道路交通安全法实施条例（英文版）

OrderoftheStateCouncilofthePeople'sRepublicofChina

TheRegulationontheImplementationoftheLawofthePeople'sRepublicofChinaonRoadTrafficSafetywasadoptedonApril28,2004atthe49thexecutivemeetingoftheStateCouncil.ItisherebypromulgatedandshallbeimplementedasofMay1,2004.

ChapterI.GeneralProvisions

Article1ThepresentRegulationisformulatedinaccordancewiththeLawofthePeople'sRepublicofChinaonRoadTrafficSafety（hereinafterreferredtoastheLRTS）.

Article2Allvehicledrivers,pedestrians,passengers,roadtrafficactivity-relatedentitiesandindividualswithintheterritoryofthePeople'sRepublicofChinashallabidebythepresentLaw.

Article3Thelocalpeople'sgovernmentsatthecountylevel or aboveshallestablishandperfecttheroadsafetycoordinationmechanism,organizetherelevantdepartmentstoevaluatetheimpactofurbanconstructionprojectsonthetraffic,formulateanadministrativeplanningonroadtrafficsafety,determineanadministrativetargetandmakeanimplementationplan.

ChapterIIVehiclesandDrivers

Section1MotorVehicles

Article4Theregistrationsofmotorvehiclesshallbeclassifiedintoinitialregistration,modificationregistration,transferregistration,mortgageregistrationandcancellationregistration.

Article5Whenapplyingfortheinitialmotorvehicleplate or drivingpermit,anapplicantshallfileanapplicationtothetrafficadministrativedepartmentofthepublicsecurityorganwherethedomicileoftheownerofthemotorvehicleislocated.Whenapplyingfortheinitialmotorvehicleregistration,anapplicantshallhavethemotorvehiclecheckedandshallsubmitthefollowingcertificatesandvouchers:

（1）Theidentificationproofoftheownerofthemotorvehicle;

（2）Thepurchaseinvoiceandotherproofsoftheprovenanceofthemotorvehicle;

（3）Theconformitycertificateissuedwhenthewholemotorvehicleleavesthefactory or theimportdocumentationoftheimportedmotorvehicle;

（4）Theproofofpaymentofvehiclepurchasetax or tax-exemptiondocumentation;

（5）Theproofofmandatorymotorvehiclethirdpartyliabilityinsurance;

（6）Otherproofsandcertificatesprescribedbyanylaw or administrativeregulationtobesubmittedfortheregistrationofthemotorvehicle.

Ifthetypeofthemotorvehicleisn'tonethatisexemptedfromsafetytechnicalinspectionaccordingtotheprovisionsoftheadministrativedepartmentformotorvehicleproductsoftheStateCouncil,theapplicantshallprovideaqualitycertificateofsafetytechnicalinspectionapartfromtheabove-mentionedcertificationandproofs.

Article6Wherearegisteredmotorvehicleisunderanyofthefollowingcircumstances,theownerofthemotorvehicleshallfileanapplicationtothetrafficadministrativedepartmentofthepublicsecurityorgan,inwhichthismotorvehiclehasbeenregistered,formodifyingtheregistration:

（1）Thecolorofitsbodyischanged;

（2）Itsengineischanged;

（3）Itsbody or frameischanged;

（4）Thewholemotorvehicleischangedbythemanufacturerduetoanyqualityproblem;

（5）Thecommercialoperatingmotorvehicleischangedtonon-commercialoperatingmotorvehicle or viceversa; or 

（6）Theownerofthemotorvehiclehasmovedinto or outofadomicilewithinthejurisdictionofthetrafficadministrativedepartmentofthepublicsecurityorgan.

Whenapplyingformodificationregistrationofamotorvehicle,theapplicantshallsubmitthefollowingcertificatesandproofs.IfthemotorvehicleisunderanyofthecircumstancesaslistedinItems

（1）through（5）oftheprecedingparagraph,theapplicantshallhavethemotorvehiclecheckedapartfromsubmittingthefollowingcertificatesandproofs;ifthemotorvehicleisunderthecircumstanceaslistedinItem

（2） or （3）oftheprecedingparagraph,theapplicantshallsimultaneouslysubmittheconformitycertificateuponsafetytechnicalinspectionaswell:

（1）Theidentificationproofoftheownerofthemotorvehicle;

（2）Themotorvehicleregistrationcertificate;and

（3）Themotorvehicledrivingpermit.

Wheretheownerofamotorvehiclechangeshisdomicilewithinthejurisdictionofthetrafficadministrativedepartmentofthepublicsecurityorgan,thenameoftheowner（entity） or contactway,heshallreporttothetrafficadministrativedepartmentofthepublicsecurityorgan,inwhichthemotorvehiclehasbeenregistered,forarchivalpurposes.

Article7Wheretheownershipofaregisteredmotorvehicleischanged,thepartiesconcernedshalldulygothroughthetransferregistrationformalities.

Whenapplyingfortransferregistration,thepartiesconcernedshallhavethemotorvehicleinspectedbythetrafficadministrativedepartmentofpublicsecurityorganwherethemotorvehicleisregistered,andshallsubmitthefollowingcertificatesandproofs:

（1）Theidentificationproofsofthepartiesconcerned;

（2）Thecertificate or proofofthetransferoftheownershipofthemotorvehicle;

（3）Themotorvehicleregistrationcertificate;and

（4）Themotorvehicledrivingpermit.

Article8Wheretheownerofamotorvehiclemortgagesthemotorvehicle,he（she）shallfileanapplicationformortgageregistrationtothetrafficadministrativedepartmentofthepublicsecurityorganwherethemotorvehiclehasbeenregistered.

Article9Wherearegisteredmotorvehiclemeetsthemandatorydiscardstandardsofthestate,thetrafficadministrativedepartmentofthepublicsecurityorganshallinformtheownerofthemotorvehiclethatheshallgothroughtheformalitiesforcancellationregistrationtwomonthsbeforethediscardperiodexpires.Theownerofthemotorvehicleshallsellthemotorvehiclethecorrespondingrecyclingenterprise,whichshallsubmitthediscardedmotorvehicleregistrationcertificate,plate,drivingpermittothetrafficadministrativedepartmentofthepublicsecurityorganforcancellation.Iftheownerofthemotorvehiclefailstogothroughtheformalitiesforcancellationregistrationwithinthetimelimit,thetrafficadministrativedepartmentofthepublicsecurityorganshallannouncethattheregistrationcertificate,plateanddrivinglicenseofthismotorvehiclearenullandvoid.

Whereanapplicationforcancellationregistrationduetoloss or damagetothemotorvehicle,theownerofthemotorvehicleshallsubmithis（her,its）ownidentificationprooftothetrafficadministrativedepartmentofthepublicsecurityorganaswellasthemotorvehicleregistrationcertificate.

Article10Wheretheproofsandcertificatessubmittedbyanapplicantformotorvehicleregistrationarecompleteandvalid,theformalitiesforregistrationshallbecompletedbythetrafficadministrativedepartmentofthepublicsecurityorganonthespot.

Withregardtoamotorvehicleseized or detainedbythepeople'scourt,people'sprocuratorate or administrativelawenforcementdepartment,thetrafficadministrativedepartmentofthepublicsecurityorganshallrefusetoregisterthemotorvehicle.

Article11Wheretheownerofmotorvehicleappliesforanewregistrationcertificate,plate or drivingpermitbecausetheformeroneislost or destroyed,heshallsubmithisidentificationproofandapplicationmaterialstothetrafficadministrativedepartmentofthepublicsecurityorgan.Uponverifyingagainsttheregisteredfilesofthismotorvehicle,thetrafficadministrativedepartmentofthepublicsecurityorganshallissueanewregistrationcertificate,plate,drivingpermittotheapplicantwithin15daysfromthedaywhentheapplicationisreceived.

Article12Thetaxdepartment or insuranceinstitutionmay,inacentralizedway,handlethemotor-vehicle-relatedtaxpayments or conclusionofinsurancecontractsattheofficeofthetrafficadministrativedepartmentofpublicsecurityorgan.

Article13Theplateofamotorvehicleshallbefixedatthespecifiedplacesofthefrontandbackofthemotorvehicle,andshallbekeptclearandcomplete.Anenlargedplatenumbershallbepaintedatthebackofthebody or containerofaheavylorry,medium-typetruck or tractoranditstrailer,thelettersshallbestandardandclear.

Themotorvehicleconformityinspectionmarkandtheinsurancesignshallbestuckontheuppercorneroftherightofthefrontwindowofthemotorvehicle.

Anymark,sign, or advertisementpaintedonthebodyofamotorvehicleshallnotaffectthesafetyofdriving.

Article14Aroadpassengerautomobile,heavylorry or semi-trailertractorshallbeequippedwith or useadrivingrecordinstrumentthatmeetsthestandardsofthestate.Thetrafficpolicemayexaminethedrivingspeed,consecutivedrivingtimeandotherdrivinginformationofmotorvehicles.Theinstallationofdrivingrecordinstrumentsmaybecarriedoutinseveralsteps,whichshallbespecifiedbytheadministrativedepartmentformotorvehicleproductoftheStateCounciljointlywithotherrelevantdepartments.

Article15Themotorvehiclesafetytechnicalinspectionshallbeconductedbythemotorvehiclesafetytechnicalinspectioninstitutionsaccordingtothestandardsofthestateonmotorvehiclesafetytechnicalinspection.Themotorvehiclesafetytechnicalinspectioninstitutionsshallbearthelegalliabilitiesfortheinspectionconclusions.

Thequality&technicalsupervisorydepartmentshallberesponsibleforthequalificationmanagementandmeasureauthenticationmanagementrelatedtothemotorvehiclesafetytechnicalinspectioninstitutions,shallcheckandtestthemotorvehiclesafetytechnicalinspectionequipment,andshallsupervisetheimplementationof
