Guidance
I.Beforesigningthecontract,thetwopartiesshallcarefullyreadeverydetailsofthecontract.Legalvalidityshalltakeeffectuponthetwoparties’signingthecontractandthetwopartiesshallstrictlyperformanceaccordingtothetermsofthecontract.
II.Thecontractmustbesignedpersonallybythelegalrepresentative(orentrustedperson)oftheemployer(partyA)andtheemployeehimself/herself(partyB)withthechopoftheemployer(orLaborContractSpecialChop)thatshallbedeemedeffective.
III.Theblankcolumninthecontractshallbedecidedbythetwopartiesbynegotiationanddiscussion,andthecontentmustbeclearlyindicated;forthecolumnwithnoindicatedcontent,pleasemarkwith“/”.
IV.Thelabortimesystemisdividedintothreeparts:
standerworkingtimesystem;indefinitetenseworkingsystem;synthesiscomputationman-hourofwork.IfitimplementstheindefinitetenseworkingsystemandSynthesiscomputationman-hourofwork,itshouldbeapprovedbythelaborsecuritydepartment,andagreedandmarkedoutthespecificcontentintheitemthreeoftheeleventharticleinthiscontract.
V.Withregardtotheissuenotcoveredinthecontract,pleasesignothersupplementaryagreementastheattachmentofthecontractthatfulfilledtogetherwiththecontract.
VI.Eachlaborstanderofthelaborcontractthattheindividualemployeesignedwiththeemployershallnotbelowerthanthecontractagreementsignedbytheunionortheworkerswhowaselectedtobearepresentativesoftheemployee.
VII.Thecontractshallbefilledwithpenwithclearletter,simpleandaccuratewords,anyunauthorizedchangeshallnotbeallowed.
VIII.Theoriginalcontract(withattachment)washeldbyPartyAandPartyBrespectivelyafterverified.
IG.TheteGtofthiscontractshallnotapplytothenonfulltimeemployment.

ThecontractisherebyconductedbybothpartiesinaccordancewithLaborLawofthePeople’sRepublicofChinaandLaborContractLawofthePeople’sRepublicofChina,intheprinciplesoffairness,legitimacy,equality,voluntariness,consensusthroughnegotiationandgoodfaith.
I.ContractValidPeriod

II.Jobdescriptionandworkingplace
A.PartyB’sworkingdepartmentis,workingpost(managementtechnicalpostorproductionoperationpost)is,title(function)is.

III.Workinghoursandresthours
A.Bothpartiesagreetoperformtheworkandresttimeinaccordancewiththeprovisionsofthe"EmployeeHandbook".
B.PartyBentitledtoallholidaysandleavesprovidedbytheState,includingannualleave,marriageleave,funeralleave,maternityleave,etc.Andpaywagesaccordingtothesalarystandardasstipulatedinthiscontract.
IV.Laborpayment
A.AccordingtothewagesystembasedlegalsalaryregulationbyPartyA,PartyB’sbasicsalaryintheperiodofprobationisRMB/month,allowancewages(includingdifferentkindsofovertimeworkingandbonus)is,meritpayis.(performasPartyA'sevaluationsystem),intotal,other.
B.Aftertheprobationperiod,andPartyBhadcompletedtheworktasksandachievedtherequiredqualitythatstipulatedbyPartyA.ThebasicsalaryafterbecomingafulltimemembershallbeRMB/month,allowancewages(includingdifferentkindsofovertimeworkingandbonus)is,meritpayis.(performasPartyA'sevaluationsystem),intotal,other,accordingtoPartyA’ssalarysystem.
C.Otheragreementoflaborpayment
D.PartyAshallpaythewageof(lastmonth/thismonth)toPartyBon
ofeverymonth.
E.PartyAshalldeterminethewagedistributionsystembylawaccordingtotheproductionandoperation,pricelevelandgovernmentissuedwagegrowthguidancelineoftheorganization.
F.PartyB’slaborpaymentwillbeevaluatedaccordingtohis/herposition,dutiesandcomprehensiveperformance.IfPartyB’spositionanddutieschangeduetoPartyA’sdemandofthebusinessmanagementormarketchangesandotherfactors,PartyB’swageandtreatmentwillalsoadjustthechanges.PartyBshalladmitthisandPartyAdidnothavealiabilityforbreachthecontract.PartyBshallpayindividualincometaGaccordingtolaw.
V.Socialinsuranceandfringebenefits
Inaccordancewithnationalandlocallaws,regulationsandpolitiesrelatingtosocialinsurance,PartyAshallpaypartofthebasicsocialinsuranceforPartyB,socialinsurancepremiumpaidbyindividualpartiswithholdwagesfromPartyB.PartyAshouldtellthetruthtoPartyBabouthandlingthesocialinsuranceformalitiesandwithholdingofsocialinsurancepremiums.
VI.Laborprotection,laborconditionsandoccupationalhazardprotection
A.PartyAprovidelaborprotectionfacilitiesandlaborconditionsconformingtonationalregulationsaccordingtotherelatednational,provincialandlocallaborprotectionregulationstotrulyguaranteePartyB’ssafetyandhealthduringproductionandworking.PartyAshallinformPartyBanyoccupationaldiseasemayproduceduringthework,andprotectthehealthandrelatedrightsofPartyBaccordingtotheprovisionsof"occupationaldiseasepreventionlaw".
B.Inaccordancewiththerelatingnationalandlocallaws,regulationsandpolities,PartyAshouldprotectthefemaleworkercommendably.
VII.Thechange,dismantlement,terminationofthelaborcontract
A.Whenchangingthelaborcontract,thetwopartiesshouldinformtheotherpartyinwriting.
B.Bothofthepartieshavetherighttochangethetermsofthecontractordismantlethecontractafternegotiationbybothparties.ThechangecontractoragreementshouldbeheldbybothpartiesandHRdepartment.
VIII.Terminationandrelieveofthelaborcontract
A.Relief
1.Thislaborcontractcouldbeterminatedafternegotiationbybothparties.
2.Underoneofthefollowingcircumstances,PartyAcanterminatethiscontract:
(1)WherePartyBisprovedtobenotinconformitywiththetermsofemploymentintheprobationperiod;
(2)WherePartyBseriouslyviolatestherulesandregulationsofPartyA;
(3)WherePartyBcommitsseriousderelictionofdutyorpracticesgraftorcorruption,causingsubstantialeconomicdamagetoPartyA;
(4)WherePartyBhasadditionallyestablishedalaborrelationshipwithanotheremployerwhichmateriallyaffectsthecompletionofhis/hertasksatPartyAorrefusestorectifythematterwhenbroughttohis/herattentionbyPartyA;
(5)WherePartyBcheats,threatens(includingprovidefakeinformationtoPartyA)PartyA,andsignsorchangesthecontractinviolationofthetruemeaningofPartyA,whichleadstotheinvalidofthecontract;
(6)WherePartyBhashis/hercriminalliabilityinvestigatedinaccordingtolaw;
(7)WherePartyB,duetosicknessorinflictedoffthejob,cannotresumehis/herworkordotheotherjobreassignedbyPartyAafterspecifiedperiodofmedicaltreatment.
(8)WherePartyBisunqualified,evenafteratrainingorjobadjustment;
(9)TheobjectiveconditionsonwhichthecontractisbasedhavemateriallychangedtotheeGtentthatitisimpossibletoperformthecontractwhilebothpartiescannotreachanagreementtoamendthecontracttoreflectthechangedconditions;
3.Underoneofthefollowingcircumstances,PartyAmayreducethepersonnelaftertheprocedureisperformed:
(1)PartyAshallbereformedinaccordancewiththeprovisionsoftheenterprisebankruptcylaw
(2)PartyAhasgreatdifficultiesinproductionandoperation;
(3)PartyAadjustedtheproduction,technologicalinnovationormanagementmodel;
(4)Whenthecontractcannotbefulfilledbecauseotherlaborcontractswhichsigningatthattimewasbasedontheobjectiveeconomicsituation;
4.PartyBmaycancelthecontractupon30days’priorwrittennoticetoPartyA;ifintheprobationperiod,3daysinadvance.
Underoneofthefollowingcircumstances,PartyBcanterminatethecontract:
(1)WherePartyAfailstopayPartyB’ssalaryorprovideworkconditionsasstipulatedherein.
(2)WherePartyAfailstopaylaborremunerationinfullandonschedule;
(3)WherePartyAfailstopaysocialinsurancepremiumsforPartyBaccordingtolaw;
(4)WherePartyA’srulesandregulationsviolatelawsandregulations,therebyharmingPartyB’srightsandinterests;
(5)WherePartyAcheats,threatensPartyB,andsignsorchangesthecontractinviolationofthetruemeaningofPartyB,whichleadstotheinvalidofthecontract;
(6)PartyAbreaksthelawsorhasmandatoryprovisionsofadministrativeregulations,whichmakesthecontractinvalid.
(7)PartyAforcesPartyBworkbyviolence,threatorillegallimitationsofPartyB’sfreedom,or
illegalcommandPartyBtodothedangerousworkwhichcannotensurethesafetyofPartyB;
(8)OthercircumstancesasspecifiedinlawsoradministrativestatutesenablePartyBtodissolvethecontract.
IfPartyAhasthecircumstancelikearticle(7)asBmentionedabove,PartyBcanterminatethelaborcontractatoncewithoutinformingPartyA.
B.Terminate
1.ThelaborcontracteGpiresorotherstatutoryterminationconditionsappear;
2.Underoneofthefollowingcircumstances,thiscontractcanbeterminated:
(1)EGceptforPartyBmaintainsorimprovestheconditionstorenewthecontract,PartyBdoesn’tagreetodoso,thelaborcontracteGpires.
(2)PartyAisdeclaredbankruptcylegally;
(3)PartyA’sbusinesslicenseisrevoked;PartyAiscompelledtoclosedownordissolve;orPartyAdecidestodissolveinadvance;
(4)Othersituationsstipulatedinlawsandadministrativeprovisions.
3.PartyBisconfirmedpartlyortotallyincapacitatedduetoanindustrialinjuryoranoccupationaldiseasewhenworkingforPartyA,inaccordancewiththeprovisionsofthestateandtheprovinceontheimplementationofindustrialinjuryinsurance.
