GeneralProvisions
Article1ThisLawisenactedinordertoimprovethelaborcontractsystem,definetherightsandobligationsofbothpartiestoalaborcontract,protectthelegitimaterightsandinterestsofworkers,andestablishanddevelopaharmoniousandstablelaborrelationship.
Article2ThisLawisapplicablewhereorganizationssuchasenterprises,self-employedeconomicorganizationsandprivatenon-enterpriseunitswithintheterritoryofthePeople’sRepublicofChina(hereinafterreferredtoasemployingunits)establishlaborrelationshipswithworkersthroughconcluding,performing,modifying,revokingorterminatinglaborcontractswiththem.
Stateorgans,institutionsandpublicorganizationsandtheworkerswithwhomtheyaretoestablishlaborrelationshipsshallconclude,perform,modify,revokeorterminatelaborcontractsinaccordancewiththisLaw.
Article3Laborcontractsshallbeconcludedinadherencetotheprinciplesoflawfulness,fairness,equality,voluntariness,consensusthroughconsultation,andgoodfaith.
Alaborcontractconcludedinaccordancewithlawshallhavebindingforce.Boththeemployingunitandtheworkershallfulfilltheobligationsstipulatedinthelaborcontract.
Article4Employingunitsshallestablishandimprovelaborrulesandregulationstoensurethatworkersenjoythelaborrightsandfulfillthelaborobligations.
Whenformulatingormodifyingtherulesandregulations,ormakingdecisionsonimportantmatters,whichhaveadirectbearingontheimmediateinterestsofworkers,suchaslaborremuneration,workinghours,restandvacation,occupationalsafetyandhealth,insuranceandwelfare,training,labordisciplineandlaborquotacontrol,theemployingunitshall,afterdiscussionbytheconferenceofworkersoralltheworkers,putforwardplansandsuggestionsandmakedecisionsafterconsultingwiththetradeunionortherepresentativesoftheworkersonanequalfooting.
If,duringtheimplementationoftherulesandregulationsorthedecisionsonimportantmatters,thetradeunionortheworkersholdthatsuchrules,regulationsordecisionsareinappropriate,itortheyareentitledtoputforwardtheopiniontotheemployingunit,andhavetherules,regulationsordecisionsmodifiedandimprovedthroughconsultation.
Theemployingunitshallmakepublicorinformtheworkersoftherulesandregulations,andthedecisionsonimportantmatters,whichhaveadirectbearingontheimmediateinterestsoftheworkers.
Article5Theadministrativedepartmentoflaborofthepeople’sgovernmentatorabovethecountylevelshall,togetherwiththerepresentativesofthetradeunionandtheenterprise,establishasoundtripartitemechanismforcoordinationoflaborrelationships,inordertojointlydiscussandresolvethemajorissuesconcerninglaborrelationships.
Article6Thetradeunionshallgiveassistanceandguidancetotheworkersinlawfullyconcludinglaborcontractswiththeemployingunitandperformingthesame,andestablishacollectiveconsultationmechanismwiththeemployingunitinordertoprotectthelegitimaterightsandinterestsofworkers.
ChapterII
ConclusionofaLaborContract
Article7Alaborrelationshipisestablishedbyanemployingunitwithaworkerasofthedatetheformeremploysthelatter.Anemployingunitshallkeeparegisterofworkersforreference.
Article8Whenanemployingunitrecruitsaworker,itshalltruthfullyinformhimofthejobdescription,theworkingconditions,theplaceofwork,occupationalhazards,conditionsforworksafety,laborremunerationandothermatterswhichtheworkerrequeststobeinformedof.Theemployingunithastherighttoacquirethebasicinformationoftheworkerwhichisdirectlyrelatedtothelaborcontract,andtheworkershalltruthfullyprovidethesame.
Article9Whenrecruitingaworker,theemployingunitmaynotdetaintheworker’sresidentidentitycardorothercertificates,normayitrequirehimtoprovideguarantyorcollectmoneyorthingsofvaluefromhiminothernames.
Article10Toestablishalaborrelationship,awrittenlaborcontractshallbeconcluded.
Intheeventthatnowrittenlaborcontractisconcludedatthetimewhenalaborrelationshipisestablished,suchacontractshallbeconcludedwithinonemonthasofthedatewhentheemployingunitemploysaworker.
Whereanemployingunitandaworkerconcludealaborcontractbeforethelatterstartstowork,thelaborrelationshipshallbeestablishedasofthedatewhenthelatterstartstowork.
Article11Intheeventthatanemployingunitfailstoconcludeawrittenlaborcontractwithaworkeratthesametimeasitemployshim,andlaborremunerationagreeduponwithhimisnotdefinite,theremunerationshallbedecidedonaccordingtotheratespecifiedinthecollectivecontract;wherethereisnocollectivecontractorthecollectivecontractissilentonthematter,equalpayforequalworkshallbepracticed.
Article12Laborcontractsconsistoffixed-termlaborcontracts,open-endedlaborcontractsandlaborcontractsthatexpireuponcompletionofgivenjobs.
Article13Afixed-termlaborcontractisonetheendingdateofwhichisagreeduponbetweentheemployingunitandtheworker.
Anemployingunitandaworkermayconcludeafixed-termlaborcontractuponreachingconsensusthroughconsultation.
Article14Anopen-endedlaborcontractisonewheretheemployingunitandtheworkerhaveagreednottostipulateadefiniteendingdate.
Anemployingunitandaworkermayconcludeanopen-endedlaborcontractuponreachingconsensusthroughconsultation.Ifaworkerproposesoragreestorenewthelaborcontractortoconcludealaborcontractinanyofthefollowingcircumstances,anopen-endedlaborcontractshallbeconcluded,unlesstheworkerrequeststheconclusionofafixed-termlaborcontract:
(1)Theworkerhasbeenworkingfortheemployingunitforaconsecutiveperiodof10ormoreyears;
(2)Theworkerhasbeenworkingfortheemployingunitforaconsecutiveperiodof10ormoreyearsbutlessthan10yearsawayfromthestatutoryretirementagewhentheemployingunitintroducesthelaborcontractsystemorwhentheState-ownedenterprisehastoconcludeanewlaborcontractwithhimasaresultofrestructuring;or
(3)Theworkerintendstorenewthelaborcontractafterhehasconsecutivelyconcludedafixed-termlaborcontractwiththeemployingunittwiceandhehasnotbeenfoundinanyofthecircumstancesspecifiedinArticle39orSubparagraph
(1)or
(2)inArticle40ofthisLaw.
Ifanemployingunitfailstoconcludeawrittenlaborcontractwithaworkerwithinoneyearasofthedatewhenitemploystheworker,itshallbedeemedtohaveconcludedanopen-endedlaborcontractwiththelatter.
Article15Alaborcontractthatexpiresuponcompletionofagivenjobisoneinwhichtheemployingunitandtheworkerhaveagreedthattheperiodforcompletionofthegivenjobisthetermofthecontract.
Anemployingunitandaworkermay,uponreachingconsensusthroughconsultation,concludealaborcontractwhichexpiresuponcompletionofagivenjob.
Article16Alaborcontractshallbecomeeffectivewhentheemployingunitandtheworkerreachagreementthroughconsultationthereonandbothpartiessignoraffixtheirsealsonthecopiesofthecontract.
Theemployingunitandtheworkershalleachkeepacopyofthelaborcontract.
Article17Alaborcontractshallcontainthefollowingterms:
(1)name,domicileandlegalrepresentativeortheprincipalleadingpersonoftheemployingunit;
(2)name,addressandthenumberoftheresidentidentitycardorofothervalididentitydocumentsoftheworker;
(3)termofthelaborcontract;
(4)jobdescriptionandtheplaceofwork;
(5)workinghours,restandvacation;
(6)laborremuneration;
(7)socialinsurance;
(8)occupationalprotection,workingconditionsandprotectionagainstoccupationalhazards;and
(9)othertermswhicharerequiredtobeincludedinalaborcontract,asprovidedforbylawsandregulations.
Inadditiontotherequisitetermsmentionedabove,anemployingunitandaworkermayagreetohaveothermattersstipulatedinthelaborcontract,suchasprobationperiod,training,confidentiality,supplementaryinsuranceandwelfarebenefits.
Article18Ifadisputearisesbecausethelaborremunerationrate,thestandardforworkingconditions,etc.arenotdefinitelyspecifiedinthelaborcontract,theemployingunitandtheworkermaynegotiateanew.Ifthenegotiationisunsuccessful,therelevantstipulationsofthecollectivecontractshallbeapplicable.Ifthereisnocollectivecontractorthecollectivecontractissilentontheissueoflaborremuneration,equalpayforequalworkshallbepracticed.Ifthereisnocollectivecontractorthecollectivecontractissilentonthestandardsforworkingconditions,etc.,therelevantregulationsoftheStateshallapply.
Article19Ifthetermofalaborcontractismorethanthreemonthsbutlessthanoneyear,theprobationperiodmaynotexceedonemonth;ifthetermismorethanone
