EXECUTIVESUMMARY
Introduction
TheExtractiveIndustriesTransparencyInitiative(EITI)aimstoimprovedevelopmentoutcomes
frombenefitspaidtogovernmentsbytheextractiveindustries.
Additionally,theinitiativeseekstoreducethepotentialforcorruptionandlargescaleembezzlement
ofthesebenefits.
Theaboveobjectivesaretobeachievedbyenhancingtransparencyinthepayments,receipts,disbursementsandutilizationofminingbenefits.
TothisendanIndependentAggregator(MessrsBoasandAssociates)wasappointedbytheMinistryofFinanceandEconomicPlanning,tocollect,analyzeandaggregatepaymentsmadebyminingcompaniestotheGovernmentofGhana.
Approach
Theassignmenthasbeendividedintothree(3)phases.Thesearei)Inception
ii)Aggregationiii)DevelopmentofframeworkorGuidelinesforensuringtransparencyinthebenefitsreceivedbythegovernment.
Whilstthefirsttwophasesinvolvedefinitiveactivities,thefinalphase(developmentofframework)isbasedonfeedbackoftheobservations,findingsandexperiencesgatheredinthefirsttwostages.
ThisreportcoversactivitiesundertakenduringtheInceptionphase
Inceptionphase
Thisisthepreliminaryinformationgatheringstage.TheAggregatorinteractedwithMiningcompanies,GovernmentRevenueAgencies,DistrictAssembliesandTraditionalAuthorities.Ingeneraltheresponsefromallstakeholdershasbeenencouraging.
Themainobjectivesforthesemeetingswere:
∙Tointeractwiththevariousstakeholderstogainabetterunderstandingoftheir
operations
∙Conductasituationalanalysistohelpputtheassignmentinthebestperspective.
∙CollectdataonpaymentsmadebytheMiningCompanies,andthebenefitsreceivedbytheGovernmentthroughtheRevenueAgenciesanddisbursementsmadetothecommunitieswithintheoperationalareasofthemines.
KeyobservationsmadeduringtheinceptionphasewouldbeinvestigatedduringtheAggregationphase.
Theseobservationshavebeencategorizedunderthefourmaincomponentsoftheassignment(Payments;
Receipts;
DisbursementsandUtilization)asfollows;
Payment
i)Almostalltheminingcompaniesvisitedhadchangedownershipwithinthelast10years
ii)Itappearstherehasnotbeenanypaymentofcapitalgainstaxduringthechangesinownership.
iii)Lackofuniformityinpricingminerals(gold)producedleadingtovariationsinthecomputationof
royaltypayment.
iv)Applicationbytheminingcompaniesofdifferentexchangerateregimesforthepaymentofmineral
royalties.
v)Allminingcompaniespayroyaltiesusingtheminimumapplicablerateof3%.
vi)Itappearsdividendwithholdingtaxesarenotpaidbytheminingcompanies.
Receipts
i)ApparentlackofformalizedcontactsbetweentheInternalRevenueService
(IRS),andotherminingsectoragenciesforthereconciliationoffiguresrelatedtoroyalties
ii)Separatebankaccountsarenotkeptforroyaltyreceipts.
Disbursement
i)LackofdocumentationonpaymentsmadebytheOfficeoftheAdministratorof
StoolLandstotheDistrictAssemblies,TraditionalCouncilsandStools.
ii)Reporteddelaysinthepaymentofmineralroyaltiestobeneficiaryinstitutions.
Utilisation
Lackofguidelinesfortheapplicationofpaymentsreceivedbybeneficiaryinstitutions
(DistrictAssemblies,TraditionalCouncilsandStools).
Aggregationphase
Thenextphase,whichistheaggregationphasewillinvolve,thecollection,collationandanalysisofdata

Conclusion
TheknowledgeandunderstandinggainedattheinceptionphasewouldserveastheplatformfortheAggregationPhaseoftheassignment.TheAggregationphasewillincludethecollectionandanalysisofdataonminingbenefits,theaggregationofthebenefitsandcompletionofrequisitetemplates.
Therewouldbecontinuousstudiesontheframeworkforenhancingtransparencyinpayments,receipts,disbursementsandutilizationofminingbenefits.
1.0INTRODUCTION
TheGovernmentofGhanathroughtheMinistryofFinanceandEconomicPlanning(MOFEP)hasassociateditselfwiththeExtractiveIndustriesTransparencyInitiative(EITI)whichwaslaunchedattheWorldSummitonSustainableDevelopmentinJohannesburg.
ToimplementtheEITIinGhanatheMinistryofFinanceandEconomicPlanninghasappointedMessrsBoas&
Associates,aCharteredAccountingandMiningConsultingfirmastheIndependentAggregator.
TheIndependentAggregatoristaskedtocollect,analyseandaggregatepaymentsmadebyminingcompaniestotheGovernmentofGhanaandtoascertainthedisbursementsmadebytheGovernmenttotherelevantminingcommunitiesanditsutilization.
2.0BACKGROUND.
2.1BriefabouttheMiningIndustryinGhana.
UndertheMineralsandMiningAct,2006,Act703,everymineralinitsnaturalstatein,underoruponanylandinGhana,rivers,streams,watercoursesthroughoutthecountry,theexclusiveeconomiczoneandanyareacoveredbyterritorialseaorcontinentalshelfisthepropertyoftheRepublicofGhanaandisvestedinthePresidentintrustforthepeopleofGhana.
TheMiningindustryinGhanamakesasubstantialcontributiontotheeconomy.ThemineralsSectoraccountsforabout11%offiscalreceiptsbytheInternalRevenueService(IRS).
Goldminingremainsthehighestcontributorinthesector,withlargescalegoldminingaccountingforover80%byvalueofthetotalincomefromthesector.Theotherimportantmineralsare,diamond,bauxite,manganeseandSilver.(SeeTable1)

2.2BriefabouttheExtractiveIndustriesTransparencyInitiative(EITI)
TheExtractiveIndustriesTransparencyInitiative(EITI)waslaunchedbytheBritishPrimeMinister,TonyBlairattheWorldsummitonsustainableDevelopmentinJohannesburg,inSeptember2002.
2.2.1Objectives
ThemainobjectiveoftheExtractiveIndustryTransparencyInitiative(EITI)istoenhancetransparencyaroundthegenerationandspendingofrevenuesfromtheextractivesectorsoastoimprovedevelopmentoutcomes,reducethepotentialforcorruptionorlargescaleembezzlementoffundsbyhosts’governments,andtostimulatedebateabouttheusestowhichtheserevenuesareput.
TheInitiativeencouragesgovernments,extractivecompanies(publiclyandprivatelyowned),InternationalAgenciesandNGOstoworktogethertodevelopaframeworktopromotetransparencyinpaymentsintheextractiveindustries.
2.3EITIINGHANA
TheGovernmentofGhanacommitteditselftoparticipateintheExtractiveIndustriesTransparencyInitiative(EITI)attheInternationalConferenceinLondononJune17th2003.
Asteeringcommittee(EITIsteeringcommittee)hasbeensetup,whichisundertheleadershipoftheDeputyMinisterofStateforFinanceandEconomicPlanningandassistedbytheDeputyMinisterof
