InArizonavUnitedStates,themajorityoverturnedthreeofthefourcontestedprovisionofArizena’scontroversialplanplantohavestatesandlocalpoliceenforcefederalimmigrationlaw.TheConstructionprinciplesthatWashingtonalonehaspowerto“establishauniformRuleofNaturalization”andthatfederallawsprecedestateslawsarenoncontroversial.Arizonahadattemptedtofashionstatepolicesthatranparalleltotheexistingfederalones.
JusticeAnthoryKennedy,joinedbyChiefJusticeJohnRobrtsandtheCourt’sliberals,ruledthatthestateflewtooclosetothefederalsun.ontheoverturnedprovisionsthemajorityheldthecongresshaddeliberately“occupiedthefield”andArizonahadthusintrudedonthefederal’sprivilegedpowers.
