Article1ThisLawisformulatedtoimprovethelaborcontractsystem,specifytherightsandobligationsofbothpartiestolaborcontracts,protectthelawfulrightsandinterestsoflaborersandestablishanddevelopastableandharmoniouslaborrelationship.
Article2ThisLawshallapplytotheconclusion,performance,change,dissolutionorterminationoflaborcontractsthroughtheestablishmentoflaborrelationshipsbetweeninstitutionssuchasenterprises,individually-ownedeconomicorganizationsandprivatenon-enterpriseworkunitswithintheterritoryofthePeople'
sRepublicofChina(hereinafterreferredtoas"
employingunits"
)andlaborers.
Theconclusion,performance,change,dissolutionorterminationoflaborcontractsbystateauthorities,institutions,socialorganizationsandlaborerswithwhichtheyhavealaborrelationshipshallrefertothisLaw.
Article3Theconclusionoflaborcontractsshallcomplywiththeprinciplesoflawfulness,fairness,equalityandwillingness,consensusconsultationandfaithfulnessandcreditworthiness.
Laborcontractsthatarelawfullyconcludedshallbelegalbinding.Employingunitsandlaborersshallperformtheobligationsagreedinlaborcontracts.
Article4Anemployingunitshalllawfullyestablishandimproverulesandsystems,protectthelaborrightsenjoyedbylaborersandperformlaborobligations.
Whereanemployingunitformulates,amendsordecidesonrulesandsystemsthataredirectlyrelatedtothepersonalbenefitsoflaborersorimportantmatterssuchaslaborrulesandsystems,workinghours,restdays,laborsafetyandhealth,insurancebenefits,employeetraining,labordisciplineandlaborquotaadministration,itshallholdadiscussionwithemployees'
assemblyorallemployees,submitproposalsandgivesuggestionsanddeterminetheissuefollowingfairconsultationwithlaborunionsoremployees'
representatives.
Intheprocessofdecision-makingandimplementationofrulesandsystemsandimportantmatters,wherealaborunionsoremployeedeemsitimproper,itshallhavetherighttoraisetheissuetoemployingunitsandamendmentsandimprovementsshallbemadethroughconsultation.
Theemployingunitshallpubliclyannouncetherulesandsystemsthataredirectlyrelatedtothepersonalbenefitsoflaborersorthedecisionsonimportantmatters,orinformthelaborersofsuchrulesandsystemsanddecisions.
Article5Thelaboradministrativedepartmentofthepeople'
sgovernmentatthecountyleveloraboveandlaborunionsandrepresentativesofenterprisesshallestablishasoundthree-partymechanismforcoordinatinglaborrelationshipsandjointlystudyandsolveimportantissuesrelevanttolaborrelationships.
Article6Alaborunionshallassistandguidelaborerstolawfullyconcludeandperformlaborcontractswithemployingunitsandestablishacollectiveconsultationmechanismwithemployingunits,andprotectthelawfulrightsandinterestsoflaborers.
Article7Anemployingunithasestablishedlaborrelationshipswithlaborersfromthedateofuseoflaborservices.Theemployingunitshallestablisharegisterofemployeesforinspection.
Article8Whereanemployingunitemployslaborers,itshalltrulyinformthelaborersofthejobspecifications,workingconditions,placeofwork,occupationalhazards,safeproductionstatusandlaborremuneration,andothercircumstancesrequestedtobeinformedbythelaborers.Theemployingunitshallhavetherighttounderstandthebasiccircumstancesdirectlyrelatedtothelaborersandlaborcontracts,andthelaborersshallgiveatrueexplanation.
Article9Whereanemployingunitemployslaborers,itmaynotdetaintheresidentidentitycardandotherdocumentsoflaborers,norrequestthelaborerstoprovideguaranteeorcollectpropertyfromlaborersinothernames.
Article10Writtenlaborcontractsshallbeconcludedtoestablishlaborrelationships.
Wherelaborrelationshiphasbeenestablishedbutnowrittenlaborcontractwasconcludedatthesametime,thewrittenlaborcontractshallbeconcludedwithinonemonthofthedateofuseoflaborservices.
Wheretheemployingunitandlaborersconcludelaborcontractsbeforetheuseoflaborservices,thelaborrelationshipsshallbeestablishedfromthedateofuseoflaborservices.
Article11Whereanemployingunithasnotestablishedawrittenlaborcontractatthesametimeastheuseoflaborservices,andthelaborremunerationhasnotbeenspecifiedwiththelaborers,thelaborremunerationoflaborersnewlyemployedshallbesubjecttothestandardoftheprovisionsofcollectivecontracts.Wherethereisnocollectivecontractorthereisnoprovisioninthecollectivecontract,equalremunerationforthesameworkshallbepaid.
Article12Laborcontractsaredividedintolaborcontractswithfixedterms,laborcontractswithunfixedtermsandlaborcontractswherethetermofserviceequalstotheperiodofcompletionofacertaintask.
Article13Laborcontractswithfixedtermsshallrefertolaborcontractstheterminationdateofwhichisagreedbetweenemployingunitsandlaborers.
Whereemployingunitsandlaborershavereachedaconsensusafterconsultation,theymayconcludelaborcontractswithfixedterms.
Article14Laborcontractswithunfixedtermsshallrefertolaborcontractstheterminationdateofwhichisnotagreedbetweenemployingunitsandlaborers.
Whereanemployingunitandalaborerhavereachedaconsensusafterconsultation,theymayconcludealaborcontractwithunfixedterms.Inanyofthefollowingcircumstanceswherethelaborerrequestsoragreestoreneworconcludelaborcontracts,thelaborcontractwithunfixedtermsshallbeconcludedunlesslaborersrequesttheconclusionofalaborcontractwithfixedterms:
(1)Thelaborerhasbeenworkingwiththeemployingunitfor10consecutiveyears;
(2)Wheretheemployingunitimplementsthelaborcontractsystemforthefirsttimeorlaborcontractsarere-concludedduetorestructuringofstate-ownedenterprises,thelaborerhasbeenworkingwiththeemployingunitfor10consecutiveyearsandthereislessthan10yearsbeforethestatutoryretirementage;
or
(3)WherealaborcontractwithfixedtermshasbeenconcludedfortwoconsecutivetimesandnolaborcontractisrenewedforlaborersthatdonotfallwithinthecircumstancesspecifiedinItems
(1)and
(2)ofArticles39and40hereof.
Wheretheemployingunitfailstoconcludeawrittenlaborcontractwiththelaborerfromoneyearoftheuseoflaborservices,thelaborcontractwithunfixedtermsshallbedeemedtohavebeenestablishedbetweentheemployingunitandthelaborer.
Article15Laborcontractswherethetermofserviceequalstotheperiodofcompletionofacertaintaskshallrefertolaborcontractswherethetermofserviceisagreedbyanemployingunitandalaborertobetheperiodofcompletionofacertaintask.
Wheretheemployingunitandthelaborerhavereachedaconsensusafterconsultation,theymayconcludealaborcontractwherethetermofserviceequalstotheperiodofcompletionofacertaintask.
Article16Anemployingunitandalaborershallreachaconsensusafterconsultationonthelaborcontractwhichshallbeeffectiveaftersigningandfixingasealonthetextofthelaborcontractbytheemployingunitandthelaborer.
Theemployingunitandthelaborershalleachkeepacopyofthetextofthelaborcontract.
Article17Alaborcontractshallcontainthefollowingtermsandconditions:
(1)Thename,domicileandthelegalrepresentativeorthemajorresponsiblepersonoftheemployingunit;
(2)Thename,domicileandthenumberofresidentidentitycardorofothervalididentitydocumentofthelaborer;
(3)Thetermofthelaborcontract;
(4)Thejobspecificationsandtheplaceofwork;
(5)Theworkinghoursandrestdays;
(6)Laborremuneration;
(7)Socialinsurance;
(8)Laborprotection,laborconditionsandprotectionagainstoccupationalhazards;
and
(9)Othermattersthatshallbeincludedinthelaborcontractasrequiredbylawsandregulations.
Inadditiontotheessentialprovisionsofthelaborcontractprovidedintheprecedingparagraph,theemployingunitandthelaborermayagreeonothermatterssuchastheprobationaryperiod,training,maintenanceofconfidentiality,supplementaryinsuranceandfringebenefits.
Article18Wherethelaborremunerationandlaborconditionsarenotspecifiedinthelaborcontractandadisputearises,theemployingunitandthelaborermayho
