一、租赁标的:
Tenancy:
甲方同意将中国北京市及其设备在良好状态下租给乙方。
PartyAherebyagreestoleaseDistrict,Beijing,Chinaandthefixtures,fittingsandequipmentthereiniscleanedandintenantableconditionstoPartyB.
二、租期:
TermofTenancy:
2.1租赁期为1年,自2012 年9月1日起至2013年月31日止。
Theabovepropertyisherebyleasedforatermof1year,commencingonSeptember1st,2012andexpiringon.
2.2在租期开始当日,出租房屋及其家俱电器应已装修或安装布置完毕,处于可供租赁的良好状态。
Theabovepropertyanditsequipmentandfurnitureshallbefullyrenovatedorinstalledandintenantableconditiononthecommencementofthelease.
2.3租期届满,甲方有权收回出租房屋及全部家俱、电器(包括附件一所列所有家具、设备),乙方亦应如期交还;乙方如要求续租,则享有优先续租权,但必须在本租约期满二个月前向甲方提出书面申请,租金双方另行协商。
Onexpiryofthislease,PartyAhastherighttotakebacktheleasedproperty(includingallthefurniture,fittingsandequipmentlistedinAppendixI)infull,andPartyBmustdelivertheleasedpropertyonthedateofexpiry.IfPartyBwishestoextendthelease,PartyBshallhavetheprioritytorenewtheleasewithtwomonthsadvancewrittennoticetoPartyA.Therevisedrentalshallbenegotiatedbetweenthetwoparties.
三、租金:
Rent:
3.1租金每月为人民币元(大写:
),包括家具电器(见附件2),物业管理费,正式租赁完税发票,卫星电视收视费和宽带使用费。
TherentisRMB(inwords:
only)permonth,includingfurnitureandelectricalappliances(SeeAppendixII),managementfee,officialtaxinvoiceofrental,satelliteTVsubscriptionfeeandinternetusagefee.
3.2甲方或甲方委托代理方需在前一月的20日前向乙方发送付款通知书及相应租金发票。
乙方于每月第十个工作日前支付当月租金(见甲方银行信息),支付租金日期以乙方汇出日期为准。
如若拖欠有关发票,甲方视为违约,乙方有权延付租金。
无论租期何时开始,租金按自然月支付。
PartyAorAgent,whoisauthorizedbyPartyAshallissueapaymentadviceandtherentinvoicetoPartyBbeforethe20thdayofeachformercalendarmonth.PartyBshallpayeachmonth'srentinadvance,onorbeforethe10thdayofeachcalendarmonth,byremittingtheamountofsuchrenttoabankaccountdesignatedbyPartyA(asreferredtoPartyA’sBankAccountInformation).Thedateofremittancesshallbethedateofpayment.IncasePartyAfailstodoso,PartyAshallbetreatedasinbreachofthisAgreementandPartyBshallhavetherighttowithholdrentalpayment.Nomatterwhentheleasestarts,therentshallbepaidbyeachcalendarmonth.
3.3本租约签订后的第一个月租金,乙方应于入住前3个工作日内全额到付给甲方。
PartyBshallpaytherentforfirstmonthinfullwithinthreeworkingdaysbeforetheLeaseCommencementDateaftersigningoftheLeaseAgreement.
3.4租金款以人民币支付。
TherentshallbepaidinRMB.
3.5在本租约有效期内,租金不予调整。
TherentcannotbeadjustedduringthetermofthisTenancyAgreement.
四、押金:
Deposit:
4.1自本租约签订之日起十个工作日之内,乙方应向甲方缴付相当于两个月租金额的租赁押金计人民币元(大写:
)。
乙方如不再续租,乙方应在租赁期结束后将杂费及电话费付清,在乙方结清费用后,甲方须在10个工作日内退还租赁押金给乙方。
WithintenworkingdaysaftersigningofthisTenancyAgreement,PartyBshallpaytoPartyAtwomonthsrentasdeposit,whichisequivalenttoRMB(inwords:
only)intotal.Oncompletionofthetenancyperiod,ifPartyBdoesnotcontinuetorenttheleasedproperty,PartyBshallpayalloutstandingfeeandtelephonebill.AfterPartyBclearthebillunderthelease,PartyAshallrefundthedepositinfulltoPartyBwithin10workingdays.
4.2乙方如在租赁期内,因乙方原因而终止租约(不可抗力除外),押金不予退还。
IfPartyBterminatestheTenancyAgreementduringtheleasetermforreasonsotherthanForceMajeure,thepaiddepositwillnotberefunded.
4.3押金以人民币支付。
ThedepositshallbepaidinRMB.
五、其它费用:
OtherCharges:
5.1乙方在租赁期内所用的电,水煤气,乙方按单缴付。
Duringtheperiodoftenancy,PartyBshallpaymonthlyallchargesforusageofelectricity,waterandgasbasedontheactualconsumptionamountbillingfromthemanagementoffice.
5.2乙方所用电话,按电信局标准收费,每月根据实际用量结算,乙方按单缴付。
AlltelephonechargesshallbepaidbyPartyBandbasedontheactualusageaccordingtotheTelecommunicationBureaustandardtariffsonreceiptofthebills.
六、甲方的责任:
Landlord’sResponsibilities:
6.1本租约签订后,甲方不得无故收回房屋。
如甲方必须终止合同,则必须提前2个月通知乙方,同时返还乙方的押金并且支付给乙方2个月的租金作为赔偿金。
PartyAisnotpermittedtotakebacktheleasedpropertyduringthetermofcontractwithoutanyreason.IfPartyAhastoterminatetheleasePartyAshallrefundtheDepositandpayanamountequalsto2monthsrentasthecompensationtoPartyB.
6.2督促物业管理公司提供充分的保安,消防工作及安静清洁的居住环境。
如果该房屋中存在有害气体、噪音,甲方又无法解决时,乙方有权终止本协议,甲方应返还乙方全额押金。
Tosupervisetheestatemanagementofficetoprovideadequatesecurity,firepreventionandquiet&cleancircumstance.Ifthereispoisonousgas,noisesintheapartment,andPartyAcouldnotsolvetheproblem,PartyBhastherighttoterminatethisAgreementimmediately.PartyAshallrefundthewholeamountofdeposittoPartyB.
6.3甲方应督促管理公司向乙方提供足够的服务,如冷水,热水,电的供应及各种设备的正常工作。
TosupervisethattheestatemanagementofficetoprovidesufficientandtimelyservicetoPartyB,suchassupplyofcoldwater,hotwater,electricityandtoensurethepropermaintenanceofallkindsofequipment.
6.4甲方应负责租赁期内房屋及其设备的正常维修,并承担维修房屋及设备的正常磨损而产生的费用。
PartyAshallresponsibleforallnormalmaintenanceofleasedpropertyandequipmentduringthetermlease,andPartyAshallbearallmaintenancecharges.
6.5甲方应对甲方的固定设施,包括该物业的或引入该物业的结构、屋顶、管道、设施、排污、管道和缆线(包括电力及电话)等进行维护,使之处于完好、可租赁状态;如果对上述各项的造成的损坏或破坏不是由乙方或其助理的不慎、疏忽或不良行为造成的,则甲方在收到乙方发出的通知后24小时内必须安排人员在提前向乙方通知后进入该房屋进行维修或修缮工作。
若五个工作日内甲方仍不能进行修缮或修缮无效(甲方无法控制的情况除外,如天气因素、材料无货等等),甲方必须更换同类物品以保障乙方居住人的正常生活尽量不受影响。
若物业内有发霉现象,甲方需要立即采取有效措施解决霉菌问题,确保乙方住户的正常生活。
TomaintainandkeepPartyA’sfixtures,includingthestructure,roof,sanitaryandplumbingfacilities,drains,pipesandcables(includingelectricityandtelephone)ingoodleasingcondition.PartyAshouldpromptlyrepairorremedyanydefectsthereinafterbeingnotifiedofsuchdefectbyPartyB,providedallsuchdefectsarenotasaresultofthePartyB’s,oritsassistant’snegligentaction,omissionormisconduct.PartyAshallenterthesaidpremisestodothenecessaryrepairsormaintenancewithin24hoursandwithadvancednoticetothePartyB.IfPartyAfailstorepairthesaidpremiseproperlywithinfive(5)workingdaysafterreceiptofsuchdemandfromPartyB(exceptsomedelayarecausedbyoutofPartyA’scontrol,likeweather,nosupplyofthefittingetc.),PartyAshallreplaceanothersimilaronetoensurePartyB’snormallifeneed.Ifthereismouldandfungusinthehouse,PartyAshalltakeeffectivemeasuresimmediatelytoresolvetheproblemandensuretheoccupantofPartyB’snormallife.
6.6若甲方违反此租约的条款并在乙方发出书面通知14天后仍未改正,乙方有权终止此租约,收回押金,且有权进一向甲方要求索赔。
WhenPartyAseriouslybreachestheTenancyAgreementandfailstoremedythebreachafterwrittennotificationoffourteen(14)calendardaysgivenbyPartyB,PartyBshallhavetherighttoterminatetheTenancyAgreementandPartyBshallbeentitledtowithdrawthedepositwithoutdeductionandwithoutprejudicetoitsrighttoclaimforanylossesanddamagesagainstPartyA.
6.7甲方谨在此声明及保证甲方为出租房屋的合法拥有人并有合法地位出租此房屋于乙方。
就本合同及出租此出租房屋予乙方之事,甲方已取得所有有关机构的批准,包括政府批准。
甲方於本合同所作出的声明及保证,如有错误或违反者,甲方须就乙方因此而引致的任何损失、损害、支出及费用作出全部补偿(包括但不限于法律费用)。
PartyAherebyrepresentsandwarrantsthatPartyAisthelegalowneroftheleasedpropertyandhasthenecessarylegalcapacitytoleasethepropertytoPartyB.PartyAhasalsoobtainedallthenecessaryauthorizationsfromallrelevantauthoritiesinthePeople'sRepublicofChinainrespectofthisAgreementandtheleasingoftheleasedpropertytoPartyB,includinganynecessarygovernmentapprovals.PartyAherebyrepresentsandwarrantsthatPartyAshallcontinuetobeliabletokeepPartyBfullyindemnifiedagainstanycosts,expenses,lossesanddamagessufferedbyPartyB(includingbutnotlimitingthelawfee)ifPartyAfailedtoobeytheleasingagreement.
6.8如在租赁期内,出租房屋发生所有权全部或部分的转移、或其他影响乙方权益的事情时,甲方应保证所有权人或其他影响乙方权益的第三者,能继续遵守本合同所有条款。
纵使出租房屋已被转移,如乙方于本合同下的权益受此等所有权人或第三者所影响或损害,甲方须负责补偿乙方的所有损失、损害、支出及费用。
Ifduringthetermofthistenancy,allorpartoftheleasedpropertyistransferredtoathirdpartybyPartyA,orPartyB'srighttousetheleasedpropertyisotherwiseaffected,PartyAshallensurethatsuchtransfereeorthirdpartyhavinganeffectonPartyB'srighttousetheleasedpropertywillcontinuetoabidebythetermsofthisAgreement.EveniftheleasedpropertyistransferredwhereatransfereeorathirdpartyaffectsPartyB’sinterestsunderthisAgreement,PartyAshallcontinuetobeliabletokeepPartyBfullyindemnifiedagainstanycosts,expenses,lossesanddamagessufferedbyPartyB.
七、乙方责任:
Tenant’sResponsibilities:
7.1乙方应按3.2条支付每月租金,如有逾期,须按日加付其租金0.5%的滞纳金,若超过限定期限30天,乙方仍未支付的,则甲方有权解除本租约。
PartyBshallpaythemonthlyrentaccordingtoClause3.2,andapenaltyof0.5%oftherentwillbechargedperdayifPartyBfailstopaytherentduly.IfPartyBdelaysthemonthlyrentpaymentatthefullamountforoverthirty(30)daysafterthetimelimit,PartyAhastherighttoterminatethisAgreement.
7.2本租约签订后,若乙方未按本租约的约定支付首月租金及押金超过十五个工作日以上,甲方有权解除本租约。
IntheeventthatPartyBfailstopaytherentforthefirstmonthanddepositaccordingtothestipulationofthisAgreementformorethan15(fifteen)workingdays,PartyAhastherighttoterminatethisAgreement.
7.3租赁期内未经甲方同意,乙方不能转让其所租房屋,私自转让无效。
DuringtheperiodofTenancy,unlesswiththeagreementofPartyA,PartyBcannotsub-letorletinpartorinfulltheleasedproperty.
7.4乙方应爱护房屋及其设备,如因使用不当而导致损坏,乙方应负责赔偿。
PartyBmusttakegoodcareofthepropertyanditscontents,otherwisePartyBshouldpaycompensationtoPartyAforhisimproperuseoftheproperty.
7.5除房内已有的装饰和设施之外,乙方如要增加设备或其他装修须征得甲方同意。
租赁期满,乙方向甲方交还房产时,必须恢复其原状(正常磨损除外),且承担相应的费用。
