根据国家、省、市有关法律、法规及房地产管理的各项规定,甲乙丙三方本着平等、自愿的原则,经协商一致订立本合同,并共同遵守,接受当地房地产管理机关的监督、管理。
Accordingtotherelatedlaws,Regulationsandrulesofrealestatemanagementbythecountry,provinceandcity,bothPartiesconcludedthiscontractthroughconsultationadheringtotheprinciplesofequalityandvoluntaryparticipation,andjointlycomplywiththecontract.BothPartiessubjecttheirselvestosupervisionandmanagementbythelocalrealestatemanagementoffice.一、甲方同意将坐落在_______________________________的房地产出租给乙方作(按房屋使用性质填写)用途使用,面积平方米。

并按照双方签订的房地产租赁合同使用房屋,甲方应在租赁期満或解除合同之日将保证金本金退回乙方。
3.PartyBhaspaidPartyAdepositof(currency:
RMB)RMBandusesthehouseaccordingtotheleasecontractconcludedbybothParties.PartyAshallreturnthedeposittoPartyBonthedateofexpirationorterminationoftheleasecontract.四、在租赁期内,甲方承担下列责任:
4.PartyAbearsthefollowingresponsibilitywithintheleasehold:
1.依合同将房屋及设备交付乙方使用。
未按约定提供房屋的,每逾期一日,须按月租金额的1%向乙方支付违约金。
4.1ThehouseandfacilitiesshallbemadeavailabletopartyBbythecontract.1%ofmonthlyrentshallbepaidtoPartyBasafineperdayifthehouseisnotbeavailableaccordingtothecontract.2.甲方负责对房屋定期安全检查,承担房屋主体结构自然损坏的维修费用;如因房屋维修须乙方临时搬迁时,甲方应与乙方签订回迁协议;如因甲方维修责任而延误房屋维修造成他人人身伤亡、财产损失的,应负责赔偿。
4.2PartyAshallmakearegularsafetycheckonthehouseandbearthemaintenancecostofthenaturaldamageofthemainstructureofthehouse.PartyAandPartyBshallconcludereturningagreementifPartyBhastomovetemporarilybecauseofthemaintenanceofhouse.PartyAshallcompensatefortheinjury,deathandlossofpropertycausedbydelayreparationofthehouse.3.租赁期间转让该房屋时,须提前1个月书面通知乙方;抵押该房屋须提前15日书面通知乙方。
4.3Whentransferringthehousewithintheleasehold,awrittennoticeshallbesenttoPartyBaheadof1_months.PartyAshallsendawrittennoticetoPartyBaheadof15daysbeforemortgagingthehouse.4.。
租赁期内,甲方如需提前解除合同,应事前征得乙方同意4.4IfPartyAhastoterminatethecontractwithintheleasehold,PartyAshallobtainconsentfromPartyBaheadoftime.、五租赁期内,乙方负责承担下列责任:

逾期交付租金的,每逾期一日,乙方须按当月租金额的1%向甲方支付违约金。
如果逾期15日,甲方有权解除合同,收回房屋。
5.1Paytherentontime.PartyBshallpay1%ofthemonthlyrenttoPartyAasafineperdaydelayed.If15daysareoverdue,PartyAhastherighttoterminatethecontractandcallinthehouse.-3-
2.严格按房屋使用性质使用房屋。
乙方擅自改变房屋用途,甲方可解除合同,收回房屋。
5.2Usethehousestrictlyaccordingtotheusageofthehouse.IfPartyBunilaterallychangetheusageoftheusageofthehouse,PartyAhastherighttoterminatethecontractandcallinthehouse.3.因使用需要对房屋进行扩、加、改建(含改变间隔)、室内装修或增加设备,必须经甲方书面同意并订立书面协议,并按规定重新议定租金,甲方有权对工程进行监督。
5.3Ifthehouseneedstobeextended,added,reconstructed(includingspacechanging),interiordecoratedortheadditionoffacilities,PartyBshallgetawrittennoticefromPartyAandconcludeawrittenagreement.Therentshallbeconcludedagainaccordingtoberegulations.PartyAhastherighttosupervisetheconstruction.4.将房屋转租、分租的,适用以下第1点:
5.4Theconditionofsubleasingthehouseappliestothefollowing1point:
(1)、不得将房屋转租或分租。
如违反则视为乙方自动放弃房屋使用权,本合同在转租或分租之日起解除,保证金不予退还,由此造成的一切损失,由乙方负责赔偿。
5.4.1Ifthesubleasingofthehouseisnotallowed.IfPartyBviolatesthecontract,itisregardedthatPartyBvoluntarilygivesuptherightofusingthehouse.Thiscontractisterminatedonthedateofsubleasingoccurs.Thedepositshallnotbereturned.PartBshallberesponsibleforalllossesarisingthereout.
(2)、同意将房屋转租或分租。
必须签定转租合同,重新议定租金和其它合同条款并办理租赁登记手续。
5.4.2Ifthesubleasingofthehouseisallowed.Asubleasecontractshallbemade.TherentandothertermsofthecontractshallbeconcludedbybothParties.Subleasingregisterformalshallbetransacted.5.爱护和正常使用房屋及其设备,发现房屋及其设备自然损坏,应及时通知甲方并积极配合甲方检查和维修,因乙方过错延误维修而造成他人人身伤亡、财产损失的,乙方负责赔偿;使用房屋不当或者人为造成房屋损坏的,应负责修复或赔偿。
5.5Takecareofandnormallyusethehouseandthefacilities.Whenfindingthatthehouseandthefacilitiesareinnaturaldamaged,PartyBshallinformPartyAandcoordinatewithPartyAtodocheckandreparation.PartyBshallberesponsiblefortheinjury,deathandlossofpropertyduetodelayedreparationofthehouse.PartyBshallberesponsibleforthehousereparationorcompensationduetomisusingordamagingcreatedbyman.6.乙方在承租的房屋内需要安装或者使用超过水、电表容量的任何水电设备,应事前征得甲方同意,并由甲方负责到有关部门办理增容手续,费用由乙方负担。
5.6PartyBshallgetpromisefromPartyAwhenfixingorusinganywaterorelectricaldeviceswhichexceedsthecapacitiesofwatermeterorelectricmeterinsidethehousetented.PartAshallgothroughtheformalitiesofcapacityexpansionattherelateddepartment.PartyBshallbearthefees.-4-
7.注意防火安全,不得在房屋内非法存放易燃、易爆等危险物品。
5.7Payattentiontofiresafety.Dangerousgoodssuchasexplosivegoods,inflammablegoodsetc.arenotallowedtobestoredinthehouseillegally.8.租赁期内,乙方需提前解除合同的,应事前征得甲方同意。
5.8WhenPartyBwantstoterminatethecontractaheadoftimewithintheleasehold,hemustobtainconsentfromPartyAaheadoftime.9.租赁期届满且甲方要求收回房屋或解除合同之日,应交回原承租房屋和设备给甲方;如需继续承租房屋,应提前1个月与甲方协商,双方另订合同。
5.9OnthedatewhentheleaseholdexpiresandPartyAwantstocallinhouseorrescindthecontract,PartyBshallreturnthehouseandfacilitiestoPartyA.IfPartyBwantstorentthehousecontinuously,heshallconsultwithPartyAaheadof1monthsandbothPartiesshallconcludeanothercontract.六、违约责任:
6.Responsibilityofbreach.1.任何一方未能履行本合同规定的条款或者违反房地产租赁管理法律、法规,另一方有权依法提前解除本合同,造成的损失由责任方承担。
6.1Ifoneofthepartycannotperformthecontractitemsorviolateagainstlaws/regulationsofrealestatetenanciesmanagement,theotherPartyhastherighttoterminatethecontract.ThePartybearingtheresponsibilityshallundertakethelossarisingthereout.2.租赁期届满,甲乙双方未续定合同且甲方要求收回房屋,乙方逾期不交出承租房屋的,甲方除限期乙方迁出和补交占用期租金外,并有权按占用期内租金总额的50%收取违约金。
6.2Whentheleaseholdexpires,ifbothPartieshasnotrenewedthecontractandPartyAwantstocallinthehouse,whilePartyBhasnotreturnedthehouserented.PartyAhastherighttocollectafineof50%oftherentsumaccordingtotheoverduetime,andPartyAmayaskPartyBtomoveoutwithinthelimitedtimeandpayoverduerent.3.租赁期内任何一方无法定或约定的理由而单方提出解除合同的,另一方有权要求赔偿损失,收取违约金。
6.3Duringtheleasehold,anyPartyinthiscontractshallnotterminatethecontractunlessthesituationisclearlydefinedinthetermsofthiscontract.Otherwise,theviolatormustpayapenaltyofRMBtotheobservantasaresultofbreachingthecontract.、七违约金、赔偿金应在确定责任后十日内付清,每逾期一天,按应付金额的1%支付滞纳金。
7.Whentheresponsibilityisdetermined,acontractualfineorcompensationshallbepaidwithin10days.Asumof1%overduefineshallpaidforeachdayoverdue.八、在租赁期内,经房屋安全鉴定部门鉴定房屋不符合安全使用标准时,租赁合同自然终止,因此造成的损失由责任方负责赔偿。
8.Withintheleasehold,whenthehousedoesn’tcomplywithsafetyusestandardverifiedbythesafetyverificationdepartment,thetenanciescontractterminatesnaturally.ThePartybearingtheresponsibilityshallundertakethelossarisingthereout.-5-
九、如因不可抗力的原因,造成本合同无法履行时,双方互不承担责任。
9.Ifthecontractcannotbeperformedduetoforcemajor,neitherofthepartiesbearstheresponsibility.十、本合同履行中发生争议,双方应协商解决,协商不成时,可采用下列第1种方式(只能选择一种,同时选择两种无效)解决:
10.Whendisputeoccursduringtheperformanceofthecontract,thetwopartiesshallconsulttomakesettlement.Iftheycannotmakeagreement,thefollowingmethodofitem1canbeadoptedtosolvetheproblems:
1.向广州仲裁委员会(具体仲裁机构名称)申请仲裁;10.1Applyforarbitrationfrom.GUANGZHOUARBITATIONCOMMISSION2.向人民法院起诉。
在协商与诉讼期间,双方均不得采用任何方式威迫对方。
10.2BringasuitinaPeople’sCount.Duringtheconsultationandlawsuit,noneofthepartiesispermittedtointimidatetheotherpartyinanyway.十一、上述房屋在租赁期内,需要交纳的费用(电、水、管理费用)和税费,由乙方按规定承担。
(管理费收费标准:
3.5元/平方米)11.Duringtheleasehold,PartyBmustpayfortheutilitycharges(electricity\water\managementfee)andtaxesaccordingtothecontract.(thecriterionofthemanagementis3.5/㎡)十二、本合同未尽事宜,双方可另行签定补充协议,但内容不得违反国家、省、市有关法律和法规,如与本合同有抵触且补充协议中不作注明的,以《东莞市房地产租赁合同》为准。
其补充协议经双方签章和房地产租赁管理机构登记后作为本合同附件,与本合同具有同等法律效力。
12.Otherclausesbeyondthecontractmaybemadeandsighedasanadditionalagreementbybothparties.Thecontentoftheclausesshallnotbreachtherelatedlawsandregulationsofthestate,provinceandcity.“TheContractofRealEstateTenanciesinDongguang”prevailsifthecontentoftheclausescontravenesthecontractorwithoutexplanationintheadditionalagreement.Theadditionalagreementshallbetakenasanappendixtothecontractandhasequalvalidityoflawafteritissighedbybothpartiesandregisteredattherealestatetenanciesoffice.十三、本合同一式三份,甲方执正本一份,乙方执正本一份,丙方执合同正本一份。
