CHAPTERI.GENERALPROVISIONS
Article1
ThisActshallbecalledtheLabourCode.
Article2
ForthepurposesoftheprovisionsofthisCodethefollowingtermsandexpressionsshall,unlessthecontextrequiresotherwise,havethemeaningsassignedtothembelow:

theMinisterwhosecompetencecoverstheactivitiesofagivenemployer;
theArbitrationCommittees"
ArbitrationCommitteesestablishedinthecapitalandineachofthegovernorateoftheRepublictosettlelabourdisputes;
therepresentativesofemployers"
theGeneralFederationofChambersofCommerceandIndustry;
therepresentativesofworkers"
theGeneralFederationofTradeUnionsorthegeneralunionconcerned;

anynaturalorlegalpersonemployingoneormoreworkersinreturnforwagesinanysectorofactivitysubjecttotheprovisionsofthisCode;

anyman,womanoryoungpersonworkingforanemployer,underhissupervisionevenifnotwithinhissight,inconsiderationofawage,underawrittenorunwrittencontractofemployment;
basicwage"
thepaymentmadebytheemployertotheworkerinconsiderationofhiswork,whetherincashorinkindwhichmaybeevaluatedincurrency,excludinganyentitlementsotherthanthebasicwage;
fullwage"
thepaymentmadebytheemployertotheworkerinconsiderationofhiswork,whetherincashorinkindwhichmaybeevaluatedincurrency,includingallentitlementsofanykind;
work"
anyeffortexertedbytheworker(intellectualorphysicalorboth)inreturnforremuneration,irrespectiveofwhethersuchworkispermanentortemporary;
casualwork"
anyjobwhichisnotpartoftheactivityofanemployerandwhosecompletiondoesnotrequiremorethanfourmonths;
seasonalwork"
anyworkwhich,byvirtueofitsnatureorcircumstancesiscarriedoutatfixedseasonsoftheyearandwhosedurationdoesnotexceedsixconsecutivemonths;
youngperson"
anymaleorfemalepersonunder15yearsofage;
temporarywork"
ajobwhich,bynature,iscompletedwithinalimitedperiodorwhich,beingrelatedtoaspecificjob,endswhenthatjobiscompleted.
Article3
1.TheprovisionsofthisCodeshallapplytoallemployersandworkersexceptthosecoveredbyaspecialprovisionofthisCode;
2.TheprovisionsofthisCodeshallnotapplytothefollowingcategories:
∙(a)employeesofthestateadministrationandthepublicsector;
∙(b)officersofthejudiciaryandthediplomaticandconsularcorps;
∙(c)staffofmilitaryandsecurityestablishments;
∙(d)foreignerssecondedtoworkwiththeState;
∙(e)foreignersworkingintheRepublicunderaninternationalConventiontowhichtheRepublicisaparty,thisexemptionbeingsubjecttothelimitssetbytheConventioninquestion;
∙(f)foreignersholdingdiplomaticorspecialpassportswhohaveobtainedavisaandwhoworkintheRepublicsubjecttotheconditionsofsuchpoliticalvisasasmaybeissuedtothem;
∙(g)casualworkers;
∙(h)personsrelatedtoandworkingwiththeemployerwhoareeffectivelyhisdependantsregardlessoftheirdegreeofkinship;
∙(i)householdservantsandworkersofequivalentstatus;
∙(j)personsemployedinagricultureandpastoralworkotherthan:
o(i)personsemployedinagriculturalcorporations,establishmentsorassociationsorinenterpriseswhichprocessormarkettheirownproducts;
o(ii)personswho,onapermanentbasis,operateorrepairmechanicalequipmentrequiredforagricultureorpermanentirrigationworks;
o(iii)personsworkinginlivestockhusbandry.
Article4
Thestatusofsomecategoriescoveredbyparagraphs7,9and10ofArticle3mayberegulatedinaccordancewiththeprovisionsofthisCodeandcertainprovisionsoftheCodemaybeappliedtothembyorderoftheCouncilofMinisters,actinguponasubmissionbytheMinister.
Article5
Workisanaturalrightofeverycitizenandadutyforeveryonewhoiscapableofworking,onthebasisofequalconditions,opportunities,guaranteesandrightswithoutdiscriminationongroundsofsex,age,race,colour,beliefsorlanguage.TheStateshall,asfaraspossible,regulatetherighttoaccesstoworkthroughdevelopmentplanningofthenationaleconomy.
Article6
TheprovisionsofthisCodeshallrepresentminimumstandardsfortherightsofworkersandconditionsofemployment.Wherespecialregulationsonemploymentrelationshipslaydownmorefavourableconditionsandguarantees,themostfavourableconditionsshallapplytotheworkers,whetherthoseofthisCodeorthoseofsuchspecialregulations.
Article7
EmploymentrelationshipsshallconformtotheprovisionsofthisCodeonthefollowingbasis:
∙1.Itshallbeforbiddentoimpairoravoidanyworkers'
rightsunderacontractofemploymentinviolationoftheprovisionsofthisCode.
∙2.TheconditionsofemploymentandrightsspecifiedinthisCodeshallapplytoworkerssubjecttosuchmorefavourableconditionsasmaybecontainedintheircontractofemployment.
∙3.AllemploymentcontractsinforceatthetimeofpromulgationofthisCodeshallremainvalidprovidedthattheyaremorefavourableforworkersandtheirrenewaldoesnotimplyanydeteriorationoftheconditionsofemploymentandrightsofworkers,evenwheretheyarenotlessthantheminimumstandardofconditionsofemploymentprescribedinthisCode.
Article8
AnyamountduetoaworkerorhisbeneficiariesundertheprovisionsofthisCodeshallconstituteaprioritydebtagainstanindebtedemployer'
smovableandimmovablepropertyandshallbesettledbeforeanyotherdebtsincludinganylegalexpensesandsumsduetothepublictreasury.
Article9
ForthepurposesoftheprovisionsofthisCodeacalendaryearshallbedeemedtoconsistof365daysandamonth,of30days,unlessotherwisespecified.
Article10
Arabicshallbethelanguageusedinallemploymentrelationships,registersanddocumentsintheRepublic.Itshallbeforbiddentopleadagainstaworkerwithanydocumentwritteninaforeignlanguage,evenifsuchdocumentweresignedbytheworker.WhereadocumentisinbothArabicandaforeignlanguage,theArabicversionshallberegardedasauthoritativeinitsinterpretationandapplication.
Article11
1.ALabourCouncilshallbeestablishedbyorderoftheCouncilofMinistersinaccordancewithaproposaloftheMinister.ThisCouncilshallbecomposedofrepresentativesoftheMinistryandrepresentativesofworkersandemployersandshalllaydownguidelinesandsubmitrecommendationstotheGovernmentinrelationtothefollowingmatters:
∙(a)draftlabourlawsandregulations;
∙(b)generalpolicyonwages,incentivesandotherbenefits;
∙(c)vocationaltrainingandrehabilitationofworkers.
2.TheorderoftheCouncilofMinistersshallspecifythenamesofthemembersoftheLabourCouncilanditsrulesofprocedure.
CHAPTERII.RULESONEMPLOYMENT
Article12
Uponstartinguphisbusiness,anemployershallsubmittotheMinistryortoitscompetentofficethefollowinginformation:
∙1.thenameofhisenterprise,itsaddressandthedateofitsestablishment;
∙2.thenatureoftheworkcarriedonbytheenterpriseandthenumberofworkersitemploys;
∙3.thenameofthepersonresponsibleforadministeringtheenterprise;
∙4.anyotherinformationrequestedbytheMinistryoritscompetentoffice.
Article13
1.AnypersonableandwillingtoworkmayapplyforregistrationwiththeMinistryoroneofitsofficesinthedistrictofhisresidence,indicatinghisage,occupation,qualifications,previousexperienceandaddress.Theauthoritytowhichtheapplicationissubmittedshallregisteritinaspecialregisterinnumericalsequenceassoonasitisreceivedandshallissuetheapplicantwithareceiptindicatingthedateandtimeoftheapplicationaswellasthecorrespondingregistrationnumberandanyothernecessaryinformation.
2.TheMinistryanditsofficesshallproposethecandidatureofpersonsregisteredwiththemforjobssuitedtotheirageandoccupationalskillstakingaccountofthesequentialorderofapplications.
Article14
1.Everyemployer
