PREAMBLE
I.LedbytherecommendationfoundintheBroadcastingActthatchildren'sBroadcastsnotbeaccompaniedbyAdvertisementsorSponsorRecommendationsforfoodstuffsorbeveragescontainingingredientswhosepresenceinexcessamountsinthedailydietisnotrecommended;
II.WhereasthetasksoftheNationalBroadcastingCouncilincludeinparticulartheinitiationandsupportofself-regulationintheprovisionofmediaservices;
III.Recognisingtheimportanceofvoluntarilyacceptedobligations,theNationalBroadcastingCouncil,TelevisionBroadcasters,andtheUnionofAssociationsAdvertisingCouncilhavetakentheinitiativetodraftrulesregardingthetransmissionalongsidechildren'sBroadcastsofAdvertisementsandSponsorRecommendationsregardingfoodstuffsorbeveragescontainingingredientswhosepresenceinexcessamountsinthedailydietisnotrecommended;
IV.Inresponsetotheaforementionedinitiativeandledbytheneedtoensureeffective,targetedprotectionofchildrenfromharmfulcontent,inconnectionwithcounteractingthepromotionofunhealthyfoodamongchildren;
V.WhereasthefactthattheUnionofAssociationsAdvertisingCouncilhasdeclared,inaccordancewiththecontentofthedeclarationformingAppendixNo.13tothisAgreement,itswillingnesstocooperatewithtelevisionbroadcastersthroughtheongoingnotificationofAdvertisingCouncilresolutionstakenonthebasisoftheCodeofEthicsinAdvertisingintheareaoffoodadvertisingdirectedatchildren;
ThePartiesenterintothisAgreementandundertaketocooperateinthemannerdescribedbelow.
DEFINITIONS
Children'sbroadcast–atelevisionbroadcastasdefinedbytheBroadcastingAct,whichduetoitstimeoftransmission(betweenthehoursof6:
00AMand8:
00PM)andcontentisaddressed(directed)mainlytoviewers(children)aged4(four)to12(twelve);
Nutritionalcriteria–documententitled"Nutritionalcriteriaforself-regulationregardingfoodadvertisingdirectedtochildrenunder12yearsofage"ofDecember2013,draftedbythePolishFederationoftheFoodIndustryUnionofEmployerswithitsseatinWarsaw,providedtoTelevisionBroadcastersbytheUnionofAssociationsAdvertisingCouncilwithitsregisteredofficeinWarsaw,inaccordancewiththecontentofthedeclarationcomprisingAppendixNo.13tothisAgreement,verifiedbytheNationalFoodandNutritionInstitutewithitsregisteredofficeinWarsaw(NutritionalCriteriaandtheletterfromtheNationalFoodandNutritionInstituteinWarsawcompriseAppendicesNo.9and10,respectively,tothisAgreement);
Broadcaster–aphysicalperson,legalperson,orpersonaltradingcompanywhoproducesandorganisesatelevisionprogrammeserviceandtransmitsitorhasittransmittedbyotherpersons;
Agreement–thisagreement;
Televisionprogramme–ascheduledcompositionofprogrammes,commercialcommunicationsorotherbroadcasts,transmittedinitsentiretyinamannerthatallowssimultaneousreceptionbythegeneralpublicinasequencedeterminedbytheBroadcaster;
Advertisement–commercialcommunicationfromtheAdvertiserinrelationtoitseconomicorprofessionalactivity,inordertopromotethesaleorpaiduseofproductsorservices;
Advertiser–anypublicorprivateentitycommissioningthedistributionofAdvertisementsandSponsorRecommendationsintelevisionprogrammes;
Parties–thepartiestotheAgreementaretheTelevisionBroadcasterswhohaveconcludedtheAgreementorotherBroadcasterswhosubmitwrittendeclarationofentranceintotheAgreement(asampledeclarationcomprisesAppendixNo.8tothisAgreement);
TheBroadcastingAct–theBroadcastingActof29December1992(unifiedtext,JournalofLaws2011,No.43,item226,asamended);
SponsorRecommendations–recommendationsincludingthename,company,tradelogo,orotherdesignationindividualisinganenterpriseoritsactivity,referencetoitsproducts,services,ortradelogo.
§1
TelevisionBroadcasters'Obligations
1.Thetelevisionbroadcasterspledgethatchildren'sBroadcastsshallnotbeaccompaniedbyAdvertisementsorSponsorRecommendationsconcerningfoodstuffsorbeveragescontainingingredientswhosepresenceinexcessamountsinthedailydietisnotrecommended,ontheconditionsofandinaccordancewiththeruleselaboratedinSections2and3below.
2.Thetelevisionbroadcastersdeclarethat:
a)theyhavereceivedthedocumententitled"Nutritionalcriteriaforself-regulationregardingfoodadvertisingdirectedtochildrenunder12yearsofage"ofDecember2013,draftedbythePolishFederationoftheFoodIndustryUnionofEmployerswithitsregisteredofficeinWarsaw,verifiedbytheNationalFoodandNutritionInstitutewithitsregisteredofficeinWarsaw;
b)Thenutritionalcriteriashallconstituteguidelinesestablishingthedivisionoffoodproductsintocategories,withthedesignationoffoodstuffsandbeverageswhoseAdvertisementorSponsorRecommendationsshouldberecommended,foodstuffsanddrinkswhoseAdvertisementorSponsorRecommendationsshouldnotbeaddressedtochildrenunder12yearsofageaswellasfoodstuffsanddrinkswhoseAdvertisementorSponsorRecommendationarepermitted,withregardtotheiringredients.
3.TheTelevisionBroadcastersundertaketorequireAdvertiserstosubmitadeclarationofNutritionalCriteriacomplianceofthecontentoftheAdvertisementandSponsorRecommendationdistributedbytheTelevisionBroadcastersbefore,duringandaftertransmissionofchildren'sBroadcasts.AsampleAdvertiserdeclarationcomprisesAppendixNo.11a/btothisAgreement.
§2
TelevisionBroadcasters'Cooperation
1.Inordertoimplementmechanismsofcooperationandself-regulationintheperformanceoftheAgreement,theTelevisionBroadcastersshallappointrepresentativesauthorizedtocarryouttheAgreement.Alistofauthorisedrepresentatives(togetherhereinafterreferredtoasthe"Representatives"),andrulesforupdatingthelistarepresentedinAppendixNo.12tothisAgreement.
2.TheRepresentativesshall,inparticular:
a)monitortheperformanceoftheAgreementbytheParties;
b)monitorlegislativeprocessesrelatedtolegalregulationsontheprotectionofchildren'shealth,takingintoaccountthesubjectofthisAgreement;
c)holdquarterlymeetingstoshareinformationontheperformanceofthisAgreementbytheParties;
d)proposechangestotheAgreementandindicatetheirscope.
3.TheAuthorisedRepresentativesshallcooperatetoensuretheproperandeffectiveperformanceoftheAgreement,andinparticularshallbeincontactwith:
a)TheNationalBroadcastingCouncilregardinginspections,performedwithinthescopespecifiedbytheregulationsoftheBroadcastingAct,oftheTelevisionBroadcasters'activitywithinthescopespecifiedintheAgreement;
b)TheAdvertisingCouncil,withtheaimofmonitoringthevalidityoftheestablishedNutritionalCriteriaaswellasmonitoringtheresolutionsnotifiedbytheAdvertisingCouncilandpassedonthebasisoftheCodeofEthicsinAdvertisingintheareaoffoodadvertisingdirectedtochildren;
c)organizationsdealingwiththepromotionofhealthyfood;
d)otherbroadcasters,inordertoencouragethemtoenterintotheAgreement.
4.TheTelevisionBroadcastersdeclarethattheactivitydescribedintheAgreementshallbecarriedoutwithutmostcareandinaccordancewithgoodmorals,aswellaswithrespectfortheprinciplesoffaircompetition.
§3
TermofAgreement
1.TheAgreementshallbeeffectivefromthedateofitsconclusion,insuchawaythat:
a)fromthedateofconclusion,thePartiesshallbeginimplementingtheresolutionsoftheAgreementwithinthescopeofactivityconducted,inparticularinthescopeoftechnicalsolutionsenablingitsapplication,proceduresandtradepoliciespresentedtoAdvertisers,
b)theregulationsconcerningtherequirementofAdvertiserstosubmitadeclarationofNutritionalCriteriacomplianceofthecontentoftheAdvertisementandSponsorRecommendationdistributedbytheTelevisionBroadcastersbefore,duringandaftertransmissionofchildren'sBroadcastsshallbeusedforallcontractsconcludedstartingfrom1December2014,takingintoaccounttheresolutionsofpo
