LaborContractLawofthePeople’sRepublicofChina
“LaborContractLawofthePeople’sRepublicofChina”,whichisadoptedattheTwenty-EighthMeetingoftheStandingCommitteeoftheTenthNationalPeople'sCongressonJune29,2007,ispromulgatednowandwillbeeffectiveasofJanuary1,2008.

Article1
ThisLawisformulatedinordertoperfectthelaborcontractsystem,clarifyrightsandobligationsofbothpartiestolaborcontract,protectlabor’slegalbenefits,andstructureanddevelopharmoniousandstablelaborrelationship.
Article2
ThisLawappliestoestablishmentoflaborrelationship,conclusion,implementation,modification,revocation,orterminationoflaborcontractbetweenallenterprisesandindividualeconomicorganizations,privatenon-enterpriseunitsandotherorganizations(hereinafterreferredtoasemployingunits)withintheboundaryofthePeople'sRepublicofChinaandlaborers.
Theconclusion,implementation,modification,revocation,orterminationoflaborcontractbyStateorgans,institutionalorganizationsandsocietiesaswellaslaborerswhoformalaborcontractrelationshiptherewithshallfollowthisLaw.
Article3
Conclusionofalaborcontractshallfollowtheprinciplesoflegality,equality,fairness,voluntariness,unanimitythroughconsultation,loyaltyandcredibility.
Alaborcontractonceconcludedinaccordancewiththelawshallpossesslegalbindingforce.Theemployingunitsandlaborersshallfulfilltheobligationsasstipulatedinthelaborcontract.
Article4
Theemployingunitsshallestablishandperfectlaborrulesandregulationstoensurethatlaborersenjoytherighttoworkandfulfilllaborobligations.
Duringconcluding,modifying,ordeterminingrulesandregulationsonlaborremuneration,workinghours,restandvacations,occupationalsafetyandhealth,insuranceandwelfare,employeetraining,labordiscipline,managementoffixquotasofwork,andothergreatissuesdirectlyconcerningtheinterestsoflaborers,theemployingunitsshallsubmitprogramsandopinionstothecongressofstaffandworkersorallofitsstaffandworkersfordiscussion,andmakefinaldecisionthroughequalconsultationwiththetradeunionorrepresentativesofthestaffandworkers.
Thetradeunionorthestaffandworkersshallhavetherighttoairitsopinionsifitregardsasinappropriatetheimplementationanddeterminationofrulesandregulations,andothergreatissues,andthemodificationandperfectionshallbeconductedthroughconsultationwithemployingunits
Theemployingunitsshalldiscloseinpublicornotifythelaborersofthedeterminationonrulesandregulations,andgreatissuesdirectlyconcerningthelaborers’interests.
Article5
Thelaboradministrativedepartmentsofthepeople’sgovernmentsatorabovethecountylevelshallsetupandperfectthecoordinationsystembythethreepartiesinvolvedinlaborrelationshipjointlywiththetradeunionandrepresentativefromenterprisetojointlyresearchandsolvegreatissuesonlaborrelationship.
Article6
Tradeunionshallassistanddirectlaborerstolegallyconcludeandimplementlaborcontractwiththeemployingunits,andsetupacollectiveconsultationmechanismwithemployingunitstoprotectlaborers’legitimaterightsandinterests.
ChapterIIConclusionofLaborContract
Article7
Theemployingunitsshallsetuplaborrelationshipwithlaborersuponthedateofemployment.Theemployingunitsshallpreparearegisterofthestaffandworkersforinspection.
Article8
Theemployingunitsshallinformthelaborersofthetruthaboutcontentsofwork,workingconditions,locationofwork,occupationalhazards,productionsafety,laborremuneration,andotherdetailsthatthelaborwantstoknowduringrecruitment;theemployingunitsshallhavetherighttoknowthebasicinformationdirectlyrelatedtothelaborcontractandthelaborshallmakeastatementofthetruth.
Article9
Theemployingunitsarenotallowedtodetaintheresidentidentificationcardandothercertificationsoflaborers,requestlaborerstoprovideguarantees,orchargeanybelongingsfromlaborersunderothernamesduringrecruitment.
Article10
Alaborcontractshallbeconcludedinwritingformoncealaborrelationshipissetup.
Awrittenlaborcontract,whichfailedtobeconcludedsimultaneouslyupontheestablishmentoflaborrelationship,shallbeconcludedwithinonemonthfromthedateofemployment.
Wheretheemployingunitandthelaborershaveconcludedalaborcontractpriortotheemployment,thelaborrelationshipisdeemedtobesetupfromthedateofemployment.
Article11
Wheretheemployingunitsfailtoconcludeawrittenlaborcontractupontheemployment,orthelaborremunerationagreeduponwithlaborersisnotclear,thelaborremunerationofnewlyemployedlaborersshallbedeterminedinaccordancewiththeprovisionsincollectivecontract;theprincipleofequalpayforequalworkshallbeadoptedifthereisnosuchacollectivecontractorthelaborremunerationisnotstipulatedinthecollectivecontract.
Article12
Thelaborcontractsshallbedividedintofixedtermlaborcontract,non-fixedtermlaborcontractandlaborcontracttakingthecompletionofaspecificamountofworkasaterm.
Article13
Fixedtermlaborcontract,referstoalaborcontractinwhichtheemployingunitsandlaborershaveagreedupontheexacttimeforterminationofthecontract.
Theemployingunitsmayconcludeafixedtermlaborcontractwithlaborersbasedontheunanimitythroughconsultation.
Article14
Non-fixedtermlaborcontract,referstoalaborcontractinwhichtheemployingunitsandlaborershavenotagreedupontheexacttimeforterminationoflaborcontract.
Theemployingunitsmayconcludeanon-fixedtermlaborcontractwithlaborersbasedontheunanimitythroughconsultation.Anon-fixedtermlaborcontractshallbeconcludedifthelaborerswantoragreetoreneworconcludelaborcontractinanyofthefollowingcircumstancesunlessthelaborerswanttoconcludeafixedtermlaborcontract:
(1)Thelaborershavekeptworkinginthisemployingunitfortenyears;
(2)Thelaborershavekeptworkinginthisemployingunitfortenyearswhentheemployingunitinitiallyimplementslaborcontractsystemorthelaborcontractisrenewedduringrestructuringofstate-ownedenterprise,andthegaptothelegitimateretirementageislessthantenyears;
(3)WherefixedtermlaborcontractwasconcludedsuccessivelyfortwotimesandthelaborisfreeofcircumstancesspecifiedinArticle39,andclause
(1)andclause
(2)inArticle40ofthisLaw,thelaborcontractshallberenewed.
Itshallbedeemedthattheemployingunitshaveconcludedanon-fixedtermlaborcontractwiththelaborersiftheemployingunitsfailtoconcludeawrittenlaborcontractwiththelaborerswithinoneyearfromthedateoftheemployment.
Article15
Laborcontracttakingthecompletionofaspecificamountofworkasaterm,referstothelaborcontractinwhichtheemployingunitandlaborerhasagreedupontakingthecompletionofaspecificworkasatermofcontract.
Theemployingunitsshallconcludealaborcontracttakingthecompletionofaspecificamountofworkasatermwiththelaborersbasedontheunanimitythroughconsultation.
Article16
Alaborcontractshallbeconcludedbasedontheunanimitythroughconsultationbetweentheemployingunitsandthelaborersandbecomeeffectiveuponthesignatureorsealonthedocumentoflaborcontractbytheemployingunitsandthelaborers.
Laborcontractshallbemadeintwocopiesandeachpartyoftheemployingunitandthelaborersshallkeepone.
Article17
Alaborcontractshallcontainthefollowingclauses:
(1)name,addressandlegalrepresentativeorpersoninchargeofemployingunit;
(2)name,addressandnumberofresidentidentificationcardorothervalididentificationcertificationsoflaborer;
(3)termoflaborcontract;
(4)contentsandlocationofwork;
(5)workinghours,restsandvacations;
(6)laborremuneration;
(7)socialsecurity;
(8)laborprotection,workingconditions,andprotectionofoccupationalhazard
(9)Otherissuestobecontainedinlaborcontractaccordingtoprovisionsoflaw,regulationsandrules.
Apartfromtheclausesrequiredbytheprecedingparagraph,othercontentsincludingprobationperiod,training,confidentiality,additionalinsuranceandwelfaremaybeagreeduponinalaborcontractthroughconsultationbetweentheemployingunitandthelaborers.
Article18
Whereadisputetakesplacebecausealaborcontractfailstoclearlyspecifythestandardsonlaborremunerationandworkingconditions,theemployingunitsandthelaborersmaynegotiateagain;ifsuchconsultationfails,theprovisionsofcollectivecontractshallapply;ifthereisnosuchacollectivecontractorthereisnosuchprovisionsonlaborremunerationincollectivecontract,theprincipleofequalpayforequalworkshallapply;ifthereisnosuchacollectivecontractorthereisnosuchprovisionsonworkingconditions,therelevantstateregulationsshallapply.

Foralaborcontractwhosetermislongerthanthreemonthsandshorterthanon
