ObamaCareadvocatesaregrowingfearfulthatseveralkeytaxesfrozeninWednesday’sbudgetdealwillnevergointoeffect.
ThepairofbudgetdealsnegotiatedbycongressionalleaderswouldhaltordelaythreeObamaCaretaxes,forcingthepresidenttomakehisbiggestconcessionyetsincehishealthcarelawwaspassed.
Hoursafterthedealwasannounced,WhiteHousespokesmanJoshEarnestdownplayedthebiggestchange–adelayoftheCadillactax–as“minimal.”Butsupportersofthelawsaythey’reworriedthatthedelayofthesetaxes,untilafterObamaleavesoffice,willultimatelyleadtotheirdemise.
“ThefearforadvocatesofthetaxisthatonceCongressstartsdelayingit,itwon’tlast,”saidLarryLevitt,aseniorvicepresidentattheKaiserFamilyFoundationandformerClintonadministrationhealthadviser.
Mostsignificantly,thelegislationwouldagainpushbackthe“Cadillac”taxonemployerhealthcarebenefits–ameasureatthecenteroftheObamaadministration'seffortstocontainhealthcarecosts.
Intotal,thosechangeswouldtakea$35billionbiteoutofthelaw’srevenuestream,accordingtoanalysesreleasedbycongressionalbudgetscorekeepersonWednesday.
Ifthechangestothelawaremadepermanent,itwouldundermineakeyargumentforthecost-savingmeasuresinthelaw.ItcouldalsomeanthattheAffordableCareActendsupcostingtaxpayersmoney.
“Ifthoseactuallyendupasrepeals,allthesuddenthelawthatwasscheduledtosavemoneyinthefirstdecadewouldcostmoneyinthefirstdecade,”saidLorenAdler,researchdirectorfortheCommitteeforaResponsibleFederalBudget.
“Thatwouldflipthesignonthewall,whichcouldbeabigthing,”hesaid.
Alone,thethreetaxchangeswouldhaveasmalleffectonthelaw,whichisprojectedtosave$200billionover20years.
Ifjustthehealthinsuranceandmedicaltaxarerepealed,multiplehealthcareexpertssaiditwouldn’thaveanymeaningfuleffectonthehealthcarelaw.Thebiggestloserswouldbedeficithawks.
ButthedelayoftheCadillactaxisdifferent,expertssay.
Thetwo-yeardelayoftheCadillactaxrepresentsthemostsignificant–andcostliest–changetothelaw.CongressionalscorekeeperssaidWednesdayitwouldcostnearly$20billion.
Thetaxhasbeenhailedasapowerfulforceforcontrollinghealthspending.JasonFurman,Obama’schiefeconomist,deliveredanimpassioneddefenseofthetaxasrecentlyasMonday,callingitakeypieceofthepresident’shealthcarelegacy.
SomeopponentsoftheCadillactaxhadlongbelievedthattheObamaadministrationwouldultimatelyhavetonixthetaxafterofficialsstruckadealtodelayitbackin2010.
Fiveyearslater,andundergrowingpressurefromuniongroups,theadministrationagainagreedtopunt.
“There’sbeenanassumptionthatCadillactaxcancontrolcoststhroughmagicandaswegotclosertoitseffectivedate,someoftheconsequencesforworkerhealthbenefitshavebecomeapparent,”Levitt,theformerClintonhealthadviser,said.“Anytimeyoutrytocontrolhealthcarecoststherearetradeoffs.”
Still,somehealthcareexpertsargueitwillbetoughertorepealthetax,evenwithanewpresident.
“Idon’tseethetaxgettingrepealedinfull,”saidDanMendelson,CEOofthehealthcareconsultingfirmAvalereHealth.
“Everyonehatestaxes,okay,soitisreallyeasytobeagainstthetax,andit’seasyespeciallytobeagainstthetaxthatpotentiallyhurtspeoplewhohaveillness.It’sproblematic.Butit’safiscalrealitythatrepealingataxisveryhardtodo,”hesaid.
