PleaAgreement
GENERALPROVISIONS
1.Thedefendant,JohnLindh,pursuanttoRule11(e)
(1)(A),agreestopleadguiltytoCountNineoftheIndictmentandtoaCriminalInformationfiledherewith.CountNinechargesthedefendantwithsupplyingservicestotheTaliban,inviolationofTitle50,UnitedStatesCode,Section1705(b),Title18,UnitedStatesCode,Section2,andTitle31,CodeofFederalRegulations,Sections545.204and545.206(a).TheCriminalInformationchargesthedefendantwithcarryinganexplosiveduringthecommissionofafelonywhichmaybeprosecutedinacourtoftheUnitedStates,inviolationofTitle18,UnitedStatesCode,Section844(h)
(2).ThemaximumpenaltyfortheviolationofCountNineistenyears’imprisonment;afineof$250,000;threeyearsofsupervisedrelease;anda$100specialassessment.ThepenaltyfortheoffensechargedintheCriminalInformationistenyears’imprisonment,consecutivetoanytermofimprisonmentimposedonCountNine;afineof$250,000;threeyearsofsupervisedrelease;anda$100specialassessment.Thedefendantisawarethatanytermofsupervisedreleaseisinadditiontoanyprisontermthedefendantmayreceive,andthataviolationofatermofsupervisedreleasecouldresultinthedefendant’sbeingreturnedtoprisonforthefulltermofsupervisedrelease.Thepartiesagreethatiftwotermsofsupervisedreleaseareimposedinthiscase,thetermsaretobeservedconcurrently.See18U.S.C.section3624(e).
2.Thedefendantagreesthatpendingsentencinginthismatterhewillnotseekreleasefromdetention.
3.Beforesentencinginthiscase,thedefendantagreestopayamandatoryspecialassessmentofonehundreddollars($100.00)percountofconviction.Restitutionisnotapplicableinthiscase.
4.Atsentencinginthiscase,theGovernmentwillmovetodismissCounts1through8,andCount10.
SENTENCINGMATTERS
5.PursuanttoRule11(e)
(1)(B),thepartiesstipulateandagreethatthecorrectapplicationoftheUnitedStatesSentencingGuidelinesisasfollows:
i.AstoCountNine,themostanalogousoffenseguidelineissection2M5.2.Theapplicablebaseoffenselevelis26.Atwelve-levelupwardadjustmentisappropriatebecausetheprovisionsof§3A1.4apply.Thedefendant’scriminalhistorycategory,therefore,isCategoryVI.Athree-levelreductionisappropriateforAcceptanceofResponsibility,pursuantto§3E1.1(a)and(b),resultinginanOffenseLevelTotalforCountEightof35.Accordingly,theSentencingGuidelineRangeonCountEightis292-365months,subjecttothestatutorymaximumoftenyears’imprisonment.
ii.AstotheoffensechargedintheCriminalInformation,theoffenseguidelineissection2K2.4,andtheguidelinesentenceistenyearsimprisonment.
iii.Accordingly,theappropriatetotalsentenceofimprisonmentistwentyyears.Neitherpartywillseekanupwardordownwarddeparturefromthatsentence.
iv.AstobothCountNineandtheoffensechargedintheCriminalInformation,nofineisappropriate.
6.Thedefendantisawarethat18U.S.C.Section3742affordsadefendanttherighttoappealthesentenceimposed.Acknowledgingallthis,thedefendantknowinglywaivestherighttoappealanysentenceuptoandincludingtwentyyears’imprisonment,orthemannerinwhichthatsentencewasdetermined,onthegroundssetforthin18U.S.C.Section3742oronanygroundwhatever,inexchangefortheconcessionsmadebytheUnitedStatesinthispleaagreement.ThisagreementdoesnotaffecttherightsorobligationsoftheUnitedStatestoappealassetforthin18U.S.C.Section3742(b).
7.TheUnitedStateswillnotfurthercriminallyprosecutethedefendantforthespecificconductdescribedintheIndictment,theCriminalInformation,ortheStatementofFacts.
WAIVEROFRIGHTS
8.ThedefendantrepresentstotheCourtthatthedefendantissatisfiedthathisattorneyshaverenderedeffectiveassistance.Thedefendantunderstandsthatbyenteringintothisagreement,thedefendantsurrenderscertainrightsasprovidedinthisagreement.Thedefendantunderstandsthattherightsofcriminaldefendantsincludethefollowing:
a.Ifthedefendantpersistedinapleaofnotguiltytothecharges,thedefendantwouldhavetherighttoaspeedyjurytrialwiththeassistanceofcounsel.Thetrialmaybeconductedbyajudgesittingwithoutajuryifthedefendant,theUnitedStates,andthejudgeallagree.
b.Ifajurytrialisconducted,thejurywouldbecomposedoftwelvelaypersonsselectedatrandom.Thedefendantandthedefendant’sattorneywouldassistinselectingthejurorsbyremovingprospectivejurorsforcausewhereactualbiasorotherdisqualificationisshown,orbyremovingprospectivejurorswithoutcausebyexercisingperemptorychallenges.Thejurywouldhavetoagreeunanimouslybeforeitcouldreturnaverdictofeitherguiltyornotguilty.Thejurywouldbeinstructedthatthedefendantispresumedinnocent,thatitcouldnotconvictthedefendantunless,afterhearingalltheevidence,itwaspersuadedofthedefendant’sguiltbeyondareasonabledoubt,andthatitwastoconsidereachchargeseparately.
c.Ifatrialisheldbythejudgewithoutajury,thejudgewouldfindthefactsand,afterhearingalltheevidenceandconsideringeachcountseparately,determinewhetherornottheevidenceestablishedthedefendant’sguiltbeyondareasonabledoubt.
d.Atatrial,theUnitedStateswouldberequiredtopresentitswitnessesandotherevidenceagainstthedefendant.Thedefendantwouldbeabletoconfrontthosewitnessesandthedefendant’sattorneywouldbeabletocross-examinethem.Inturn,thedefendantcouldpresentwitnessesandotherevidenceindefendant’sownbehalf.Ifthewitnessesforthedefendantwouldnotappearvoluntarily,thedefendantcouldrequiretheirattendancethroughthesubpoenapoweroftheCourt.
e.Atatrial,thedefendantcouldrelyonaprivilegeagainstself-incriminationtodeclinetotestify,andnoinferenceofguiltcouldbedrawnfromtherefusalofthedefendanttotestify.Ifthedefendantdesiredtodoso,thedefendantcouldtestifyinthedefendant’sownbehalf.
TERMSOFCOOPERATION
9.Thedefendantagreestocooperatefully,truthfullyandcompletelywiththeUnitedStates,andprovideallinformationknowntothedefendant.Afailuretocooperatefully,truthfullyandcompletelyisabreachofthispleaagreement,asdeterminedbytheCourt.ThedefendantacknowledgesthathehasbeenadvisedthattheUnitedStateswillnotseekadownwarddeparturefromtheapplicablesentencingguidelines,orfromthesentenceimposed,pursuanttoSection5KoftheSentencingGuidelines,Title18U.S.C.Section3553(e),orRule35(b)oftheFederalRulesofCriminalProcedure,inrespecttothedefendant’scooperation.Inregardtothatcooperation:
a.Thedefendantagreestotestifyfully,truthfullyandcompletelyatanygrandjuries,trialsorotherproceedings,includingmilitarytribunals.
b.AsrequiredbytheUnitedStates,thedefendantagreestobeavailablefordebriefingbylawenforcementandintelligenceofficersandforpre-trialconferenceswithprosecutiveauthorities.ThetimingandlocationofsuchdebriefingsandmeetingsshallbedeterminedbytheUnitedStates.Shoulddefensecounselwishtoattendparticulardebriefings,theGovernmentwillseektoschedulesuchdebriefingsconsistentwiththescheduleofdefendant’scounsel,whoshallmakethemselvesreasonablyavailable.
c.Thedefendantagreestoprovidealldocuments,records,writings,ormaterials,objectsorthingsofanykindinthedefendant'spossessionorunderthedefendant’scare,custody,orcontrolrelatingdirectlyorindirectlytoallareasofinquiryandinvestigation,exceptingdocumentsprivilegedundertheattorney-clientprivilege.
d.Thedefendantagreesthat,uponrequestoftheUnitedStates,thedefendantwillvoluntarilysubmittopolygraphexaminationstobeconductedbyapolygraphexamineroftheUnitedStates’choice.Thedefendantstipulatestotheadmissibilityoftheresultsofthispolygraphexaminationiflaterofferedinaproceedingtodeterminethedefendant’scompliancewiththispleaagreement;however,thedefendantreservestherighttochallengetheweightthatshouldbeattributedtosuchpolygraphsbycontestingtheaccuracyofsuchpolygraphs.
e.ThedefendantagreesthattheaccompanyingStatementofFactsislimitedtoinformationtosupporttheplea.Thedefendantwillprovidemoredetailedfactsrelatingtothiscaseduringensuingdebriefings.
f.Thedefendantisherebyonnoticethathemaynotviolateanyfederal,state,orlocalcriminallawwhilecooperatingwiththegovernment.
ADDITIONALGENERALPROVISIONS
10.TheUnitedStatesagreesnottouseanytruthfulinformationprovidedpursuanttothisagreementagainstthedefendantinanyothercriminalprosecutionagainstthedefendant.Regardlessofanyotherprovisionofthisagreement,however,theUnitedStatesmayuseanystatementmadebythedefendant,whetherintheformoftheStatementofFactsaccompanyingthispleaagreementorinthedebriefingofthedefendantorinsomeotherform,againstthedefendantinanyprosecutionofthedefendantresultingfromthedefendant’sbreachofthepleaagreement,whethersuchbreachiscausedbythedefendant’sprovidingfalseinformation,failingtoprovidefullandcompletecooperation,orforanyothervalidreason.Suchaprosecutionincludes,butisnotlimitedto,aprosecutionforperjuryorfalsestatements.
11.ThispleaagreementdoesnotrestricttheCourt'sorProbationOffice’saccesstoinformationandrecordsinthepossessionoftheUnitedStates.
12.Thispleaagreementisnotconditioneduponchargesbeingbroughtagainstanyotherindividual.Th
