatesinitsSecondAmendedComplaintthatJupiter Media MetrixisahighlyrespectedresourcebymajornewsmediamemberssuchasNew York Times,CNN,TheWallStreetJournal,Reuters,Business WeekandUSA Today.TheComplainantannexedcopiesofstoriesfromthesenewsourcesfeaturingJupiterMediaMetrixdataandanalysis,orrelyingons
