Article2Theprobationperiodof thiscontract shallbedeterminedby asfollows (theprobationperiodisincludedinthecontractperiod):
(a)Noprobationperiod.
(b)Thefirstmonthshallbetheprobationperiodforthiscontract.
II.JobdescriptionandworkingplaceArticle3.PartyAmayadoptasystemoffullemploymentorrecruitmentandamanagementsystem,andthejobdutiesandworkingplaceofPartyBshallbedeterminedbythepartiesheretoaccordingtothejob/positionagreement(hereinafterreferredtoasthe"PostAgreements")orotherrelevantagreementsorcontractsagreedbythepartieshereto.
Theworkingperiodshallnotexceedthecontracttermandshallbeterminatedasthelaborcontractexpires.Incasethattheworkingperiodterminateswithinthecontractterm,thepartiesmayrenewthetermorsignanewagreement,otherwise,thepartiesshallactinaccordancewiththeregulationsandrulesonpost-waitinganddepartureoftheemployeesstipulatedbyPartyAwithnoticeonpost-waitinganddepartureasamendmentstothelaborcontract.
PartyBagreesthatPartyAmaychangethejobdutiesofPartyBasrequiredbytheoperation,businessormanagementofthecompanybasedontheperformanceofPartyB.
Article4.PartyBshallperformitsjobdutieshereunderinaccordancewiththerequirementsofPartyAanditsjobresponsibilities,andshallcompleteitstasksasrequiredontimetothesatisfactionofPartyA.
Article5.PartyAshallpractiseasystemofperformanceappraisal. Theappraisalresultsof PartyBandtheevaluationofPartyB'sabilities,behaviorsandattitudes,whichshallserveasimportantevidencesforthepost/positionappointment,salaryadjustment,workshifts,traininganddevelopment,careerplanning,supervisionandimprovement,forceddepartureofPartyB.
Article6.Duringthetermofthiscontract,PartyBshallnot, withoutthepriorwrittenapprovalofPartyA, workfor orprovideservicesfor anyotheremployersorindividualsaspart-timejob,orrunitsownbusinessorcooperatewithotherstoengageinanybusinesssameorsimilartotheoperationorbusinessofPartyB,withorwithoutpaymentofanyforms.
Article7.Accordingtoitsmanagementrequirementssuchasconfidentiality,PartyAshallbeentitledtoaskPartyBnottoperformitsresponsibilities,partsorall,asspecified hereunder.
III.Workinghoursandvacations
Article8 PartyAshalladoptoneofthethreeworkingsystemasfollowsaccordingtotheworkundertakenbyPartyB:
(a)Standardman-hours.PartyAshallnotassignPartyBanyworkbeyondtherequired8hoursperworkingdayand40hoursperweek,dependingon theprovisionsofPartyA. IfPartyBisrequiredtooperateonnon-standardman-hours,theworkinghoursofPartyBshallbedeterminedbythenationalorlocalregulationsandlawsonnon-standardworkinghoursandtherelevantprovisionsof PartyA.
(b)Integratedman-hourscalculated bymonth(orquarter,year). Averagedailyandaverageweeklyworkinghoursshallnotexceedthelegalstandardworkinghours.Iftheworking-hoursystemofPartyBischangedtothestandardworkingsystemasrequiredbytheapplicablelawsandregulationswithintheemployment,thespecificworkinghoursofPartyBshallbedeterminedby theapplicablelawsandregulationsandby therelevantprovisionsofPartyA.
(c)Flexibleworkinghoursystem. PartyAshalluseanappropriateworkinghoursystemsuchasflexibleworkinghoursystemtoensurethatPartyBhasitsrightstorestandvacationswithoutnegativeeffectsonitscompletionofitsjobtasks. Iftheworking-hoursystemofPartyBischangedtothestandardworkingsystemasrequiredbytheapplicablelawsandregulationswithintheemployment,thespecificworkinghoursofPartyBshallbedeterminedby theapplicablelawsandregulationsandby therelevantprovisionsofPartyA.
TheinitialworkinghourssystemforPartyBshallbethe(b)optionsmentionedaboveorasotherwisespecifiedherein.Ifanychangesoccurto PartyB'sposition,thecorrespondingworkinghourssystemshallbeadoptedthereafter.
Article9.PartyAmay,asrequiredbythejobandupontheinternalapprovalofPartyA,askPartyBtoworkovertime,dependingonandinaccordancewiththerelevantprovisionslegallystipulatedbyPartyA.
Article10.PartyBshallbeentitledtosuchvacationsas legalholiday,annualleave,weddingleave,maternityleave,funeralleave accordingtothenationalandlocalregulationsandrulesspecifiedbyPartyA.PartyBshallmakereasonablearrangementsofvariousvacationinaccordancewiththeprovisionsofPartyAandasrequiredbythebusiness.
IV.Remuneration
Article11.PartyAshallpractiseajob-orperformance-basedcompensationsystem. PartyAwilldetermineapplicablesalaryandcompensationlevelofPartyB accordingtotheresultofevaluationsasreflectedinthemarketvaluesofthejobperformedbyandcontributionmadebyPartyB. Indeterminingthesalarylevel,PartyAwill,accordingtoPartyB'scompetence,pastperformance,workexperienceandotheraffectingfactors,determinethespecificproportionorsalarypointsofPartyB,whoshallagreeoracceptsuchdecisions.
Article12.IfPartyBperformsitsjobsandtasksasrequiredbyPartyAduringthelegalworkinghoursorworkinghoursspecifiedherein,PartyAshallpayPartyBtheinitialsalaryof orasspecifiedin agreement.IfanyadjustmentmadetoPartyB'spostwithintheperiodofthiscontract,theadjustedsalarystandardsthereaftershallapply.
Standardwageatprobationperiodshallbe_yuan/or asspecifiedin__.
Article13.IfPartyBmeetstheminimumperformancerequirementsofPartyA,PartyAwilleffect performancebonuses accordingtotheassessmentofPartyB'sperformancewithacertainperiod. PartyB'sperformancebonus,notonlyshallberelatedtotheworkingperformanceofPartyB,butalsocouldberelatedtotheperformanceoftheorganization(ordepartmentorteam)wherePartyBoperatesaccordingtothenatureofjob,and totheregulationsonperformancemanagementandcompensationsystemprovidedbyPartyA.PartyBmustagreeoracceptsuchdecisionsorarrangements.
Article14.Intheperiodofthiscontract,PartyAshallMmakeadjustmentsandchangesatitsowndiscretionbasedonthepost,jobdescription.changestojobresponsibilitiesandtheperformanceofPartyBasrequiredbytheregulationsonchangesofcompensationsstipulatedbyPartyAbylaw.
Article15.IfPartyBisonbusinessleave,unemployed,sickorinjuredbynon-work-relatedreasonsorpenalized,PartyAmaydeductthesalarypayabletoPartyBinaccordancewiththeapplicablelawsandregulationsasrequiredasfollows:
(1) IfPartyBisonbusinessleave, PartyAhastherighttodecreaseacertainamountofthesalarypayabletoPartyBaccordingtotherelevantrulesandregulations.
(2) IfPartyBisunemployed,PartyAshall paylivingexpenses toPartyBbymonthforthatperiod,whichmay belowerthanthelocalminimumwages,butshallnotbelessthanthelocal subsistenceallowance.
(3) IfPartyBissickorinjuredbynon-work-relatedreasons,PartyAshallpaysickpayor sickness-reliefcosts,whichshallnotbelessthantheamountasspecifiedbytheapplicablenationalandlocalregulations, toPartyBduringthemedicalperiod.
(4) IfPartyBispenalized, PartyAshallbeentitledtodeduct acertainamountofthesalarypayabletoPartyBaccordingtotherelevantrulesandregulations. IfPartyBprovidesservicesasusualforthatperiod,itshallreceivewagesnotlowerthanthelocalminimumwagestandards.
Article16.UponthecompletionofworksassignedtoitbyPartyA,PartyBshallreceiveanamountinfullandontimefromPartyAatatimespecifiedbyregulationsoncompensationsystemsetbyPartyA.
Article17.PartyAshallhavetherighttodeductthefollowingcostsorfeesfromthesalariespayabletoPartyB:
(1)individualincometaxthat shallbebornebyPartyBandbewithheldbyPartyA;
(2)allsocialinsurancesandwelfares;
(3) alimoniesto bewithheldbyPartyA asrequiredby thecourtdecisionsorruling;
(4)anyeconomiclossesincurredtoPartyAduetoPartyB;
(5)otherfeesandcoststhatcanbedeductedfromtheamountpayabletoPartyBbyPartyAinaccordancewiththeapplicablelawsandregulationsuponmutualagreement.
V.Socialinsurancesandotherwelfarebenefits
Article18.Withinthetermofthecontract,thepartiesheretoshall underwrite socialinsurancesaccordingtotherelevantstateprovisionsandlocallaws. Inaccordancewiththeapplicablelawsandregulations,PartyAshallbearitsdueshareandwithholdtheamountpayablebyPartyBfromthepayrollinaccordancewiththelaw.
PartyB shall underwrite socialinsurances,gothroughalltheformalitiesasrequiredinatimelymanneraccordingtotherequirementsofPartyA,andprovideinformation toPartyA,otherwise,PartyBshallbeheldliableforanylossesarisingtherefromtoPartyA (includingbutnotlimitedtotheoverduefinesbythesocialinsurancedepartment).PartyBshallbeentitledtoallbenefitsrelatedtosocialinsurance inaccordancewiththerelevantregulationssetbyBOTHthestateandPartyA.
Article19.
IfPartyBissickorinjuredbynon-work-relatedreasons duringthecontractterm, PartyBshallbeentitledtomedicalleave,sickpayor sickness-reliefcostsasspecifiedbytheapplicablenationalandlocalregulationsandbythePartyA.
