Preamble:
WhereasitisexpedienttomakeprovisionsfortheDuty,PowerandResponsibilitiesandWorkingProcedureoftheCommissionfortheInvestigationofAbuseofAuthority,1991;
Now,therefore,Parliamenthas,inthetwentiethyearofthereignofHisMajestyKingBirendraBirBikramShahDev,enactedthisAct.
ChapterI
Preliminary
1.ShortTitleandCommencement
(1)ThislawshallbecalledtheCommissionfortheinvestigationofabuseofauthorityAct,1991.
(2)ThislawshallbeapplicablethroughoutthekingdomofNepal,aswellastoallNepalicitizens,wherevertheymaybelivingorresidingoutsidethekingdomofNepal.
(3)Itshallcomeintoforceatonce.
2.Definitions
Unlessotherwisemeantwithreferencetothesubjectorcontext,inthisAct,
(a)"Constitution"meanstheConstitutionoftheKingdomofNepal,1990
(b)"Commission"meanstheCommissionfortheInvestigationofAbuseofAuthority,constitutedunderArticle97oftheConstitutionoftheKingdomofNepal
(c)"Commissioner"meansincludingtheChiefCommissioneroftheCommission.
(d)"Personholdingapublicpost"meansanypersonwhoisholdingapostofresponsibilityorisentitledtoexerciseanyrightinpursuanceoftheConstitution,otherprevailinglawsordecisionsorordersoftheconcernedbodyorauthorityandthetermshallalsomeananofficialoremployeeholdinganypostinapublicinstitution.
(e)"PublicInstitution"shallmeanthefollowinginstitutions:
1.Acompany,bankorcommitteewhollyorpartlyownedorcontrolledbyHisMajesty'sGovernmentorcommissions,organizations,authority,corporations,academy,boards,centers,councilsoranyotherorganizedinstitutionofsuchnatureestablishedbyHisMajesty'sGovernment,
2.Universities,campuses,schools,researchcentersandanyotheracademicoreducationalinstitutionsrunbyHisMajesty'sGovernmentorreceivingfullorpartialgrantsfromHisMajesty'sGovernment,
3.LocalbodiesconstitutedundertheLocalSelf-GovernanceAct,1999,
4.Institutionsrunwithloans,grantsorguaranteeofHisMajesty'sGovernment.
5.InstitutionswithfullorpartialownershipintheinstitutionsstatedinSub-Clauses
(1),
(2),(3)or(4),
6.AnyotherinstitutiondesignatedaspublicinstitutionbyHisMajesty'sGovernmentbypublishinganotificationintheNepalGazette.
(f)"InvestigationOfficer"meansapersondesignatedunderthislawforconductinginquiriesandinvestigationsintoabuseofauthority.
(g)"ImproperAction"meansanyactionasmentionedinSection3,committedbyapersonholdingapublicpost.
(h)"Corruption"meansanoffencepunishableunderthecurrentlawsrelatingtotheeliminationofcorruption.
(i)"AbuseofAuthority"meansanimproperactionasmentionedinClauses(g)or(h)orcorruption,
(j)"Court"meansthecourtpursuanttoSection34
(1),
(k)"Authority"meansanauthorityprovidedforincurrentlawsoragreementsoranyotherwrittendocumentsrelatingtotermsandconditionsofserviceofapersonwhoisholdingapublicpost,andthetermshallalsoapplytoapersonauthorizedtoappoint,dismissfromserviceorsupervisetheworksofsuchpersons.
3.Improperaction:
Anyofthefollowingactionstakenwillfullyornegligentlybyapersonholdingapublicpostshallbedeemedasanimproperaction:
(a)Whohasrefusedtodoanythingwithinhisjurisdictionordoneanythingforwhichhehasnopowers,
(b)Whohasfailedtocomplywiththemandatoryworkingprocedureswhiletakinganydecisionorissuinganyorder,
(c)Whohasexercisedpowersvestedwithhimforanyobjectiveorpurposeincontraventionoftheappropriatelaws,decisionororder,
(d)Whohasexercisedhisdiscretionarypowersinamalafideorarbitrarymanner,
(e)Whohascreatedunauthorizedobstructionintheworkofanyotheroffice,officialoremployee,orcompelledthemtodoanyunauthorizedactsbyexertingpressureonsuchoffice,officialoremployee,
(f)Whohasshiftedtheresponsibilitybynotdoinganythingwhichheorsheshouldhavedone,butsentittoanotherofficeorofficial,
(g)Whohasfailedtodischargeanydutypertainingtohispost,whichheisrequiredtodischargeaccordingtothenatureofthepost.
(h)Whohasgothisworkdonebyexertingunduepressuresonanemployeewhoissubordinatetohimoranypersonwhoisunderhisinfluence,or
(i)Whohasabusedtheimmunity,facilitiesorprivilegesacquiredinthecapacityofhispost.
ChapterII
ProvisionsRegardingJurisdictionoftheCommission
4.JurisdictionoftheCommission:
TheCommission,inaccordancewiththisActorothercurrentlaws,mayconductinvestigations,filecasesortakeanyactionagainstanypersonholdingapublicpostfoundguiltyofabusingpowers.Providedthat,
a.InmatterscontainedintheprovisoofArticle98
(1)oftheConstitution,actionsshallbetakenaccordingly.
b.TheCommission,pursuanttotheAct,shallnottakeanyactioninmattersrelatingtoanybusinessordecisionstakenatmeetingsofanyHouseofParliamentorofanycommitteeoranythingsaidordonebyanymemberatsuchmeetings,oranypolicydecisionstakenbytheCouncilofMinistersoranycommitteethereoforjudicialactionsofacourtoflaw.
5.*RepealedbytheSecondAmendment
6.RegardingactionsbytheCommissiononimproperactsininstitutions:
TheCommissionmayreferanycomplaintfiledwithitregardinganyimproperactioninanypublicinstitutiontotheconcernedinstitution,ortotheconcernedhigherbodyforaction,accordingtocircumstances,ontheconditionthatthereportissubmittedtoit,andsuchbodyshallinformboththeCommissionandthecomplainantabouttheactionanddecisiontakeninrespectthereto.
ProvidedthatincasetheCommissionsodeemsnecessary,itmayconductafreshinquiryorinitiateactionitselfinrespecttosuchcomplaint.
7.Commissionnotallowedtoraisequestionsaboutexerciseofdiscretionarypowers:
TheCommissionshallnotinitiateanyactionunderthisActwithregardtoanyactionordecisiontakenbyanyofficerinanymatterinexerciseofhisdiscretionarypowers.
Providedthatincaseitappearsthatsuchdiscretionarypowershavebeenexercisedinamalafideorarbitrarymanner,nothingmentionedinthisSectionshallbedeemedtohavepreventedtheCommissionfrominitiatingactioninrespectthereto.
ChapterIII
ProvisionsRegardingImproperActions
8.Complaintswithregardtoimproperacts:
(1)Incaseanyonecommitsimproperactionshavinganadverseeffectonmattersofpublicinterestsorconcern,anyonemayfileacomplaintwiththeCommissionandincaseofmattersotherthanthis,anypersonwhoisadverselyaffectedbytheimproperactionmaylodgeacomplaint.
Providedthatincasethepersonadverselyaffectedbyimproperactshasalreadydiedoritisprovedthatheisunabletofileacomplaintbecauseofphysicalormentalincapacity,theCommissionmayinitiateactioninrespecttheretoonthebasisofacomplaintfiledbyhisheirorguardianaswell.
(2)NotwithstandingnoonefilingacomplaintpursuanttoSub-Section
(1),incaseatip-offisreceivedtotheCommissionfromanysourceaboutanimproperactionbeingcommittedadverselyaffectingmattersofpublicinterestorconcern,theCommission,pursuanttothisAct,mayconductaninquiryorinvestigationandtakenecessaryactionwithregardtoit.
(3)WhilefilingacomplaintasperSub-Section
(1)onmattershavinganadverseimpactonpublicinterestorconcern,thecomplaintmaybefiledanytimeandwithregardtomattersotherthanthiscomplaintsshallbefiledwithin35daysafterthecomplainantcomestoknowofit.
(4)Whilesubmittingacomplaint,thecomplainantmustsubmitalltheevidencesinsupportofthecomplaintwhichareinhispossessionorwhichhecanobtain.
9.Verificationofcomplaints:
ExceptwhenthepersonadverselyaffectedbyimproperactionspersonallyfilesacomplaintwiththeCommission,incasethecomplaintisforwardedtotheCommissionbypostorbyanyothermeans,theCommissionmustsummonthecomplainanttoappearbeforeitwithinsevendaysafterreceivingsuchcomplaintforitsverification.
Providedthatincasethecontentsofthecomplaintshowthatitisnotbasedonthefactsorisunclearorconfusing,theCommissionmaydecidenottotakeanyactioninrespectthereto.TheCommissionshallinformthepersonadverselyaffectedbyimproperactionsofsuchdecisionasearlyaspossible.
10.Procuringtherelevantfilesanddocumentsofevidence:
Incasethecontentsofthecomplaints,andanyevidences,ifany,submittedbythecomplainantinrespectthereto,providereasonablegroundstobelievethatanypersonholdingapublicposthasdoneanyimproperactionasmentionedinthecomplaint,theCommissionmayprocuretherelevantfilesordocumentsofevidencefromtheappropriateoffice,office-holder,orperson,andincaseofanypersonwhocanprovideimportantinformationinrespectthereto,theCommissionmayalsointerrogatesuchperson.
11.Procedurefordepartmentalaction:
1.IncaseanypersonholdingapublicpostisdeemedtohavecommittedanimproperactionorthereisreasonablegroundtobelievesofromaninvestigationundertakenbytheCommission,theCommissionshallsendanotificationtosuchpersonbyenclosingallthedetailsobtainedfromtheinvestigationintothecomplaintfiledagainsthimrequiringhimtosubmitaclarificationwithin
