出租方(以下简称甲方)与承租方(以下简称乙方)于_____年月日,双方一致就以下各项条款达成协议。
Thisagreementismadeonthedayof,___betweenthelandlord(hereinafterreferredtoasPartyA)andthetenant(hereinafterreferredtoasPartyB)wherebyitisherebymutuallyagreedbyandbetweenthesaidpartiesheretoasfollows:
第1条租赁标的:
Tenancy:
1.1甲方同意将室及其设备在清洁及良好状态下租给乙方。
PartyAherebyagreestoleaseRoad.andthefixtures,fittingsandequipmentthereinincleanedandtenantableconditionstoPartyB.
第2条租期:

2.1有效租赁期为1年,自__2011年11月18日起至_2012___年11月17日止。
Theabovepropertyisherebyleasedforatermof_____oneyear_____,commencingon___18thNovember,2011______andexpiringon____17thNovember2012.
2.2本合同固定租赁期为1年,固定租赁期满后,乙方有权提出续租,但须提前二个月书面通知甲方。
Thefixedleasetermisoneyear.Afterthefixedleaseterm,partyBshallhavetherighttorenewthiscontractupongivingpriorwrittennoticetopartyAofitsintentiontwomonthsbeforeexpirationofthecontract.
2.3.1在租期开始前,甲方同意乙方在租期开始3日前将家具搬入该房屋,并且乙方无需为此支付额外费用。
如果甲方在租期开始日没有向承租人交付符合使用状态的房屋,甲方应向乙方支付每日违约金,相当于月租金的三十分之一,该违约金将由甲方向乙方按日支付直至房屋交付至承租人为止,或由乙方直接从租金中扣除,乙方无须支付从合同规定的起租日期至实际交房日期间的租金。
PartyAagreesthatPartyBmaymoveallitsfurnitureintotheproperty3dayspriortothecommencementoftheleasetermatnoadditionalcostofPartyB.IntheeventthatPartyAdoesnotdeliverPremisestoPartyBintherequiredstateontheCommencementDate,thenPartyAshallpaytoPartyBadailypenaltyamountingto1/30ofthemonthlyRent,andwhichpenaltyshallbepayablebyPartyAtoPartyBeachdayuntilthePremisesaredeliveredtoPartyB,ordeductedfromtherentaldirectly,PartyBshallnotpaytherentalfortheperiodfromthecommencementdatetothedatewhenPartyBactuallypossessestheproperty.
2.4租期届满,甲方有权收回出租房屋及全部家具、电器(包括附件2所列之所有家具、设备),乙方亦应如期交还;
逾期交还,乙方需按日支付双倍日租金(月租金的三十分之一).乙方如要求续租,则享有优先续租权,但须在本租约期满前_2_个月向甲方提出书面申请,租金双方另行协商。
Onexpiryofthislease,PartyAhastherighttotakebacktheleasedproperty(includingallthefurniture,fittingsandequipmentlistedinAppendixII)infull,andPartyBmustdelivertheleasedpropertyonthedateofexpiry.IfPartyBwishestoextendthelease,PartyBshallhavetheprioritytorenewtheleasewith_two_monthsadvancewrittennoticetoPartyA.Therevisedrentalshallbenegotiatedbetweenthetwoparties.
2.5租赁期间,若甲方或甲方的继承人出售该房屋时,乙方自愿无条件放弃优先购买房屋的权利.如甲方或甲方的继承人转让本租赁物业产权给第三方(“受让人”),甲方必须在产权转让生效前三个月通知乙方,并使该受让人与乙方达成协议,受让人承诺以房东身份继续根据本租赁合同的条件和条款履行本租赁合同,特别是根据本租赁合同规定,履行将保证金交还房客的责任。
如乙方因受让人拒绝与乙方签订上述协议或违反本合同而蒙受任何费用和损失,甲方应给予全部补偿。
Duringtheleaseterm,ifpartyAorhis/herheirsellsthishouse,partyBiswillingtowaivethepreferentialrighttopurchasethishousewithoutanycondition.Intheeventthatduringtheleaseterm,PartyAtransferstheownershiptitleofthePremisestoathirdParty(the"
Transferee"
),partyAmustnotifythepartyBthreemonthsinadvanceofthetransferbeforetheownershiptransfertakeseffectandcausethetransfereetoenterintoanagreementwiththePartyBthatthetransfereeshallcontinuetoperformthisTenancyAgreementastheLandlordundersametermsandconditionshereof,andinparticular,beobligedtorepaytheSecurityDeposittothePartyBinaccordancewiththeprovisionherein.PartyAshallindemnifyPartyBagainstanydamagesandcostsresultingfromtherefusalbytheTransfereetoenterintotheaforesaidagreementwithPartyBoranyactionsbytheTransfereeinviolationofthisTenancyAgreement.
第3条租金:
Rent:
3.1租金每月为人民币30,000元大写叁万元整,包括正式完税发票,物业管理费,宽带无线网络安装费和使用费(包括无线路由器),电话安装费,伦敦广场的家庭会所卡,卫星电视(英语频道)的开通和使用费以及附件二中所列事项和家具清单。
TherentisRMB30,000permonth,includingtaxrentalinvoice,managementfee,Telephoneinstallationfee,Internetbroadbandinstallationfeeandusingfee(withwirelessrouter),familyclubhousemembershipcardinLondonPlaza,satelliteTV(Englishchannels),otherstuffandtheinventorylistintheAppendixII.
3.2乙方支付甲方每月的租金,应在收到甲方出具的当月租赁发票后15个工作日内汇至甲方指定的银行帐号(按附件1汇款指示),支付租金日期以乙方汇出日期为准。
PartyBshallpayeachmonth'
srentwithin15workingdaysafterreceiverentalinvoicefromthelandlordbyremittingtheamountofsuchrenttoabankaccountdesignatedbyPartyA(asreferredtoinAppendixI).Thedateofremittancesshallbethedateofpayment.
3.3首月租金乙方应于租约签定且收到甲方提供的租赁发票后10个工作日内支付给甲方。
PartBshallpaytherentforfirstmonthwithintenworkingdaystoPartyAaftersignedleasecontractandreceiverentalinvoicefromthelandlord.
3.4租金款以人民币支付,在本租约有效期内,租金不予调整。
TherentshallbepaidinRMB.TherentcannotbeadjustedduringthetermofthisTenancyAgreement.
第4条押金:
Deposit:
4.1本租约签订且乙方收到甲方出具的押金收据后10个工作日内,乙方应向甲方缴付相当于_2_个月租金额的租赁押金计人民币60,000元。
租约期满,乙方如不再续租,乙方需在收到水,电,煤气费和应由乙方支付的杂费及电话费等账单后10日内付清。
如因帐单延期等原因,乙方承担的全部水,电,煤气费及电话费无法在租赁期结束后_7_日内付清,甲方有权保留部分押金并在上述项目付清后3日内返回给乙方,但保留的押金部分不应超过上一帐期应付额的二倍。
如保留的部分押金不够支付实际的帐单,乙方应在接到甲方通知后7天内向甲方补足差额,若有剩余,甲方应将剩余的押金连同已支付的帐单交还给乙方。
PartyBshallpaytoPartyA_2_months’rentasdepositwithintenworkingdaysaftersignedleasecontractandreceivedepositreceiptfromthelandlord.,whichisequivalenttoRMB60,000intotal.Oncompletionofthetenancyperiod,ifPartyBwillnotcontinuetorenttheleasedproperty,PartyBmustpayalltheoutstandingutilitiesfeesuchaswater,electricity,gasandtelephonebill.Ifsuchoutstandingutilitiesfeecouldnotbesettledbecauseoflimitationoftheaccountduedate,PartyAhastherighttokeeppartofthedepositandpaybackthisparttoPartyBaftertheoutstandingutilitiesfeesettled.Howevertheholdingpartofdepositshouldbelimitedtoasmuchastwiceofthepreviousaccountperiod.Ifthepartofthedepositisnotsufficienttocovertheactualutilitybills,PartyBshallpaythedifferenttoPartyAwithin7daysafterbeinginformedbyPartyA,whilePartyAshallreturntheleftoverofthedepositbacktopartyAtogetherwiththepaidutilitybillsifthereisanymoneyleft.
乙方如在租赁固定期内,因乙方原因而终止租约(不可抗力除外),押金不予退还。
IfPartyBterminatestheTenancyAgreementduringthefixedleasetermforreasonsotherthanForceMajeur,thepaiddepositwillnotberefunded.
4.2甲方因乙方违反本合同的规定而受的损失,可在押金中扣抵合理数目,在甲方做出该种扣抵前,需书面通知乙方将被扣抵的金额和理由,乙方有权拒绝不合理或不公正的抵扣,不足部分乙方必须在接到甲方付款通知后_7_天内补足。
PartyAmaydeductareasonableamountfromthesecuritydeposittowardspaymentofanyactualdamagesPartyAmayhaveincurredorsufferedasaresultofPartyB'
sbreachofthisAgreement.Priortomakingsuchdeductions,PartyAshallinformPartyBwithwrittennoticeoftheamountwhichitintendstodeductandthereasonformakingsuchdeductions.PartyBshallbeentitledtoobjecttosuchdeductionsifPartyBbelievesthatsuchdeductionsareunreasonableorunjustified.Ifthesecuritydepositisnotsufficienttocoversuchamounts,PartyBmustpaythedeficiencywithin_7_daysofthereceiptofademandfromPartyA.
第5条其它费用:

5.1乙方在租赁期内所用的水、电、煤气(天然气)等,物业管理公司或公共事业部门将每月按房屋实际耗用量结算,乙方按单缴付。
甲方在此承诺本出租物业用电为非工业用电计价标准(即居民用电标准)若租约3.1条中规定租金包括部分水、电、煤气费用,具体支付方式详见附件1:
(水、电、煤气等支付方式)。
Duringtheperiodoftenancy,PartyBshallpaymonthlyallchargesforusageofwater,electricityandgasbasedontheactualconsumptionamountbilledbythemanagementofficeorrelatinggovernmentutilitybureaus.PartyAensuresthattheunitpriceofelectricityofthepremisesisaccordancewithresidentialelectricitychargeregulatedbyShanghaipowerbureau.Intheeventthattheutilityhasbeenincludedinthemonthlyrental,thepaymentmethodoftheutilityshallrefertothe“UtilityPaymentmethod”saidinAppendix
5.2乙方所用电话,按上海市电信局标准收费,每月根据实际用量结算,乙方按单缴付。
AlltelephonechargesshallbepaidbyPartyBandbasedontheactualusageaccordingtotheShanghaiTelecommunicationBureaustandardtariffsonreceiptofthebills.
5.3乙方所用宽带使用费,由甲方支付。
ThemonthlyboardbandusagefeeshouldbebornebyPartyA.
第6条甲方的责任:

6.1本租约签订后并乙方支付押金后,甲方不得无故收回房屋,如甲方中途要求收回房屋,乙方有权拒绝。
PartyAisnotpermittedtotakebacktheleasedpropertyduringthetermofcontractanddepositpaidwithoutanyreason.IfPartyAwishestodoso,PartyBhastheabsoluterighttorefuse.
6.1.1本租约签订后,且乙方已按时交纳第一个月的租金或押金后,若甲方欲解除本租约且乙方同意解除,则甲方应向乙方支付相当于_2_个月租金的赔偿金.本租约在甲方支付赔偿金的当日解除。
IfPartyAwantstorescindtheAgreementafterthesignatureofthisAgreement,andPartyBhaspaidtherentorthedepositofthefirstmonthbythattime,theAgreementcanbeterminatedonlyafterPartyBhasagreedandPartyAhaspaidPartyB_2_monthsrentascompensation.TheterminationoftheTenancyAgreementeffectsonthedaywhenpartyApaysthecompensationtoPartyB.
6.2甲方应督促管理公司向乙方提供足够的服务,如冷水,热水,电的供应及各种设备的正常工作。
PartyAshouldberesponsibletosupervisethattheestatemanagementofficetoprovidesufficientandtimelyservicetoPartyB,suchassupplyofcoldwater,hotwater,electricityandtoensurethepropermaintenanceofallkindsofequipment.
6.3甲方应负责租赁期内房屋的正常维修,并承担维修房屋的正常磨损而产生的费用。
若乙方及其代理人通过租约注明的甲方联系方式无法通知到甲方及代理人,乙方有权自行安排修理,乙方有权从次月租金中扣除相应的费用,并向甲方出示修理费用发票或收据。
