Haveagreedasfollows:
ArticleI
ForthepurposeofthepresentConvention,thefollowingexpressionsshall
havethemeaningshereunderassignedtothem:
(a)the"
headofthemission"
isthepersonchargedbythesendingState
withthedutyofactinginthatcapacity;
(b)the"
membersofthemission"
aretheheadofthemissionandthe
membersofthestaffofthemission;
(c)the"
membersofthestaffofthemission"
arethemembersofthe
diplomaticstaff,oftheadministrativeandtechnicalstaffandof
theservicestaffofthemission;
(d)the"
membersofthediplomaticstaff"
arethemembersofthestaffof
themissionhavingdiplomaticrank;
(e)a"
diplomaticagent"
istheheadofthemissionoramemberofthe
diplomaticstaffofthemission;
(f)the"
membersoftheadministrativeandtechnicalstaff"
arethe
membersofthestaffofthemissionemployedintheadministrative
andtechnicalserviceofthemission;
(g)the"
membersoftheservicestaff"
themissioninthedomesticserviceofthemission;
(h)a"
privateservant"
isapersonwhoisinthedomesticserviceofa
memberofthemissionandwhoisnotanemployeeofthesending
State;
(i)the"
premisesofthemission"
arethebuildingsorpartsofbuildings
andthelandancillarythereto,irrespectiveofownership,usedfor
thepurposesofthemissionincludingtheresidenceoftheheadof
themission.
Article2
TheestablishmentofdiplomaticrelationsbetweenStates,andofpermanent
diplomaticmissions,takesplacebymutualconsent.
Article3
1.Thefunctionsofadiplomaticmissionconsistinteraliain:
(a)representingthesendingStateinthereceivingState;
(b)protectinginthereceivingStatetheinterestsofthesendingState
andofitsnationals,withinthelimitspermittedbyinternational
law;
(c)negotiatingwiththeGovernmentofthereceivingState;
(d)ascertainingbyalllawfulmeansconditionsanddevelopmentsinthe
receivingState,andreportingthereontotheGovernmentofthe
sendingState;
(e)promotingfriendlyrelationsbetweenthesendingStateandthe
receivingState,anddevelopingtheireconomic,culturaland
scientificrelations.
2.NothinginthepresentConventionshallbeconstruedaspreventingthe
performanceofconsularfunctionsbyadiplomaticmission.
Article4
1.ThesendingStatemustmakecertainthattheagr俶entofthereceiving
Statehasbeengivenforthepersonitproposestoaccreditasheadofthe
missiontothatState.
2.ThereceivingStateisnotobligedtogivereasonstothesendingState
forarefusalofagr俶ent.
Article5
1.ThesendingStatemay,afterithasgivenduenotificationtothe
receivingStatesconcerned,accreditaheadofmissionorassignanymember
ofthediplomaticstaff,asthecasemaybe,tomorethanoneState,unless
thereisexpressobjectionbyanyofthereceivingStates.
2.IfthesendingStateaccreditsaheadofmissiontooneormoreother
Statesitmayestablishadiplomaticmissionheadedbyacharged'
affaires
adinterimineachStatewheretheheadofmissionhasnothispermanent
seat.
3.Aheadofmissionoranymemberofthediplomaticstaffofthemission
mayactasrepresentativeofthesendingStatetoanyinternational
organization.
Article6
TwoormoreStatesmayaccreditthesamepersonasheadofmissionto
anotherState,unlessobjectionisofferedbythereceivingState.
Article7
SubjecttotheprovisionsofArticles5,8,9and11,thesendingStatemay
freelyappointthemembersofthestaffofthemission.Inthecaseof
military,navalorairattaches,thereceivingStatemayrequiretheir
namestobesubmittedbeforehand,foritsapproval.
Article8
1.Membersofthediplomaticstaffofthemissionshouldinprinciplebeof
thenationalityofthesendingState.
2.Membersofthediplomaticstaffofthemissionmaynotbeappointedfrom
amongpersonshavingthenationalityofthereceivingState,exceptwith
theconsentofthatStatewhichmaybewithdrawnatanytime.
3.ThereceivingStatemayreservethesamerightwithregardtonationals
ofathirdStatewhoarenotalsonationalsofthesendingState.
Article9
1.ThereceivingStatemayatanytimeandwithouthavingtoexplainits
decision,notifythesendingStatethattheheadofthemissionorany
memberofthediplomaticstaffofthemissionispersonanongrataorthat
anyothermemberofthestaffofthemissionisnotacceptable.Inanysuch
case,thesendingStateshall,asappropriate,eitherrecalltheperson
concernedorterminatehisfunctionswiththemission.Apersonmaybe
declarednongrataornotacceptablebeforearrivingintheterritoryof
thereceivingState.
2.IfthesendingStaterefusesorfailswithinareasonableperiodto
carryoutitsobligationsunderparagraph1ofthisArticle,thereceiving
Statemayrefusetorecognizethepersonconcernedasamemberofthe
mission.
Article10
1.TheMinistryforForeignAffairsofthereceivingState,orsuchother
ministryasmaybeagreed,shallbenotifiedof:
(a)theappointmentofmembersofthemission,theirarrivalandtheir
finaldepartureortheterminationoftheirfunctionswiththe
mission;
(b)thearrivalandfinaldepartureofapersonbelongingtothefamily
ofamemberofthemissionand,whereappropriate,thefactthata
personbecomesorceasestobeamemberofthefamilyofamemberof
themission;
(c)thearrivalandfinaldepartureofprivateservantsintheemployof
personsreferredtoinsub-paragraph(a)ofthisparagraphand,where
appropriate,thefactthattheyareleavingtheemployofsuch
persons;
(d)theengagementanddischargeofpersonsresidentinthereceiving
Stateasmembersofthemissionorprivateservantsentitledto
privilegesandimmunities.
2.Wherepossible,priornotificationofarrivalandfinaldepartureshall
alsobegiven.
Article11
1.Intheabsenceofspecificagreementastothesizeofthemission,the
receivingStatemayrequirethatthesizeofamissionbekeptwithin
limitsconsideredbyittobereasonableandnormal,havingregardto
circumstancesandconditionsinthereceivingStateandtotheneedsofthe
particularmission.
2.ThereceivingStatemayequally,withinsimilarboundsandona
nondiscriminatorybasis,refusetoacceptofficialsofaparticular
category.
Article12
ThesendingStatemaynot,withoutthepriorexpressconsentofthe
receivingState,establishofficesformingpartofthemissionin
localitiesotherthanthoseinwhichthemissionitselfisestablished.
Article13
1.Theheadofthemissionisconsideredashavingtakenuphisfunctions
inthereceivingStateeitherwhenhehaspresentedhiscredentialsorwhen
hehasnotifiedhisarrivalandatruecopyofhiscredentialshasbeen
presentedtotheMinistryforForeignAffairsofthereceivingState,or
suchotherministryasmaybeagreed,inaccordancewiththepractice
prevailinginthereceivingStatewhichshallbeappliedinauniform
manner.
2.Theorderofpresentationofcredentialsorofatruecopythereofwill
bedeterminedbythedateandtimeofthearrivaloftheheadofthe
Article14
1.Headsofmissionaredividedintothreeclasses,namely:
(a)thatofambassadorsornunciosaccreditedtoHeadsofState,and
otherheadsofmissionofequivalentrank;
(b)thatofenvoys,ministersandinternunciosaccreditedtoHeadsof
(c)thatofchargesd'
affairesaccreditedtoMinistersforForeignAffairs.
2.Exceptasconcernsprecedenceandetiquette,thereshallbeno
differentiationbetweenheadsofmissionbyreasonoftheirclass.
Article15
TheclasstowhichtheheadsoftheirmissionsaretobeassignedshallbeagreedbetweenStates.
Article16
1.Headsofmissionshalltakeprecedenceintheirrespectiveclassesin
theorderofthedateandtimeoftakinguptheirfunctionsinaccordance
withArticle13.
2.Alterationsinthecredentialsofaheadofmissionnotinvolvingany
changeofclassshallnotaffecthisprecedence.
3.Thisarticleiswithoutprejudicetoanypracticeacceptedbythe
receivingStateregardingtheprecedenceoftherepresentativeoftheHoly
See.
Article17
Theprecedenceofthemembersofthediplomaticstaffofthemissionshall
benotifiedbytheheadofthemissiontotheMinistryforForeignAffairs
orsuchotherministryasmaybeagreed.
Article18
TheproceduretobeobservedineachStateforthereceptionofheadsof
missionshallbeuniforminrespectofeachclass.

1.Ifthepostofheadofthemission
