THECOUNCILOFTHEEUROPEANCOMMUNITIES,
HavingregardtotheTreatyestablishingtheEuropeanEconomicCommunity,andinparticularArticle118athereof,
HavingregardtotheproposalfromtheCommission
(1),submittedafterconsultingtheAdvisoryCommitteeonSafety,HygieneandHealthProtectionatWork,
IncooperationwiththeEuropeanParliament
(2),
HavingregardtotheopinionoftheEconomicandSocialCommittee(3),
WhereasArticle118aoftheTreatyprovidesthattheCouncilshalladopt,bymeansofdirectives,minimumrequirementsforencouragingimprovements,especiallyintheworkingenvironment,toensureabetterlevelofprotectionofthesafetyandhealthofworkers;
Whereas,underthetermsofthatArticle,thosedirectivesaretoavoidimposingadministrative,financialandlegalconstraintsinawaywhichwouldholdbackthecreationanddevelopmentofsmallandmedium-sizedundertakings;
WhereasthecommunicationfromtheCommissiononitsprogrammeconcerningsafety,hygieneandhealthatwork(4)providesfortheadoptionofaDirectivedesignedtoguaranteethesafetyandhealthofworkersattemporaryormobileconstructionsites;
Whereas,initsresolutionof21December1987onsafety,hygieneandhealthatwork(5),theCounciltooknoteoftheCommission'sintentionofsubmittingtotheCouncilinthenearfutureminimumrequirementsconcerningtemporaryormobileconstructionsites;
Whereastemporaryormobileconstructionsitesconstituteanareaofactivitythatexposesworkerstoparticularlyhighlevelsofrisk;
Whereasunsatisfactoryarchitecturaland/ororganizationaloptionsorpoorplanningoftheworksattheprojectpreparationstagehaveplayedaroleinmorethanhalfoftheoccupationalaccidentsoccurringonconstructionsitesintheCommunity;
WhereasineachMemberStatetheauthoritiesresponsibleforsafetyandhealthatworkmustbeinformed,beforethebeginningoftheworks,oftheexecutionofworksthescaleofwhichexceedsacertainthreshold;
Whereas,whenaprojectisbeingcarriedout,alargenumberofoccupationalaccidentsmaybecausedbyinadequatecoordination,particularlywherevariousundertakingsworksimultaneouslyorinsuccessionatthesametemporaryormobileconstructionsite;
Whereasitisthereforenecessarytoimprovecoordinationbetweenthevariouspartiesconcernedattheprojectpreparationstageandalsowhentheworkisbeingcarriedout;
Whereascompliancewiththeminimumrequirementsdesignedtoguaranteeabetterstandardofsafetyandhealthattemporaryormobileconstructionsitesisessentialtoensurethesafetyandhealthofworkers;
Whereas,moreover,self-employedpersonsandemployers,wheretheyarepersonallyengagedinworkactivity,may,throughtheiractivitiesonatemporaryormobileconstructionsite,jeopardizethesafetyandhealthofworkers;
Whereasitisthereforenecessarytoextendtoself-employedpersonsandtoemployerswheretheyarepersonallyengagedinworkactivityonthesitecertainrelevantprovisionsofCouncilDirective89/655/EECof30November1989concerningtheminimumsafetyandhealthrequirementsfortheuseofworkequipmentbyworkersatwork(secondindividualDirective)(6),andofCouncilDirective89/656/EECof30November1989ontheminimumhealthandsafetyrequirementsfortheusebyworkersofpersonalprotectiveequipmentattheworkplace(thirdindividualDirective)(7);
WhereasthisDirectiveisanindividualDirectivewithinthemeaningofArticle16
(1)ofCouncilDirective89/391/EECof12June1989ontheintroductionofmeasurestoencourageimprovementsinthesafetyandhealthofworkersatwork(8);whereas,therefore,theprovisionsofthesaidDirectivearefullyapplicabletotemporaryormobileconstructionsites,withoutprejudicetomorestringentand/orspecificprovisionscontainedinthisDirective;
WhereasthisDirectiveconstitutesapracticalsteptowardstheachievementofthesocialdimensionoftheinternalmarketwithspecialreferencetothesubjectmatterofCouncilDirective89/106/EECof21December1988ontheapproximationoflaws,regulationsandadministrativeprovisionsoftheMemberStatesrelatingtoconstructionproducts(9)andthesubjectmattercoveredbyCouncilDirective89/440/EECof18July1989amendingDirective71/305/EECconcerningcoordinationofproceduresfortheawardofpublicworkcontracts(10);
Whereas,pursuanttoCouncilDecision74/325/EEC(11),theAdvisoryCommitteeonSafety,HygieneandHealthProtectionatWorkisconsultedbytheCommissionwithaviewtodrawingupproposalsinthisfield,
HASADOPTEDTHISDIRECTIVE:
Article1
Subject
1.ThisDirective,whichistheeighthindividualDirectivewithinthemeaningofArticle16
(1)ofDirective89/391/EEC,laysdownminimumsafetyandhealthrequirementsfortemporaryormobileconstructionsites,asdefinedinArticle2(a).
2.ThisDirectiveshallnotapplytodrillingandextractionintheextractiveindustrieswithinthemeaningofArticle1
(2)ofCouncilDecision74/326/EECof27June1974ontheextensionoftheresponsibilitiesoftheMinesSafetyandHealthCommissiontoallmineral-extractingindustries(12).
3.TheprovisionsofDirective89/391/EECarefullyapplicabletothewholescopereferredtoinparagraph1,withoutprejudicetomorestringentand/orspecificprovisionscontainedinthisDirective.
Article2
Definitions
ForthepurposesofthisDirective:
(a)'temporaryormobileconstructionsites'(hereinafterreferredtoas'constructionsites')meansanyconstructionsiteatwhichbuildingorcivilengineeringworksarecarriedout;anon-exhaustivelistofsuchworksisgiveninAnnexI;
(b)'client'meansanynaturalorlegalpersonforwhomaprojectiscarriedout;
(c)'projectsupervisor'meansanynaturalorlegalpersonresponsibleforthedesignand/orexecutionand/orsupervisionoftheexecutionofaproject,actingonbehalfoftheclient;
(d)'self-employedperson'meansanypersonotherthanthosereferredtoinArticle3(a)and(b)ofDirective89/391/EECwhoseprofessionalactivitycontributestothecompletionofaproject;
(e)'coordinatorforsafetyandhealthmattersattheprojectpreparationsstage'meansanynaturalorlegalpersonentrustedbytheclientand/orprojectsupervisor,duringpreparationoftheprojectdesign,withperformingthedutiesreferredtoin
Article5;
(f)'coordinatorforsafetyandhealthmattersattheprojectexecutionstage'meansanynaturalorlegalpersonentrustedbytheclientand/orprojectsupervisor,duringexecutionoftheproject,withperformingthedutiesreferredtoinArticle6.
Article3
Appointmentofcoordinators-Safetyandhealthplan-Priornotice
1.Theclientortheprojectsupervisorshallappointoneormorecoordinatorsforsafetyandhealthmatters,asdefinedinArticle2(e)and(f),foranyconstructionsiteonwhichmorethanonecontractorispresent.
2.TheclientortheprojectsupervisorshallensurethatpriortothesettingupofaconstructionsiteasafetyandhealthplanisdrawnupinaccordancewithArticle5(b).
TheMemberStatesmay,afterconsultingbothmanagementandtheworkforce,allowderogationsfromtheprovisionsofthefirstparagraph,exceptwheretheworkconcernedinvolvesparticularrisksaslistedinAnnexII.
3.Inthecaseofconstructionssites:
-onwhichworkisscheduledtolastlongerthan30workingdaysandonwhichmorethan20workersareoccupiedsimultaneously,or
-onwhichthevolumeofworkisscheduledtoexceed500person-days,
theclientortheprojectsupervisorshallcommunicateapriornoticedrawnupinaccordancewithAnnexIIItothecompetentauthoritiesbeforeworkstarts.
Thepriornoticemustbeclearlydisplayedontheconstructionsiteand,ifnecessary,periodicallyupdated.
Article4
Projectpreparationstage:
generalprinciples
Theprojectsupervisor,orwhereappropriatetheclient,shalltakeaccountofthegeneralprinciplesofpreventionconcerningsafetyandhealthreferredtoinDirective89/391/EECduringthevariousstagesofdesigningandpreparingtheproject,inparticular:
-whenarchitectural,technicaland/ororganizationalaspectsarebeingdecided,inordertoplanthevariousitemsorstagesofworkwhicharetotakeplacesimultaneouslyorinsuccession,
-whenestimatingtheperiodrequiredforcompletingsuchworkorworkstages.Accountshallalsobetaken,eachtimethisappearsnecessary,ofallsafetyandhealthplansandoffilesdrawnupinaccordancewithArticle5(b)or(c)oradjustedinaccordancewithArticle6(c).
Article5
Projectpreparationstage:
dutiesofcoordinators
Thecoordinator(s)forsafetyandhealthmattersduringtheprojectpreparationstageappointedinaccordancewithArticle3
(1)shall:
(a)coordinateimplementationoftheprovisionsofArticle4;
(b)drawup,orcausetobedrawup,asafetyandhealthplansettingouttherulesapplicabletotheconstructionsiteconcerned,takingintoaccountwherenecessarytheindustrialactivitiestakingplaceonthesite;thisplanmustalsoincludespecificmeasuresconcerningworkwhichfallswithinoneormoreofthecategoriesofAnnexII;
(c)prepareafileappropriatetothecharacteristicsoftheprojectcontainingrelevantsafetyandhealthinformationtobetakenintoaccountduringanysubsequentworks.
