InterplayoftheADA,FMLA,andWorkersCompensationTrainingforSupervisorsSHRM20082IntroductionTheBermudaTriangleisanareaintheAtlanticOceaninwhichanunusuallyhighnumberofshipsandplaneshavedisappeared.Becausetheinterplayofthreemajoremploymentlaws-theAmericanswithDisabilitiesAct(ADA),theFamilyandMedicalLeaveAct(FMLA)andWorkersCompensationissocomplicatedandfraughtwithproblems,manyHRprofessionalsoftenrefertothesethreelawsastheBermudaTriangleofEmploymentLaw.Itisessentialforallsupervisors,inadditiontothehumanresourcesstaff,tounderstandtheinterplayoftheselawstoassurelegalcomplianceaswellastoprovideemployeeswiththebenefitsandprotectionseachlawprovides.Thissamplepresentationisintendedforpresentationtosupervisorsandotherindividualswhomanageemployees.ItisdesignedtobepresentedbyanindividualwhoisknowledgeableintheADA,FMLAandWorkersCompensationandtheinteractionamongtheselaws.Thisisasamplepresentationthatmustbecustomizedtoincludeandmatchtheemployersstatelawsanditsownpoliciesandpractices.SHRM20083ObjectivesAtthecloseofthissession,youwillbeableto:
StatewhyitimportanttorecognizeandanalyzetheinteractionoftheADA,FMLAandWorkersCompensationLawsCitethedifferentpurposesofthethreelaws.Nametheenforcementauthoritiesforeachlaw.Citeimportantareasofinterplaybetweenthethreelawsthatemployersneedtoconsiderwhenmanagingemployeeabsenteeism.Describeandanalyzeasituationinwhichthethreelawsinteract.SHRM20084ReasonsItisImportanttoRecognizeandAnalyzetheInteractionoftheADA,FMLA,andWorkersCompensationLawsItisimportanttorecognizeandanalyzetheinteractionoftheselawsbecause:
1.Themajorityofunscheduledandscheduledabsencesarerelatedtotheillnessofemployeesortheirfamilymembers.One,both,orallthreeoftheselawsmaybeinvolved.2.Violationsoftheselawsmayresultinlostwages,backpay,reinstatement,retroactivebenefits,compensatorydamages,andpunitivedamages.3.Otherthanthelegalresponsibilities,employershavemoralandethicalresponsibilitiestoassurethatemployeesreceivethebenefitsandprotectionstheselawsprovide.SHRM20085PurposeoftheADA,FMLA,andWorkersCompensationLawsTheADAprohibitsdiscriminationagainstapplicantsandemployeeswhoare“qualifiedindividualswithadisability”.TheFMLAsetsminimumleavestandardsforemployeesforthebirthandnewborncareofachild,placementofachildforadoptionorfostercare,tocareforanimmediatefamilymemberwithaserioushealthcondition,andfortheemployeesserioushealthcondition.WorkersCompensationlawsprovideforpaymentofcompensationandrehabilitationforworkplaceinjuriesandminimizeemployerliability.SHRM20086EnforcementAuthoritiesfortheADA,FMLA,andWorkersCompensationLawsADAEqualEmploymentOpportunityCommission(EEOC)FMLADepartmentofLabor(WageandHourDivision)WorkersCompensationLawsStateWorkersCompensationCommissionsSHRM20087AreasofInterplaybetweenADA,FMLA,andWorkersCompensationThesearetheareasofinterplaybetweentheADA,FMLA,andWorkersCompensationthatemployersneedtoconsiderwhenmanagingemployeeabsenteeism.NOTE:
