THEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,
HavingregardtotheTreatyestablishingtheEuropeanCommunity,andinparticularArticle175
(1)thereof,
HavingregardtotheproposalfromtheCommission
(1),
HavingregardtotheOpinionoftheEconomicandSocialCommittee
(2),
HavingregardtotheOpinionoftheCommitteeofRegions(3),
ActinginaccordancewiththeprocedurelaiddowninArticle251oftheTreatyinthelightofthejointtextapprovedbytheConciliationCommitteeon8November2002(4),
Whereas:
(1)TheobjectivesoftheCommunity'
senvironmentpolicyare,inparticular,topreserve,protectandimprovethequalityoftheenvironment,protecthumanhealthandutilisenaturalresourcesprudentlyandrationally.Thatpolicyisbasedontheprecautionaryprincipleandprinciplesthatpreventiveactionshouldbetaken,thatenvironmentaldamageshouldasapriorityberectifiedatsourceandthatthepollutershouldpay.
(2)TheCommunityprogrammeofpolicyandactioninrelationtotheenvironmentandsustainabledevelopment(FifthEnvironmentalActionProgramme)(5)statesthattheachievementofsustainabledevelopmentcallsforsignificantchangesincurrentpatternsofdevelopment,production,consumptionandbehaviourandadvocates,interalia,thereductionofwastefulconsumptionofnaturalresourcesandthepreventionofpollution.Itmentionswasteelectricalandelectronicequipment(WEEE)asoneofthetargetareastoberegulated,inviewoftheapplicationoftheprinciplesofprevention,recoveryandsafedisposalofwaste.
(3)TheCommissionCommunicationof30July1996onreviewoftheCommunitystrategyforwastemanagementstatesthat,wherethegenerationofwastecannotbeavoided,itshouldbereusedorrecoveredforitsmaterialorenergy.
(4)TheCouncilinitsResolutionof24February1997onaCommunitystrategyforwastemanagement(6)insistedontheneedforpromotingwasterecoverywithaviewtoreducingthequantityofwastefordisposalandsavingnaturalresources,inparticularbyreuse,recycling,compostingandrecoveringenergyfromwasteandrecognisedthatthechoiceofoptionsinanyparticularcasemusthaveregardtoenvironmentalandeconomiceffectsbutthatuntilscientificandtechnologicalprogressismadeandlife-cycleanalysesarefurtherdeveloped,reuseandmaterialrecoveryshouldbeconsideredpreferablewhereandinsofarastheyarethebestenvironmentaloptions.TheCouncilalsoinvitedtheCommissiontodevelop,assoonaspossible,anappropriatefollow-uptotheprojectsoftheprioritywastestreamsprogramme,includingWEEE.
(5)TheEuropeanParliament,initsResolutionof14November1996(7),askedtheCommissiontopresentproposalsforDirectivesonanumberofprioritywastestreams,includingelectricalandelectronicwaste,andtobasesuchproposalsontheprincipleofproducerresponsibility.TheEuropeanParliament,inthesameResolution,requeststheCouncilandtheCommissiontoputforwardproposalsforcuttingthevolumeofwaste.
(6)CouncilDirective75/442/EECof15July1975onwaste(8)providesthatspecificrulesforparticularinstancesorsupplementingthoseofDirective75/442/EEConthemanagementofparticularcategoriesofwastemaybelaiddownbymeansofindividualDirectives.
(7)TheamountofWEEEgeneratedintheCommunityisgrowingrapidly.Thecontentofhazardouscomponentsinelectricalandelectronicequipment(EEE)isamajorconcernduringthewastemanagementphaseandrecyclingofWEEEisnotundertakentoasufficientextent.
(8)TheobjectiveofimprovingthemanagementofWEEEcannotbeachievedeffectivelybyMemberStatesactingindividually.Inparticular,differentnationalapplicationsoftheproducerresponsibilityprinciplemayleadtosubstantialdisparitiesinthefinancialburdenoneconomicoperators.HavingdifferentnationalpoliciesonthemanagementofWEEEhamperstheeffectivenessofrecyclingpolicies.ForthatreasontheessentialcriteriashouldbelaiddownatCommunitylevel.
(9)TheprovisionsofthisDirectiveshouldapplytoproductsandproducersirrespectiveofthesellingtechnique,includingdistanceandelectronicselling.Inthisconnectiontheobligationsofproducersanddistributorsusingdistanceandelectronicsellingchannelsshould,asfarasispracticable,takethesameformandshouldbeenforcedinthesamewayinordertoavoidotherdistributionchannelshavingtobearthecostsoftheprovisionsofthisDirectiveconcerningWEEEforwhichtheequipmentwassoldbydistantorelectronicselling.
(10)ThisDirectiveshouldcoverallelectricalandelectronicequipmentusedbyconsumersandelectricalandelectronicequipmentintendedforprofessionaluse.ThisDirectiveshouldapplywithoutprejudicetoCommunitylegislationonsafetyandhealthrequirementsprotectingallactorsincontactwithWEEEaswellasspecificCommunitywastemanagementlegislation,inparticularCouncilDirective91/157/EECof18March1991onbatteriesandaccumulatorscontainingcertaindangeroussubstances(9).
(11)Directive91/157/EECneedstoberevisedassoonaspossible,particularlyinthelightofthisDirective.
(12)Theestablishment,bythisDirective,ofproducerresponsibilityisoneofthemeansofencouragingthedesignandproductionofelectricalandelectronicequipmentwhichtakeintofullaccountandfacilitatetheirrepair,possibleupgrading,reuse,disassemblyandrecycling.
(13)Inordertoguaranteethesafetyandhealthofdistributors'
personnelinvolvedinthetake-backandhandlingofWEEE,MemberStatesshould,inaccordancewithnationalandCommunitylegislationonsafetyandhealthrequirements,determinetheconditionsunderwhichtake-backmayberefusedbydistributors.
(14)MemberStatesshouldencouragethedesignandproductionofelectricalandelectronicequipmentwhichtakeintoaccountandfacilitatedismantlingandrecovery,inparticularthere-useandrecyclingofWEEE,theircomponentsandmaterials.Producersshouldnotprevent,throughspecificdesignfeaturesormanufacturingprocesses,WEEEfrombeingreused,unlesssuchspecificdesignfeaturesormanufacturingprocessespresentoverridingadvantages,forexamplewithregardtotheprotectionoftheenvironmentand/orsafetyrequirements.
(15)SeparatecollectionisthepreconditiontoensurespecifictreatmentandrecyclingofWEEEandisnecessarytoachievethechosenlevelofprotectionofhumanhealthandtheenvironmentintheCommunity.ConsumershavetoactivelycontributetothesuccessofsuchcollectionandshouldbeencouragedtoreturnWEEE.Forthispurpose,convenientfacilitiesshouldbesetupforthereturnofWEEE,includingpubliccollectionpoints,whereprivatehouseholdsshouldbeabletoreturntheirwasteatleastfreeofcharge.
(16)InordertoattainthechosenlevelofprotectionandharmonisedenvironmentalobjectivesoftheCommunity,MemberStatesshouldadoptappropriatemeasurestominimisethedisposalofWEEEasunsortedmunicipalwasteandtoachieveahighlevelofseparatecollectionofWEEE.InordertoensurethatMemberStatesstrivetosetupefficientcollectionschemes,theyshouldberequiredtoachieveahighlevelofcollectionofWEEEfromprivatehouseholds.
(17)SpecifictreatmentforWEEEisindispensableinordertoavoidthedispersionofpollutantsintotherecycledmaterialorthewastestream.SuchtreatmentisthemosteffectivemeansofensuringcompliancewiththechosenlevelofprotectionoftheenvironmentoftheCommunity.AnyestablishmentorundertakingscarryingoutrecyclingandtreatmentoperationsshouldcomplywithminimumstandardstopreventnegativeenvironmentalimpactsassociatedwiththetreatmentofWEEE.Bestavailabletreatment,recoveryandrecyclingtechniquesshouldbeusedprovidedthattheyensurehumanhealthandhighenvironmentalprotection.Bestavailabletreatment,recoveryandrecyclingtechniquesmaybefurtherdefinedinaccordancewiththeproceduresofDirective96/61/EC.
(18)Whereappropriate,priorityshouldbegiventothereuseofWEEEanditscomponents,subassembliesandconsumables.Wherereuseisnotpreferable,allWEEEcollectedseparatelyshouldbesentforrecovery,inthecourseofwhichahighlevelofrecyclingandrecoveryshouldbeachieved.Inaddition,producersshouldbeencouragedtointegraterecycledmaterialinnewequipment.
(19)BasicprincipleswithregardtothefinancingofWEEEmanagementhavetobesetatCommunitylevelandfinancingschemeshavetocontributetohighcollectionratesaswellastotheimplementationoftheprincipleofproducerresponsibility.
(20)UsersofelectricalandelectronicequipmentfromprivatehouseholdsshouldhavethepossibilityofreturningWEEEatleastfreeofcharge.Producersshouldthereforefinancecollectionfromcollectionfacilities,andthetreatment,recoveryanddisposalofWEEE.Inordertogivemaximumeffecttotheconceptofproducerresponsibility,eachproducershouldberesponsibleforfinancingthemanagementofthewastefromhisownproducts.Theproducershouldbeabletochoosetofulfilthisobligationeitherindividuallyorbyjoiningacollectivescheme.Eachproducershould,whenplacingaproductonthemarket,provideafinancialguaranteetopreventcostsforthemanagementofWEEEfromorphanproductsfromfallingonsocietyortheremainingproducers.Theresponsibilityforthefinancingofthemanagementofhistoricalwasteshouldbesharedbyallexistingproducersincollectivefinancingschemestowhichallproducers,existingonthemarketwhent
