Federal（Davis-Bacon）wagerequirementsaremadeapplicabletotheHOMEprogrambySection286oftheNationalAffordableHousingActof1990whichprovides,inpartasfollows:

Anycontractfortheconstructionofaffordablehousingwith12ormoreunitsassistedwithfundsmadeavailableunderthissubtitleshallcontainaprovisionrequiringthatnotlessthanwagesprevailinginthelocality,asdeterminedbytheSecretaryofLaborpursuanttotheDavis-BaconAct…,shallbepaidtoalllaborersandmechanicsemployedinthedevelopmentofaffordablehousinginvolved,…

HUDregulations（24CFR92.354）paraphrasethestatutoryprovisionandclarifythatthecontractforconstructionmustcontainthesewageprovisionsifHOMEfundsareusedforanyprojectcosts,includingconstructionornon-constructioncosts,forhousingwith12ormoreHOME-assistedunits.

Theregulationsfurtherexplainthataconstructioncontractthatincludesatotalof12ormoreHOME-assistedunitsiscoveredbyDavis-BaconrequirementsevenifthecontractcoversmorethanoneHOME“project”andprohibitsarrangingmultipleconstructioncontractswithinasingleprojectforthepurposeofavoidingDavis-Baconcoverage.Oncetriggered,thewageprovisionsapplytotheconstructionoftheentireproject–HOME-assistedandnon-assistedportions,alike.

TheDavis-Bacon“trigger”relatestothenumberofHOME-assistedunitscontainedinaconstructioncontract.Itisimportanttorecognizethatthetwofactorsare:

Everyconstruction（rehabilitationornew）contractwith12ormoreHOME-assistedunitsisrequiredtocomplywiththefollowingfederallaborstandards（notethatconstructionprojectswithlessthat12HOME-assistedunitsarestillsubjecttotheFairLaborStandardsAct:

Davis-BaconAct（40U.S.C.276（A）-（A）-5）

EnsuresthatmechanicsandlaborersemployedinconstructionworkunderFederallyassistedcontractsarepaidwagesandfringebenefitsequaltothosethatprevailinthelocalitywheretheworkisperformed.

ContractWorkHoursandSafetyStandardsAct（40U.S.C.327-333）

ProvidesthatmechanicsandlaborersemployedonFederallyassistedconstructionjobsarepaidtimeandone-halfforworkinexcessof40hoursperweek,andprovidesforliquidateddamageswhereviolationsoccur.Thisactalsoaddressessafeandhealthyworkingconditions.

CopelandAct（Anti-KickbackAct）（40U.S.C.276c）

TheCopelandActmakesitacriminaloffenseforanypersontoinduce,byanymannerwhatsoever,anypersonemployedintheconstruction,prosecution,completion,orrepairofanypublicbuilding,publicwork,orbuildingorworkfinancedinwholeorinpartbyloansorgrantsfromtheUnitedStates,togiveupanypartofthecompensationtowhichheisentitledunderhiscontractofemployment.

FairLaborStandardsActof1938,asAmended,（29U.S.C.102,et.seq.）

ThisActprovidesforminimumwagesforconstructionworkers,overtimepay（forty-hourweek）,recordkeepingandchildlaborstandards.

Granteesmustdevelopacomplianceandenforcementprogramthatensuresallapplicablelaborstandardsrequirementsaremet.Inmanyinstancesthegrantee,thegrantadministrator,andtheengineermayworktogethertoensurecompliancewithDavis-BaconandRelatedActs.

Thegranteemustdesignatesomeoneasthelaborstandardscomplianceofficerwiththeoverallresponsibilitytocoordinateandensurecompliancewithallappropriatelaborstandardsregulationsandmaintenanceofanaccuratefilingsystem.Thefinalresponsibilityforcompliancerestswiththegrantee.

Thegranteemustsecureapplicablewageratedecisions,includeallapplicablewagerateandlaborstandardsprovisionsinthebidspecificationsandcontractdocuments,andmonitorcontractorcompliance.MajoractivitiesaresummarizedinTasks3through6inthemosttypicalsequenceofoccurrence.
