甲、乙双方在自愿、平等、互利基础上,经协商一致,就乙方承租甲方物业事宜,签订本协议。
Havingreachedunanimitythroughconsultations,PartyAandPartyB,onthebasisofvoluntariness,equalityandmutualbenefit,haveenteredintothisContractinrespectofPartyAleasingthePremisestoPartyB.
一、租赁物业
LeasedPremises
1.1甲方将坐落于(以下简称‘该物业’)出租给乙方使用,该物业建筑面积为平方米。
PartyAlets(hereinafterreferredtothePremises),toPartyB,andthesizeofthePremisesissquaremeters.
1.2甲乙双方确定该物业用途为住宅。
BothPartyAandPartyBhaveconfirmedthatthePremisesshallbeforthepurposeofResidential.
1.3该物业家俱、家电配置,见本协议附件一。
Thefurniture&
appliancesofthePremisespleaseseeAppendixI.
二、租赁期
LeasingTerm
2.1本协议租赁期为个月,自年月日起至年月日止。
Theleasingtermofthiscontractshallbecalendarmonths,
commencingfromto.
2.2租赁期满,甲方有权收回该物业,乙方应准期归还;
乙方如要求续租,须在本协议期满前1个月向甲方提出书面申请,经甲方同意后重新签署租赁协议。
Onexpiryofthislease,PartyAhastherighttotakebackthePremises,andPartyBshallreturnthePremisesontime.IfPartyBwishestoextendthelease,PartyBisrequiredtogivewrittennoticetoPartyAonemonthspriortotheexpiryoftheleaseandsubjecttoPartyAandPartyB’sconsent,anewleasingcontractshallbesigned.
三、租金及确保金
RentalandDeposit
3.1租金为每个月元人民币,租金含物业管理费,发票。
Themonthlyrentalispermonth,inclusiveofmanagementfee,formalinvoice。
3.2乙方应予签署本协议后五日内向甲方支付相当于一个月租金金额,即人民币_______元,作为确保金,甲方应出具收据给乙方。
在租赁期满,乙方准期交还该物业,并付清居住期间全部租金和其它费用后十五天内,甲方应将确保金无息退还乙方。
WithinfivedaysafterthesigningofthisContract,PartyBshallpay
toPartyAasDeposit,whichisequivalenttoonemonths’rental,andPartyAshallissueareceiptforthesaidvalue.AttheexpirationoftheContract,PartyAshallrefundtheDeposittoPartyBwithoutinterestwithin15daysafterPartyBhasreturnedthePremisesandpaidalltherentandotherexpensesforthetermsthatPartyBhasoccupiedthePremises.
3.3乙方应在每个月日前支付该月租金,若乙方在租金到期后十五天仍未支付,
每逾期一天,则乙方应按日租金支付滞纳金。
若超出三十天未付,则视乙方自动退租并组成违约,甲方有权收回该物业,没收确保金并追究相关损失。
PartyBshallpaytherentalonorbeforethedayofeachcalendarmonth.IftheRenthasnotbeenpaidwithin15daysofitsduedate,PartyBshallberequiredtopayalatepenaltyfeeequalto______oftherentalperdayforeachdayofdelay.Iftherentalhasnotbeenpaidmorethan30daysaftertheduedate,
PartybwillbedeemedtohaveautomaticallyterminatedtheleasingresultinginabreachoftheContract,PartyAwillbeentitledtotakebackthePremises,retaindepositandseekrelatedlosses.
3.4甲方在收到租金后五天内应提供给乙方正式发票,若甲方在月底前仍未提供乙方发票,则乙方有权延迟支付下月租金直至收到正式发票。
甲方有责任依据税务局和/或房管局要求、要求和相关程序支付对应相关租赁房屋税款。
PartyAwillissueanofficialinvoicewithin5daysafterreceivingtherental.IfPartyAhasnotissueanofficialinvoicebytheendofthemonth,PartyBhastherighttodelaythepaymentofthefollowingmonth’srentaluntiltheinvoiceofthesaidmonthisreceived.PartyAisresponsibleforcomplyingwithregulations,requirementsandproceduresoriginatingfromtheTaxBureauand/orHousingBureaurelatedtothetaxesoftherentofthePremises.

收取租金时,房东银行所收手续费由房东支付。

四、出租人责任
Landlord’sResponsibilities
4.1甲方须按时将出租物业及家俱电器(见附件一)以良好状态交付给乙方使用。
PartyAshoulddeliveronscheduletheleasedpropertyandthefurnitureandappliances(refertoAppendixI)ingoodconditiontoPartyB.
4.2甲方应确保或责成物业管理企业对物业及其公共设施进行定时维修保养,包含
4.3但不限于物业内空调、上下水管、电线电缆、煤气管道、通讯及有线电视等设施,使之处于正常使用状态。
PartyAshouldguaranteeororderthepropertymanagementcompanytocarryoutmaintenanceandrepairofthesaidpremisesandthefacilitiesingoodandproperoperationregularly,includingbutnotrestrictedtoair-conditions,waterpipelines,wiresandcables,gaspipelines,communicationandcableTVetc.
4.3房屋基础设施和结构损坏时(不包含乙方损坏家俱和器具),甲方必需在24小时内提供维修服务或给予乙方回复,并负担相关费用。
Incaseofthebasicfacilitiesandstructureofthepremisesbeingdamaged(notincludingfurnitureandappliancesdamagedbyPartyB),PartyAshallrepairorrespondtoPartyB’scomplaintswithin24hours,andbearallcostsrelatedthereto.
4.4甲方在此申明及确保甲方为出租房屋正当拥有些人并有正当地位出租此房屋给乙方。
就本协议及出租此房屋于乙方之事,甲方已取得全部相关机构同意,包含政府同意及抵押权人同意。
甲方于本协议所做出申明与确保,如有错误或违反者,甲方须就所以而对乙方引发任何损失、损害、支出及费用对乙方做出全额赔偿。
PartyAherebyrepresentsandwarrantsthatPartyAisthelegalowneroftheleasedpropertyandhasthenecessarycapacitytoleasethepropertytoPartyB.PartyAhasalsoobtainedallthenecessaryauthorizationsfromallrelevantauthoritiesinrespectofthisContractandtheleasingofthepropertytoPartyB,includinggovernmentapprovaland/ormortgageconsent.PartyAshallbeliabletokeepPartyBfullyindemnifiedagainstanycosts,expenses,lossesanddamagesincurredandsufferedbyPartyBasaresultofanybreachofPartyA’srepresentationsorwarrantiesherein.
4.5如在租赁期内,租赁房屋发生全部权全部或部分转移,和其它影响乙方权益事情时,甲方应确保全部权人或其它影响乙方权益第三人,能继续遵守本协议全部条款。
如乙方于本协议下权益受此等全部权人或第三者影响或损害,甲方应负责赔偿乙方全部损失、损害、支出及费用。
Ifduringthetermofthetenancy,allorpartoftheleasedpropertyistransferredorPartyB’srighttouseleasedpropertyisaffected,PartyAshallensurethatsuchtransfereeorthirdpartyhavinganeffectonPartyB’srighttousetheleasedpropertywillcontinuetoabidebythetermsofthisContract.PartyAshallalsobeliabletokeepPartyBfullyindemnifiedagainstanycosts,expenses,losses
anddamageswhenanyofPartyB’sinterestshereinareaffectedorprejudicedbysuchtransfereeorthirdparty.
4.6甲方应负责依据中国法律法规所定因本楼宇租赁而产生一切税务(包含但不限于房产税,所得税和营业税)和法定费用(包含但不限于土地使用费),并必需将该些税务和法定费用直接向相关税局缴付。
TheLandlordshallberesponsibleforandpaydirectlytotherelevanttaxauthoritiesallapplicabletaxes(includingbutnotlimitedtoRealEstateTax,IncomeTaxandBusinessTax)andothergovernmentcharges(includingbutnotlimitedtoLandUseFee)requiredbyChineselaworanyrelevantregulationsarisingfromtheleasingofthePremises.
4.7在乙方遵守本协议条款及交付租金前提下,乙方有权于租赁期内拒绝甲方或其她人骚扰而平静享用出租房屋。
ProvidedthatPartyBpayingtherentalandperformingandobservingpartyB’stermsandconditionshereincontainshallpeaceablyholdandenjoythePremisesthroughoutthetermofthisContractwithoutanyinterruptionbyPartyAorotherpersons.
4.8租期为一年,如若任何一方提前解约,支付违约金为一年租金(人民币______元)。
LeasingTermisoneyear.Ifanysideterminatestheagreementahead
oftime,mustpaythepenaltyisoneyearrent(RMB78000.00yuan).
五、承租人责任
Tenant’sResponsibilities
5.1乙方应按时支付协议中要求确保金、租金及水、电、煤气、电话费,宽带费等公用事业费。
PartyBshouldpromptlypaythedeposit,rentalandwater,broadband,electricity,gas,telephonechargeetc.
5.2未经甲方书面同意,乙方不得将该物业转租或分租给第三方。
PartyBshallnottransferorsub-leasethesaidpremisestoanythirdpartywithoutPartyA’swrittenconsent.
5.3乙方应珍惜使用租赁房屋,如因乙方过失或过失致使房屋及设施受到损坏(正常损耗除外),乙方应负赔偿责任。
PartyBshalltreattheleasedpropertywithcare.If,asaresultof
PartyB’snegligenceormisconduct,theleasedpropertyandtherelatedfacilitiessufferanydamage(fairwearandtearexcepted),PartyBshallberesponsibleforcompensatingPartyAforsuchdamages.
5.4除在物业内已经有装饰和设施外,乙方如要增加设备或装修,须取得甲方同意,甲方不得无理拒绝或延误;
租赁期满必需恢复原状(正常损耗、磨损除外),并负担其费用,经甲方验收认可后归还甲方。
甲方同意期满前两个月通知乙方其所需拆除在物业内任何改变及改善设施。
Inadditiontothedecorationandequipmentalreadyintheproperty,ifPartyBwishestomakeanyalterationsorimprovementstotheproperty,PartyBmustgetPartyA’sconsent.Anysuchconsentshallnotbeunreasonablywithheldordelayed.Onexpiryofthetenancy,PartyBmusthandoverthepropertytoPartyAinitsoriginalcondition(fairwearandtearexcepted).AllfeesarisingfromsuchworktodosoaretobebornebyPartyB.PartyAagreestoprovidePartyBwithtwomonths’noticepriortotheexpiryofthecontract,intheeventPartyArequiresdemolitionofanyalterationorimprovementcarriedouttothepropertybyPartyB.
5.5若乙方、乙方雇员或任何其她经乙方许可人员进入该物业,对甲方或其她住户造成损失,不管有意或过失,乙方皆应对造成全部损失给予赔偿。
IncaseofPartyB,employeesofPartyBoranyotherpersonpermittedbyPartyBtoenterthepropertycausingdamagestoPartyAorothertenants,whetherintentionallyornegligently,PartyBshallcompensateforallthelossescausedbysuchdamages.
5.6乙方不得携带任何违禁危险物品进入该物业,严禁从事任何违反中国法律法规活动;
如所以发生损害,乙方应负担全部责任。
PartyBshallnotbringanythingdangerousorforbiddenintheleasedproperty,andnotbehaveagainstthelawsorregulationsofthePeople’sRepublicofChina,andshallbefullyresponsibleforanydamagesorlossesasaresultthereof.
5.7在本协议期满前一个月内,乙方应许可甲方或其指定代理人经与乙方预约后,在合理时间内陪同其她有爱好租住该楼宇人士参观
TheTenantshallpermittheLandlordoritsdesignatedagenttoenterthePremiseswithotherpotentialtenantstoseethePremises,atreasonabletimeanduponpriorappointmentwiththeTenantwithinonemonthbeforetheexpirationofthisContract.
5.8租期为一年,如若任何一方提前解约,支付违约金为一年租金(即人民币_______元)。
六、违约处理
BreachofContract
6.1甲、乙任何一方如未按本协议条款推行,组成违约,应负担对应违约责任,
双方同意违约方应赔偿受害方之直接损失(间接和结果性损失除外)。
甲方若有违约并在七日内未予补救,乙方则有权延付租金和管理费或做对应扣除。
IfeitherPartyAorPartyBfailstoperformitsobligationshereunder,itshallconstituteabreachofthisContractandthedefaultingpartyshallundertaketheliabilitiesforsuchbreach.Thepartiesagreethatthepartyinbreachshallpaytheotherpartythedirectlossesanddamage(excludingindirectandconsequentiallossanddamages).IfPartyAisinbreac
